79-38-84- 135 Appearance of Bill McMillan concerning building code violation at the
(6) United _Supermarket at 50th Street and Slide Road.
Mr. Bill McMillan appeared before the Council at the request of the Building Board
of Appeals for the reason of an alleged building violation with respect to the
remodeling of the supermarket located at 50th Street and Slide Road. The nature
of the violation relates to the use of wood shingles on a canopy attached to the
roof of the building .
Mr. McMillan indicated that on July 12, 1978, he was issued a building permit following
the presentation of plans and specifications of the proposed remodeling job, said
plans and specifications reflecting the anticipated use of the wood shingles on
the canopy. Four days prior to the completion of the entire project, the contruction

job was red tagged due to the alleged violation of the Building Code. Mr. McMillan,
having workmen and materials on hand completed the job thereafter. His appearance
as this stage was for the purpose of requesting exemption from the red tag due
to a deviation from the Building Code on this particular building.
Extensive discussion ensued during which it was pointed out by City Attorney John
Ross that the Council does not have the authority to waive an ordinance now incorporated
into the Code; that the only means by which the matter could be remedied would
by amending the Building Code Ordinance in which shingles would be permitted in
Fire Zone No. 2; that the Building Board of Appeals recommendation to Mr. McMillan
that the Council could waive the Building Code was erroneous and that he had been
misdirected. It seems that to permit this type of material in Fire Zone No. 2 -
the issue of the violation - could increase the key rate on the insurance premium
paid by the City. Mayor Pro Tem Henry suggested that possibly a ruling from the
State Board of Insurance could be obtained as to the type of contruction and roof
affected in Fire Zone No. 2 inasmuch as this canopy is not a structural part of
the roof; that should this type of construction be permitted in Fire Zone No. 2,
what effect, if any, would it have on the key rate of the City's Fire Insurance
coverage.
In response to Council's query, Mr. McMillan indicated to remove the shingles and
to replace with a fire retardant material would cost in the area of $15,000.00.
Following the discussion, the motion was made by Mayor Pro Tem Henry, seconded
by Councilman Aderton to request the Mayor to write the State Board of Insurance
requesting their interpretation of a mansard roof not structurally a part of the
building, as compared to mansard roofing material used where it is a structural
part of the building; and additionally, what effect there would be on Fire Insurance
rate in Lubbock if the Building Code requirements were changed to allow wood shingles
in Fire Zone No. 2. Mayor Pro Tem Henry did point out that while they were awaiting
the response from Austin, that Mr. McMillan would not be subject to any penalty
or no action would be taken in this matter, to which Mr. Bertram concurred. Motion
carried: Mayor West, Mayor Pro Tem Henry, Councilmen Aderton and McAlister voting
Yea; none voting Nay; Councilwoman Jordan absent. (A complete transcript of this
portion of the meeting is on file in subject file entitled: "Bill McMillan - Building
Code Violation")

AMOUNT OF SAID MONTHLY ADJUSTMENTS; DEFINING COST OF GAS; ESTABLISHING AN EFFECTIVE
DATE; AND CONTAINING A SAVINGS AND SEVERABILITY CLAUSE.
Ma'yor.{Pro Tem Henry presiding.
In anticipation to her being absent at today's Council Meeting, Councilwoman
Jordan indicated that she would support this ordinance provided that there
be provision for the staff person replacing Mr. Ervin Looney to be responsible
for ongoing study to determine if these rates are applicable to Pioneer's cost
of doing business in Lubbock, and that if it is found that they do not represent
the cost of doing business in Lubbock, that a provision be made for accounting
and refund to the gas customers.
City Manager Larry Cunningham responded to the Council's request to determine
an estimated cost to have an outside firm review their studies; that these
two different firms had been contacted, both of which were reluctant to give
an estimated cost of review, for they felt the need to visit with the City
and with Pioneer people to determine what was involved. Director of Finance
Sterling Miller indicated that Touche-Ross Firm had performed in similar study
for the City of Garland, Texas, and the fee they received was $12,000.00.
Following discussion, Councilman McAlister suggested that the Ordinance be
amended to reflect the concerns expressed in the discussion, and made the motion
that an amendment be added that the City Rate Analyst review the method of
allocation on the part of the total revenue deficit which is to be paid by
the City of Lubbock, to determine that such allocations are fair and equitable.
That would be the first part of the amendment. The second part would be that
if the City Rate Analyst finds that the method of allocation in question is
not fair and equitable, that he is to file his findings with the City Council
which will thereby take appropriate action authorized by law, which action
may include a new rate hearing to consider an accounting and refund order.
Motion to amend referenced ordinance was seconded by Councilman Aderton. There
being no further discussion, the motion carried: Mayor Pro Tem Henry, Councilmen
Aderton and McAlister voting Yea; none voting Nay; Councilwoman Jordan absent;
Mayor West abstaining. Mayor Pro Tem Henry once again commented for the record
that Councilwoman Jordan had expressed her intent and was supportative of this
ordinance as amended.

Aderton to pass said ordinance on second and final reading as amended.

the poor.
Motion was made by Councilman Aderton, seconded by Mayor Pro Tem. Henry
to pass said ordinance on first reading. Before balloting, the Council
queried as to the method recommended for implementing the reduction,
to which the City Manager replied that one from each classification
whose term next expired could be eliminated, or, in the alternative,
should a member have excessive absenteeism and be a noncontributory
member of the Commission at this time, that position could be reduced
prior to expiration of term. They proceeded with the balloting at this
point. Motion carried: Mayor West, Mayor Pro Tem. Henry, Councilmen
Aderton and McAlister voting Yea; none voting Nay; Councilwoman Jordan
absent.

NOTE: Master Application filed with Resolution No. 65 entitle, Master
Application with Aetna Variable Annuity Ins. Col - Deferred Comp.
Aetna Variable Annuity Life Insurance Company has advised the City that
the Federal Government has now imposed limitations as to the amount
of money that a participant may invest in such a plan in any one year.
Regulations provide that a participant may invest $7,500 or 33 1/3%
of his compensation, whichever is the lessor amount. The change in
these regulations necessitates an amendment to our existing plan.
Motion was made by Councilman McAlister, seconded by Councilman Aderton
to pass Resolutions 64 and 65. Motion carried: Mayor West, Mayor Pro

Nay; Councilwoman Jordan absent.
79-38-102-165 Ordinance No. 7809
(36)
Ordinance amending Ordinance No. 7674 regarding a Deferred Compensation
Plan for City of Lubbock employees.
ORDINANCE NO. 7809
AN ORDINANCE AMENDING ORDINANCE NO. 7674 OF THE CITY OF LUBBOCK TO
SET OUT THE PARTICULARS OF THE ESTABLISHMENT OF A DEFERRED COMPENSATION
PLAN FOR CITY OF LUBBOCK EMPLOYEES.
The referenced ordinance relates to the above Resolutions - 64 and 65.
It is recommended that this program be administered by a committee appointed
by the City Manager and that said committee should be charged with administrIation
of this plan.
Motion was made by Councilman McAlister, seconded by Councilman Aderton
to pass said ordinance on first reading. Motion carried: Mayor West,
Mayor Pro Tem Henry, Councilmen Aderton and McAlister voting Yea; none

79-38-102-166 The continuation of Industrial Gas Rate Hearin
(37)
City Attorney John Ross indicated that we had proceeded on several hearings
on the industrial gas rate case; that we were at the point in the hearings
where Mr. Looney, Rate Analyst, had given evidence and testimony to
the City Council, sitting as the regulatory body; that the Pioneer Natural
Gas Co. had not exercised their constitutional right to cross-examination
before Mr. Looney's untimely passing. Therefore, there resulted a
constitutional problem.
Mr. Ross then suggested the following options that could be taken:
1. Dismiss the hearing and start all over again, which would
require the City to retain new experts to take new investigation,
probably working with a new test year;
2. Try to enter into some type of agreement to hire new experts
at this point and continue with the existing hearing; however,
that would still entail the new experts going through the books
and satisfying themselves that they could answer any questions
and present evidence that they feel they could stand on;
3. If the Gas Company is willing at this point in time to sit down,
based on the evidence that has been presented, and would consent
to negotiating on a contract basis for all members of this
class - we may be able to conclude a contractual rate base,
as opposed to a rate base ordered by the regulatory authority
in a shorter period of time at less cost to tax payers, and
to the company.
103
Mr. M. D. Lagrone, Vice President for PNG, stated that he did not want
to go through another industrial case like that of last year's; that
it was time consuming and expensive. Mr. Lagrone stated that they wer
agreeable to negotiate and felt that the third option, suggested by
Mr. Ross, would be a better solution.
The motion was made by Councilman McAlister, seconded by Councilman
Aderton that the previous case be dismissed and to establish negotiations
with Pioneer Gas to see if the industrial rate can be resolved. Motion
carried: Mayor Pro Tem Henry, Councilmen Aderton and McAlister voting
Yea; none voting Nay; Councilwoman Jordan absent; Mayor West abstaining.
(A complete transcript of this discussion and action is on file in the
City Secretary's Office).

79-38-104-175 An appropriation ordinance from Street Improvement Fund for paving
(47) improvements on Indiana Avenue from 95th Street to 103rd Street
The above referenced appropriation ordinance is related to Bid No. 5142
(above) and is from Street Capital Improvement Fund in the amount of $136,919.62.
The property owner's cost is $81,013.35; the City's cost is $36,920.42;
and pre -paid amount is $18, 985.85. The City's portion will come from
Revenue Sharing Funds.
Appearance: Ken Flagg
There are three developers participating in this project. Mr. Flagg's
dilemma results from the fact that one of the participants in this project
has failed to submit his proportional share for the cost of paving, all
monies to be received by the City prior to awarding the bid. The dilemma
is further compounded by the fact that: 1. that a request for an extension
from the low bidder has already been granted once; 2. that the bid expires
on this date (February 8, 1979). Mr. Flagg appeared before the Council
to request their consent to a "guarantee" from a local lending institution
for the third party's sum which is due; that he was not wanting to request
the contractor for another extension; that the other members of the development
team were unwilling to put up the money for the third party for some reason;
and in the alternative he was requesting the Council to approve awarding
the bid under the terms of "guarantee".
The City Attorney John Ross indicated that this would not be appropriate
or in keeping with the City Policy and suggested possibly a cashier's
check could be submitted by the third party to be held until the appropriate
time as stated by the third party; that an additional extension could
be requested from the contractor; or that Mr. Flagg submit to the Council
an unconditional letter of credit on behalf of the third party or the
other two members of the development team.
After much discussion, by consensus the Council agreed to table the matter
until after lunch to allow Mr. Flagg time to obtained either a cashier's
check, an unconditional letter of credit, or the two remaining members
of the development team put up the money on behalf of the third party.
At midafternoon, Mr. Flagg again reappeared before the Council and indicated
that the three recommendations indicated above did not seem feasible or
acceptable to the two members of the development team, and they had decide
to negotiate with the third party regarding this matter and those legal
papers were not in proper form and ask that the matter be continued to
the February 22, 1979, regular Council meeting; that he would again ask
the contractor (Kerr Construction Company) for an additional extension
of two weeks.
