At this point, Fred Senter, Jr., City Attorney, expressed concern that if any of those buses are put out of service, at any time, the City is required to reimburse the State and UMTA, stating that management contract is needed before buses are purchased. It was the consensus of the Council that the Staff be instructed to begin negotiations for management contract. The vote on the original motion was as follows: Mayor Bass, Councilmen West, Jordan, Henry voting Yea, Councilman Campbell voting Nay. At this point, Mayor Bass announced that the City Council will hold an executive session today following the regular City Council meeting to discuss personnel matters, in accordance with Section 2E, Article 6252-17, V.A.T.S. Tom Foster, Fire Chief, discussed the loca- tion of the street in relation to movement of fire trucks and accessibility to gas pumps. After consideration of all information presented, motion was made by Councilman Henry, seconded by Councilman Campbell, motion carried, Mayor Bass, Councilmen West, Jordan, Henry and Campbell voting Yea, none voting Nay to close Avenue K by the mire station and open 5th Street. 75-34-450-1080 The City Council considered a request of the Governor's Office for a Tax Assessor to participate (28) in a State Tax Study. N.B. McCullough, City Manager, stated that John Brooks, City Tax Assessor - Collector, had been asked to be allowed to participate in a study to make a determination of school districts' ability to support public education based on the value of taxable property in the district. This would require that Mr. Brooks be away from the City for approximately five months during this study period. Mr. McCullough stated that it would be his recommendation that this request not be approved because of the length of time involved in this study. John Brooks appeared before the City Council expressing reluctance to participate in this tax study because of the time it would require away from his duties. After consideration of all information presented, motion was made by Councilman Henry, seconded by Councilman West, motion carried, Mayor Bass, Councilmen West, Henry and Campbell voting Yea, Councilwoman Jordan voting Nay to follow the Staff recommendations that this request not be approved.
