David Jones, Senior Planner, presented the recommendations of the Planning and Zoning Commission. At Mayor Bass' request, Mrs. Mary Vines, a member of the Planning and Zoning Commission came forward and made comments on Condition No. 2 prohibiting billboards, as recommended by the Planning and Zoning Commission. Mrs. Vines stated it was the opinion of the majority of the Planning Zoning Commission members that, because of the loca- tion of this triangular tract of land, uses were limited, and they did not want to limit use of adjacent property as residential area. That was the reason for the restriction on billboards, they did not want to hinder develop- ment of the other areas. No one else came forward; whereupon, Mayor Bass announced that the hearing was closed. After consideration of all information presented, motion was made by Council- man West, to uphold the recommendations of the Planning and Zoning Commission except to delete Condition No. 2 regarding billboards, and, on Condition No. 3, grant a building height of 35' with "M-1" zoning. This motion died for lack of a second. Motion was made by Councilman Henry, seconded by Councilman West to uphold the recommendations of the Planning and Zoning Commission, except to delete Condition No. 2 regarding billboards, and change Condition No. 3 to a 30' building height (including billboards in "M-1"). After still further discussion, motion was made by Councilman Campbell, second- ed by Councilman West, to uphold the recommendations of the Planning and Zoning Commission and pass Ordinance No. 7121 on first reading with the follow- ing changes in conditions: Condition No. 2, concerning billboards to be omitted. Condition No. 3, building height be limited to 301, including billboards in "M-1". That outside storage be no higher than screening fence. Tied to Specific Use requirements: Section 22.2-6 - "A building permit for development of the subject property shall be applied for and secured and thirty (20) percent of the development shall be completed within twenty-four (24) months of the effective date of the zone change, or all undeveloped property shall automatically revert back to the pre- vious zoning classification:" Section 22.3-1-5 - "Conditional uses permitted shall be limited to those uses permitted in "C-4" and "M-1" Districts." Councilman Campbell asked that the above motion be amended to add that "M-1" and "C-4" portions be limited to Specific Use; that as they develop each tract, a site plan be presented for approval, Specific. Use and site plan applied to each tract individually, with a buffer as proposed by proponents in this zone case. Councilman West accepted this amendment to the motion.
