(3 )
In accordance with the above Notice of Zoning Hearing, hearing was held on Zone Case No. 1067-A -
Request of Roy Middleton to change property located at the southeast corner of 66th Street and
Indiana Avenue from "R-1" to "C-2" zoning district and to reduce the 130 foot building setback
line to 60 feet from Indiana Avenue and to delete the screening fence requirement along the north
side of property covered by Ordinance No. 4391, Zone Case No. 1067. The Planning and Zoning
Commission recommended that this request be granted for change to "C-2" zoning district, subject
to the following four conditions:
1. That a 60 foot building setback be observed from Indiana Avenue and from 66th Street.
2. That a 50 foot building setback be observed from the east property line.
3. That a 6 foot high solid permanent type screening fence be erected and permanently
maintained along the east property line. Said fence to be erected prior to or con-
currently with the first building permit on the property. Only "pedestrian type gate
openings shall be permitted. The fence shall be slanted or stepped down beginning at a
point 25 feet from the 66th Street property line to a 2k foot height at the 66th Street
property line.
4. Three square feet of paved off-street parking space shall be provided for each square
foot of total building floor area.
The Mayor read the following letter of opposition from Mr. Sid Burleson requesting that a 6 foot
high screening fence be erected on the west property line if the property is re -zoned.
Our home is located on the corner of Indiana and 68th Drive, directly west of this property.
Our property values are certain to be reduced if a retail center is built across the street
from us. If this area is to be zoned for retail use, we feel that a 6-foot high solid
screening fence should be erected on the west property line (along Indiana Avenue.) The
Planning and Zoning Commission recommends such a fence on the east property line.
