or permitted, in which case such construction or maintenance shall be in strict accordance with
such statute or order; provided, however, all materials and workmanship employed in the construc-
tion and maintenance of the.Electric Supply Line shall be subject to the approval of Santa Fe.
3. Licensee shall, at Licensee's own cost, remove all combustible material from around wooden

Licensee hereby agrees to reimburse Santa Fe for the expense so incurred.
4. During construction and while repairing, renewing or changing the Electric Supply Line,
Licensee shall exercise utmost and extraordinary diligence to the end that no damage shall occur
to the property of Santa Fe, and that there shall be no interference with the operation of its
railroad. Upon completion of.the Electric Supply Line or after the making of any changes, repairs
or renewals, Licensee shall, at Licensee's own cost,.restore said premises to their former state;
and Licensee shall, within fifteen (15) days after receipt of bill therefor, pay to Santa Fe the
entire cost incurred in employing watchmen or such other means of protection as in the judgment of
Santa Fe may be required during the construction, maintenance, repair, renewal or changing of the
Electric Supply Line.
5. If at any time during the term hereof Santa Fe shall desire,to make any use of its pro-
perty with which the Electric Supply Line will in any way interfere, including the relocation of
existing or the construction of new lines of poles, wires, conduits and other facilities in which
it shall have an interest, Licensee shall, at Licensee's own cost, within thirty (30) days after
receiving written notice from Santa Fe to such effect, make such changes.in-the Electric Supply
Line as in the judgment of Santa Fe may be necessary to avoid.interference with the proposed use
of its property.
6. Santa Fe shall have the right at its election itself -to construct the Electric Supply
Line, and at any time to make such repairs, renewals or changes therein as it may deem necessary
or desirable, and in the event Santa Fe shall decide to exercise such right, Licensee shall advanc
to Santa Fe the cost, as estimated by Santa Fe, of such construction, repair, renewal or change.
If the actual cost incurred by Santa Fe in performing such work shall prove more or less than the
amount so advanced, the difference shall be promptly paid by Licensee or refunded by Santa Fe, as
the case may be. Santa -Fe may, at its election, advance the necessary moneys to cover such cost
and, in that case, Licensee agrees promptly upon demand to payto Santa Fe all sums so advanced,
with interest.
7. Licensee shall at all times indemnify and save harmless Santa Fe and other companies
operating over its tracks against, and shall pay in full, all loss, damage or expense that they, I

including any such loss, damage or expense arising out of.(a) loss of or damage to property, (b)
injury to or death of persons, (c) mechanics' or other liens of any character, or (d) taxes or

Fe shall be liable for any damage, howsoever caused, to the Electric Supply Line, whether due to
negligence or otherwise.

days after written demand for such performance or compliance shall have been made upon Licensee by
Santa Fe, Santa Fe may, at its election, without notice, forthwith -revoke this license, and in
case'of such election, or upon any termination hereof, Licensee shall, upon request, forthwith
remove the Electric Supply Line and restore said premises to the condition in which they were
prior to -the construction of the Electric Supply Line. In case Licensee shall fail to make such
removal or restoration within -thirty (30) days, Santa Fe may proceed with such work, and Licensee
shall promptly repay to Santa Fe the cost thereof. No waiver by Santa Fe of any default or
defaults, or the right to terminate this license, shall be deemed or held to be a waiver of the
right to terminate the same for any subsequent default or defaults, but notwithstanding such waiver

(33) Councilmen Granberry, Hollingsworth, Rigsby, and Turner voting Yea, none voting Nay, that Council-
man Deaton Rigsby and Councilman'Lonnie F. Hollingsworth meet with the Lubbock Independent School
District Board in connection with appointment of the 1969 Tax Equalization Board.
69-28-170-399 Mr. Joe Blain of IBM appeared.before the City Council and presentee] information in connection with
(35) operation of the IBM equipment by the City of Lubbock. Mr. Charles Hanson and Mr. Charles Marlow
of IBM were also present in the Council Chamber. Mr. William Gribble of MAI also appeared before
the City Council and presented information on MAI equipment. The following information as to
computor disk drives in the Data Processing Department was given the City Council:
Under the present lease contract with IBM for the computor system which we installed in October,
1968, we're leasing three IBM 2311 Disk Drives. The rental price for the Disk Drives if $598 per
month each. MAI has offered to lease Disk Drives marketed by that company and manufactured by
Memorex Corporation. The MAI 2301 Disk Drives rent for $500 per month each, and they are plug -to -
plug compatible replacements for -IBM 2311 Disk Drives. There are several advantages to the MAI
proposal and possibly some disadvantages. The City would -realize a savings of $270 per month or
$3,248 per year by taking advantage of the MAI proposal. The average access time of the MAI Disk
Drives is fifty miliseconds whereas it is seventy-five.miliseconds with IBM. The City has leased
unit record equipment -manufactured by IBM from MAI for approximately two years and our experience
under that contract was entirely satisfactory. The disadvantages could possibly be that the use
of other equipment would lead to a departure from the -total systems approach previously pursued by
the City. The City would have to pay freight out on the.IBM.equipment in the event of a change -
out and freight in on the MAI equipment. This would amount to approximately $600 for each change -
out, or a total of $1,800 for the three units. Under the IBM agreement fifty-five percent of the
lease payments for Disk Drives during the first two years of the contract can be applied toward
the purchase price, whereas no credit is offered by MAI. There are -other factors to consider
also in that IBM would not provide maintenance service support on equipment manufactured by some-
one else. Of course, IBM would continue to offer guidance on their portion of the computor system
and maintain the equipment manufactured by IBM. However, MAI installations appear to be satis-
factory and others have enjoyed good experience under such contracts. Lubbock National Bank has
used MAI Disk Drives for approximately.three months and we have observed their performance during
that period. Bank officials advise that the performance of MAI has been entirely satisfactory
and their experience has been good following some initial disagreement in the area of maintenance
responsibility. In evaluating all avaiable information and considering all factors, it is
recommended that the proposal by MAI be accepted and that the City of Lubbock take advantage of
the opportunity to save $3,240 per year on these three Disk Drives in the computor system.
After consideration of the above information, the City Council took thisitem under advisement
until additional information could be secured by IBM, MAI and the City staff.

Attention: Mayor W. D. Rogers, Jr.
Gentlemen:
April 11, 1.969
re: N.E. Lubbock Area 1-629 Lubbock County, Texas
Recently,.Coastal States Gas Producing Company has been buying leases on acreage lying..northeas:t
of the City of Lubbock. In this regard, Costal would like to purchase a lease from the City of
Lubbock on Section 2, Block D-3, G. C. & S.F. RR Co. Survey, containing 640 acres of land, and
the north one-half of Section 41, Block A, H.E. & W. T. Ry. Co. Survey, containing 320 acres of
land, Lubbock County, Texas.
Enclosed herein are two -originals and three (3) copies each of two Oil, Gas and Mineral leases.
These leases follow as closely as possible the terms and provisions found in that certain Oil,
Gas and Mineral Lease.dated February 22, 1968, from the City of Lubbock to Joe G. Sauer. We have
used this "Sauer" lease as a guide in preparingours because it apparently was acceptable to the
City Council of Lubbock as well as Mr. Fred Senter, City Attorney, who approved it as -to form and
the Lubbock Municipal Airport Board: I have been discussing the procedure and format in present-
ing these leases to the City with Mr. Kenneth Jones of the Legal Department.
As mentioned, I have followed the terms, etc. found in the "Sauer" City of Lubbock Lease, which
,contains a 1/8 royalty with a one dollar per acre rental -for a five (5) year primary term lease.
Also, Coastal will pay a.lease bonus of twenty dollars ($20.00) per acre for the lease. This
would total $12,800.00 for the 640.00 acre lease and $6,400.00 for the 320.00 acre lease (total
$19,200.00), proportionately reduced only in the event that the City owns less that 100% of the
minerals in each tract. At.the City of Lubbock's convenience I will be happy to appear in Lubbock
to discuss the leases involved at any time, as our attorneys have advised us that leasing from a
municipality usually•requires.advertising and bids due to laws governing the incorporation of a
city. In.the event this is required in this situation, please advise as we would like to start
the preliminary steps for leasing within the next few days.
Sincerely,
COASTAL STATES GAS PRODUCING COMPANY

the City Council. Mayor Rogers stated he would discuss installation of these signs with the State
Highway Department.
69-28-172-409 The City Council considered making right -turn on red at traffic signals. Mr. David Collier,
(19) Chairman of the Citizens' Traffic Commission, and Mr. Joe Kelly, Executive Secretary of the
Citizens' Traffic Commission, appeared before the City Council.' Mr. Collier stated to the City
Council that since the State law prohibits a right -turn on red after stopping at a traffic signal
the Citizens' Traffic Commission recommends that the State law be followed. Motion was then made
by Councilman Hollingsworth that the City discontinue the practice of right -turn on red and put
up signs saying, "Right -turn on Red After Stop". This motion died for lack of a second. Motion
was then made by Councilman Granberry, seconded by Councilman Hollingsworth, motion carried,
Mayor Rogers and Councilmen Granberry, Hollingsworth, Rigsby, and Turner voting Yea, none voting
Nay, to table until additional information can be secured and the City Attorney can give the City
Council a specific recommendation as to the legality of allowing a right -turn on red after stop-
ping.

69-28-176-415 Approximately 100 persons were present in the Council Chamber for discussion of the 10.2 million
(40a) dollar electric revenue bonds that failed to carry on May 6, 1969.
The following speeches were made by Councilman Turner and Councilman Rigsby. Speeches made by
Mayor Rogers and Joe Stanley are set in on the opposite -page.
Councilman Turner:
The Electric Bond issue has been certified correct..
And it has been turned down by the voters. The issue is closed, and it's past history.
Now..Only two days after this election, I would like to make a statement that may seem strange,
since it follows a defeated bond issue so closely...
We must look at the future of Lubbock..And the things that must be done —And done soon!
I believe Lubbock needs a Civic Center, and this will require a Bond Election...
Its a fact Lubbock must improve and enlarge its airport facilities now —and this will require a
Bond Election.
Lubbock must expand and improve its recreational facilities, and this will require a bond
election.
There are more things this City must do —and do now..
And I urge my fellow councilmen NOT to sit back and stay quiet because of past history.
We must work hard to make a Lubbock a really great city, and it is our obligation to continue
to give the voters the opportunity to deter ine the progress of the City of Lubbock.
I pledge all of my efforts toward a continuing program to improve Lubbock's business climate,
Recreation facilities and keep Lubbock as a great place to raise a family.
The Council must give the citizens of Lubbock the opportunity to vote on these things.
I will make every effort to see that they are not put on the shelf:'
Councilman Rigsby:
Good Government is by consent of the people. By the consent of the people we serve.
We are obligated, from time to time, to present to the people for their consideration, certain
issues.
If we failed to properly inform the people as to the facts as we see them, we are derelict,
no one else.
In LP & L we have one of the City's greatest assets. If we, by any omission, fail to make known
the facts as we see them, then by default we offer the -opportunity for opposition, however moti-
vated, to defeat any issue, no matter how vital.
Let this be our lesson - the opposition wi-11 unite and will oppose - we must assume our responsi-
bility, submit issues we feel necessary and vital for the health, safety, and general welfare of
Lubbock, then support them with our every energy.

Mr. Robert L. Isom, Jr., addressed the City Council and made the following statement: "I opposed
it (the bond issue) because I don't think it's managed as -it should be ...... and too much of it's
profits are put into the general fund. I don't feel I owe any apology for opposing this brand

TION SHOULD BE RESTRICTED UNDER ANY CIRCUMSTANCES FROM VOICING
AN OPINION ON ANY ISSUE WHATSOEVER.
A-S A MATTER OF FACT, I,, LUZ YOU, WILL FIGHT TO PRESERVE
THIS RIGHT WHICH IS THE BACKBONE OF OUR DEMOCRACY. FURTHER,
L WOULD LIKE TO ADD I AM NOT CASTING ANY REFLECTION WHATSOEVER
ON ANY INDIVIDUAL WHO VOTES FOR OR AGAINST ANY PROPOSITION
BASED ON HONEST CONVICTIONS, AND WHO DOES NOT PARTICIPATE, OR

FORTUNATELY, A MAJORITY OF OUR CITIZENS, REGARDLESS OF THEIR
CONVICTIONS, REFRAIN FROM USING THIS RIGHT TO MAKE STATEMENTS
WHICH ARE COMPLETELY AND TOTALLY FALSE. HOWEVER, THERE SEEM-

69-28-177-416 Dr. George Farrell, Chairman of the City -County Health Board, and Dr. David Cowgill, Director of
(36) the City -County Health Department, appeared before the City Council and recommended approval of
expanding the Air Pollution Control Program. Under this proposal the total program would be
expanded at a total cost of $47,057.93; of this amount $31,343.93 would be federal funds and
$15,714 would be non-federal funds. The expanded program would include the addition of laborator3
facilities and a chemist and would also provide some coverage under the Weed Control Program. It
would involve an addition $3,000 outlay on the part of the City during 1969-70 and the chemist
added would be available for other work in the Health Department. The program could be discon-
tinued on thirty days' notice and there would be no obligation to continue if the City elected
not to in the future. Application is to be made to the U.S. Public Health Service by June 1,
1969. After consideration of the above information, motion was made by Councilman Turner,
seconded by Councilman Rigsby, motion carried, Mayor Rogers and Councilmen Granberry, Hollings-
worth, Rigsby, and 'Turner voting Yea, none voting Nay, to approve the City making application for
an Air Pollution Grant for continuation of the Air Pollution Study during the period October 1,
1969 through September 30, 1970. Funds during this period of time will be used to attempt to
determine major air pollution sources looking toward abatement of such sources.
