Mrs. Louise Cummins, President of the League of Women Voters, appeared and made that following statement: Statement to the Lubbock City Council November 13, 1974 a am Louise Cummins, president of the League of Women Voters of Lubbock. Thank you for the opportunity to speak to you today. This morning I am speaking to you as the representative of the following groups: the National Association for the Advancement of Colored People, the East Lubbock Businessmen's Association, El Movimiento Popular, the Lubbock Civil Liberties Union, the Lutheran Council for Community Action, and the Lubbock League of Women Voters. It is the consensus of these groups that calling a charter election to enlarge the council without providing for geographical residential requirements is not appropriate. All of these groups ask that the proposal to expand the council include the provision that each council member live in one of six districts with the entire council and mayor elected at large. We realize that residential requirements cannot be drawn so that all members of the present council could continue to serve on the council after a transitional period and must point out that our request is not intended as a repudiation of your efforts on behalf of the city. We are aware that all of you serve the community conscientiously and well. Any legislative body which has had to face the problem of districting or redistricting has had to deal with this dilemma. We hope, and we are sure, you will not allow this to affect your judgement on this matter. We support the place system with residence requirements because this proposal would afford broader representation instead of additional representation and individual citizens would feel more affinity to a council member from one's own district. This in turn would tend to increase citizen participation in the democratic process. In this plan all citizens would vote for each council member so there would be responsibility and accountability to all citizens. The breadth of representation involves two issues. One is whether or not the council is representative. The other is whether or not the citizen perceives himself to be represented. Accordingly whether or not in fact the present council is or is not actually representative of all the citizens, it is true that in the minds of many the council is not perceived to be representative. We have heard several theories on what might happen if our proposal were to be adopted. The argument has been advanced that people from a district would band together and put up only one candidate and hence provide no choice in the at large election. In communities where this system has been used the projection has not come true. Also, the argument has been advanced that a candidate may try to establish a temporary residence in a district where he believes there is less competition. We think the citizens are astute enough to identify this ploy. Today we ask you to consider two alternatives: Alternative number one is to include a provision for residential requirements within the expansion proposal. Naturally we think this is the simplest solution and the best for all citizens of Lubbock. By doing this you as council members would control the wording of the amendment and the transition schedule. If citizens were to Rlaae the issue on the ballot through a petition drive; ewej understran-d- that the peti+iron must. iitclude .the exact word- ing3.of the amendment and the plan for transition. If the council is unwilling to refer a proposed charter including residential require- ments, then we suggest that the most preferred alternative is to defer calling an election and thereby allow citizens to pursue the initiative procedure. Should you defer calling the election we are prepared to proceed as quickly as possible to secure the necessary signatures for an initiative to amend the charter. If our attempt should fail you would still be able to proceed with your present plan. A vote for deferral would give the citizens of Lubbock an opportunity to indicate their support or lack of support for our proposal. If you decide to passthe ordinance calling for an election to merely expand the council, we have agreed to continue with a petition drive because we feel the real issue here is not expansion but broader representation. speak today not just for one group or individual but for a broad representation of people and groups from many segments of our community. We urge you to give serious and favorable consideration to this request. Dr. J. William Davis, 2830 23rd St., appeared before the City Council. Dr. Davis served as a member of the Charter Study Committee in 1971. From the recommendations of that committee, Dr. Davis made the following proposal: 1. To enlarge the 'XimbersCouncil wouldfrom befpesideur ntsrofnd a and elected from yor to six threergeogaphicalr. 2. Three of the s districts, but voted on by the City at -large. 3. Three of the six would be elected at -large from the City at -large. 4. The Mayor would be elected at -large from the City at -large - (These proposals were read from the recommendations of the Charter Committee as adopted by the committee June 10, 1971.) 412 974 Dr. Davis stated he would like to see geographical districts organized so as to provide a broader base of representation. Others appearing before the City Council in regard to the passage of this ordinance were: Adolphus Cleveland, 2625 E. Auburn, Dr. Vivian Davis 4607 23rd St., a professor at Texas Tech, T. J. Patterson of 2405 Globe Avenue. Dr. Neal Pearson, 3009 25th St., with the Political modified system where some council members have residency requirementsScience Department at Texas Tech appeared and stated that several Texas citi. Froy Salinas and Richard es do have a Ybarra appeared urging passage of the proposal made by Mrs. Louise Cummins. Dr. John Hopkins, 2020 20th St., a member of the Government Department at Texas Tech, appeared and advocated broader geographic representation. Roian Simpson appeared and made a brief statement. After consideration of all information presented, motion was made by Councilman Campbell to adopt the amendment pertaining to Section 5, Article VIII, Chapter 1, regarding the sale of bonds and pass Ordinance No. 6998 on first reading calling a Charter Amendment Election. Council- woman Jordan seconded this motion with a question of procedure, stating she wanted to insure Council - that by passing this amendment, it would not preclude adding more amendments or changes. In answer to her question, City Attorney Fred Senter stated other items could be added. This motion carried by the following vote: Mayor Bass, Councilmen West, Jordan, Henry and Campbell voting Yea, none voting Nay. After more discussion, motion was made by Councilman Campbell, seconded by Councilwoman Jordan, to call the Special Charter Amendment Election January 15, 1975. Atthis time, motion was made by Councilman Henry, to amend the original motion by adding the adoption of Dr. Davis' pro- posal to elect 3 councilmen with residency requirements, with reversionary clause (revert back to at -large representation in case of a court case). This motion to amend the original motion died for lack of a second. The vote on the original motion was as follows: Council- woman Jordan, Councilmen Henry and Campbell voting Yea, Mayor Bass and Councilman West voting Nay. This motion failed to carry because a 4/5 vote is required. Councilwoman Jordan made a motion to reconsider, stating that if we do not have a motion to consider expansion of the Council, we cannot have these other things. She suggested that they begin with the question of salaries, and vote on these one at a time. This motion died for lack of a second. Motion was made by Councilman West, seconded by Councilman Henry, that it be put on the ballot for the charter election, expansion of the City Council to 7 members 6 of them to five in 6 geographical districts, or designated areas, but to be voted on at -large and the mayor to be elected at -large. This motion failed to carry by the following vote: Mayor Bass, Councilmen West and Henry voting Yea, Councilwoman Jordan and Councilman Campbell voting Nay. Motion was then made by Councilwoman Jordan, seconded by Councilman Campbell, that there be added to Article 9, Section 9 of the Charter "Candidates for Councilmen Positions 5 and 6 shall live in the geographical area of the City within the tracts bounded on the south, east and north by the city limits and on the west by a line drawn along Highway 87 from the southern boundary of the City to the traffic circle, Highway 84 from the traffic circle to 4th Street, 4th Street from Avenue Q to Indiana Avenue, Indiana Avenue, from 4th Street to Erskine Road, Erskine Road from Indiana Avenue to Quaker Avenue, and Quaker Avenue to the north city limits." This motion failed to carry by the following vote: Councilwoman Jordan and Councilman Campbell voting Yea, Mayor Bass, Councilmen West and Henry voting Nay. Motion was made by Councilwoman Jordan, seconded by Councilman Campbell, that Article 9, Section 14, be change to read that salaries be changed to $6,000 per year for the Mayor, or $500 per month; $4,800 per year for council members, or $400 per month, and forfeit not be more thm $50 per meeting, that persons currently serving would not be eligible for increase in salary during their present term. Councilman West stated he would not be willing to vote on this item yet until it is decided how to work out the expansion of the Council. This motion was withdrawn. Motion was made by Councilwoman Jordan that Article 11 be added regarding campaign expenditures, total limited to two times the annual salaries for positions being sought. This motion died for lack of a second. Motion was then made by Councilman Henry, seconded by Councilwoman Jordan, that Dr. Davis' Proposal be reintroduced: In regard to expansion of the Council to 7 members, Mayor elected at -large, 3 with residential requirements and 3 without residential requirements, all elected at -large. This motion failed to carry by the following vote: Mayor Bass, Councilwoman Jordan and Councilman Henry voting Yea, Councilmen West and Campbell voting Nay. After further discussion, motion was made by Councilman Henry, seconded by Councilman Campbell to hold the rest of these proposals in regard to expansion of the City Council until the Novem- ber 14 City Council Meeting. This motion carried, by the following vote: Mayor Bass, Council- men West, Henry and Campbell voting Yea, Councilwoman Jordan voting Nay.
