The Planning and Zoning Commis- sion recommended that this request be granted, subject to the condition that development be tied to the site plan presented at the Planning and Zoning Commission hearing. Mr. Floyd Honey representing the Baxter Honey Estate appeared before the City Council in opposition to this zone change request. Mr. Honey called the Council's attention to the following points: 1. Commercial zoning is premature in Zone Case 1542-Tract 1 because no need exists for a regional shopping center in this area at this time. 2. Adding approximately 70 acres of C-2 commercial zoning to 62 acres of C-4 zoning and 15 or more acres of AM zoning for a total of some 147 acres of commercial zoning in the hands of one owner is unprecedented, it is inequitable, and it will tend to prevent other property owners -in the area from securing commercial zoning on land that has the potential for such zoning. 3. The zoning of a regional shopping center of this magnitude will upset the comprehensive plan for orderly commercial development of Southwest Lubbock as -planned by the Planning Department of the City of Lubbock. 4. The progress of Lubbock will not -be enhanced by unnecessary commercial zoning, which might pull commercial and business -establishments away from downtown Lubbock, from Caprock, Monterey, or other shopping centers, leaving ghost buildings as reminders to everyone that Lubbock is not growing. and prospering as it once was. Mr. Fred West appeared before the City Council and made -comments as to why this was proper zoning for this tract of land. At this time Councilman Turner made remarks as to zoning of other areas comparable to this area. Councilman Turner stated that at the May 2, 1968, meeting of the Plan- ning and Zoning Commission there was no comprehensive plan presented for the area south of Loop 289 and that 3-1/2 days later -there was a plan and two site plans for the shopping center. Mr. Turner stated he objected to zoning of the entire area as he considered it too large and feels it could in no reasonable way be substantiated. Councilman Turner stated: "I am opposed publicly to this zone case as it stands. I am not opposed to this area being developed as a shopping cen- ter. I think it is a logical location, but I do not agree with the size of it and the effect it is going to have on the entire development of .southwest Lubbock ". Councilman Turner then made the motion that Zone Case No. 1542 be Tabled. This motion died for want of a second. Motion was then made by Councilman Granberry, seconded by Councilman Rigsby, motion carried, Mayor Rogers and Councilmen Granberry, Hollingsworth and Rigsby voting Yea, Councilman Turner voting Nay to override the recommendation of the Planning and Zoning Commission and adopt site plan 5B. Ordinance No. 5486 being hereby passed on first reading. ORDINANCE NO. 5486 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1542: CHANGE A TRACT OF LAND OUT OF SECTION 10, BLOCK E-2, LUBBOCK COUNTY, TEXAS, BEING ADJACENT TO THE SOUTH RIGHT-OF-WAY LINE OF SOUTH LOOP r 289 AND WEST OF QUAKER AVENUE FROM AN "R-1" TO A "C-2" DISTRICT: SUBJECT TO CONDITION; AND PRO- VIDING FOR PUBLICATION. 68-27-226-526 In accordance with the above Notice of Zoning Hearing, hearing was held on Zone Case No. 1098-A - (9) Appeal of Jack Kastman (for J. Taylor Evans) to change property located at the northwest corner of Indiana Avenue and 66th Street from "R-111-to "R-3""zoning district. The Planning and Zoning Commission recommended that this request not be granted.' Mr. Jack Kastman appeared before the City Council in support of this zone change request. Mrs. Richard Vardy of 6417 Joliet Avenue appeared before the City Council in opposition to this zone change request. Mr. E. B. Dixon of 6422 Joliet Avenue appeared before the City Council in opposition to this zone change request. Mr. A. N. Baldwin of 6411 Joliet and Mr. Leonard Chaney of 6413 Joliet Avenue appeared before the City Council in connection with this zone change request. The following petition was presented in opposition to this zone change request: PETITION To: Planning and Zoning Commission City of Lubbock Re: Zoning Case #1098 A (Northwest corner 66th St. and Indiana Ave.) JUN 2 6 196 Li Gentlemen: The undersigned petitioners are homeowners of the area in the immediate vicinity of the parcel of land in question at this hearing. The petitioners request that the zoning change from R-1 to R-3 as requested in this case be denied, for the following reasons: 1. The petitioners feel that a change as requested will be injurious to their neighborhood and will cause them personal loss in property value. It should be noted that this inter- section is a "gateway" to Melonie Park addition and the whole addition would be subject to degradation as a result of lowering zoning classification in the area. 2. The City of Lubbock has previously zoned sufficient vacant areas of land in the R-3 class fication. Specifically there are two very large tracts of R-3 zoning and one large area of C-2 zoning immediately to the -East of the case in question. The petitioners feel that the integrity of the remaining vacant areas in Melonie Park should be preserved in an R-1 classification. 3.. The petitioners made careful appraisal of existing zoning in Melonie Park prior to establishing their homes in the area. It was apparent at those times that the area was favorably zoned for a good residential area. We feel it should not be changed at this late date. 4. Reputable builders indicate that the area in question would make prime home sites. One such builder has indicated that he would not hesitate to build speculatively on this site if lots were available. This block of land can be platted in such a way that a large number of lots would be available for home building. It would appear, then, that the present owner of the tract would be able to dispose of the land for this purpose, if -he so desired. The petitioners feel that their interest in their own property should be protected and it is requested that the Planning and Zoning Commission deny any change from the R-1 classification. . .1.
