ORDINANCE NO. 5349 AN ORDINANCE AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, ENTITLED "STREETS ANW IDEWALKS," BY AMENDING SUB -SECTION (£) OF SECTION 28-50 TO PROVIDE AN EXCEPTION TO SIDEWALK REQUIREMENT WHEN AN ADDITION OR IMPROVZEW IS MADE TO EXISTING SINGLE FAMILY RESIDENCE. 67-26-360-925 Mrs. Lavenia Lowe, Secretary (25) City of Lubbock P. 0. Box 2000 Lubbock, Texas Dear Mrs. Lowe: September 26, 1967 This letter is intended as notice to the City which is required under Article VIII, "Claims Against City", Section 2.74 and Section 2-75. I am the owner and resident of the house and lot situated at 1924 - 17th Street, in the City of Lubbock, Lubbock County, Texas, and have owned and resided there for more than six months. On or about the 15th day of April, 1964, there was erected adjacent to my property a 40 foot utility pole. This pole is located on the right-of- way along Avenue T and is approximately midway between 17th Street which runs along the front of my house, and the alley which runs behind my house. Due to the peculiar placement of this pole and its extraordinary height, I am put in constant peril of possible extensive damages which would result if tornadic or other high winds common to the Lubbock area were to cause this pole to fall toward my premises. As a result, my premises have been rendered unsafe to the extent that I am required to live in substantial danger and discomfort, and some of the renters who rent portions of my house have informed me that they, too, are put in constant fear of the fore- going occurrences. Such circumstances have resulted in a $2,000.00 reduction in the market value of my premises, and in addition, I would ask that this pole -be classified as a nuisance and would request that you remove it. It is my understanding that the Southwestern Public Service Company, the Southwestern Bell Telephone Company and the City of -Lubbock all maintain facilities on this pole. , Yours very truly, /s/ Mrs. Henry L. DeBusk Mrs. Henry L. DeBusk The City Council considered the claim of Mrs. Henry DeBusk as set out above. After considera- tion of all information presenped, motion was made by Councilman Kastman, seconded by Council- man Diekemper, motion carried, Mayor Rogers and Councilmen Granberry, Kastman, Diekemper, and Nedlotk voting Yea, none voting Nay, to DENY this request for removal of•a utility pole. 67-26-360-926 Bids as follows were received for purchase of 45' and 50' electric poles for warehouse stock, (19) being Bid No. 9964.
