Senter, Jr. , FRED 0. SENTER, JR., City Attorney 66-25-327-858 (25) Mayor - City Council City of Lubbock P. 0. Box 2000 Lubbock, Texas 79408 Dear -Sirs: W. D. 183MIM, Lubbock, Texas August 23, 1966 In regard to the paving of a portion of 36th Street beginning at Avenue P and extending some 406' west in the 1600 block to a line and -to paving on 36th Street. On the north side of this street as is indicated by Lots Nos. 1606 to 1630 incl. All lots are occupied at present by Mobile Home owners, and each having a frontage of 25'. Head in parking has been in use for these lots for some 14 years and with no congestion of the street to my knowledge. Each lot needs to have the most available parking space possible, which would be the whole 25' and head in parking. To leave off the curb and with only the gutter will accomplish this vital necessity. Since it is physically impossible for 20' curb and a 12' driveway on a 25' lot the only way in which compliance to the City Ordinance would be to curb the whole 325'. Such compliance however would deny each occupant ingress and egress, except to go over the curbing. Such compliance would allow only one average size car to park legally at one time parallel. To head in park or double park on the curb, as is done in down town, would be a nuisance as well as dangerous to the drive ing public. It is obvious my tenants would either double park or head in park or both should the curbing be established. Should my tenants leave would be ruination to my business. Should the curbing be established against my protest I feel this action would be a third attempt to destroy my non -conforming business as well as defiance to the supreme court of Texas. I request a special exception and ask that no curbing be put on this 325' of paving as is shown on map. Thank you. /s/ R. Q. Stubbs P. S. Should tenants be allowed to head in park without curbing they would be able to keep three cars off the paving much better than they could one car parked parallel to curbing on the pavement. Thanks again should you need more thinking material. } UG 2 51W The City Council considered the above request for head -in parking on 325 feet along the north side of 36th Street between Paris Avenue and Avenue P and motion was made by Councilman Kastman, seconded by Councilman Medlock, motion carried, Mayor Rogers and Councilmen Granberry, Kastman, Diekemper, and Medlock voting Yea, none voting Nay, that Mr. Stubbs be required to comply with the City ordinances and regulations covering this improvement. 66-25-328-859 Motion by Councilman Granberry, seconded by Councilman Diekemper, motion carried, Mayor Rogers (26) and Councilmen Granberry, Kastman, Diekemper, and Medlock voting Yea, none voting Nay, that Ordinance No. 5079 be passed on first reading.
