66-25-210-534 In accordance with the above Notice of Zoning Hearing, hearing was held on Zone Case No. 1427 -
(10) Request of Carroll Cobb (for College Heights Baptist.:Church) to change property located at the
northwest corner of 39th Street and Salem Avenue.and that portion of land between 39th and 40th
Streets extending 200' west of Salem Avenue from."R-1"_to "R-2" zoning district. The Planning
- and Zoning Commission recommended that this request be granted, subject to the following two
conditions: i
1. That development be limited to church use only.
2. -That buildings and parking lots be constructed and designated as shown on the plan
presented at the Planning and Zoning hearing, said plan being on file in the office of
the Secretary of the Planning and Zoning Commission.
Mr. Carroll Cobb appeared before the City Council in support of this zone change for College
Heights Baptist Church. Dr. Ben Johnson and Rex Portwood appeared before the City Council in
support of this zone change request. They presented a petition containing approximately 400
names in support of this zone change request.
We, the members, Trustees and Deacons of College Heights Baptist Church, feel there is a
need and ample room for a Baptist Church in this community since there is not a Baptist Church
near to the lots 1, 2, 12 and the eastern half of lot 11, Block 20, College Heights Addition.
There is the Grace Nazarine Church, located at 4523 35th College Heights, Four Square Gospel
- at 4415 35th, the Hiland Assembly of God at 3808 Quaker Avenue. Since these Churches are in the
College Heights addition, we feel that it is unjust to -discriminate against a Baptist Church
having few local residents. The Church owns ample grounds for present parking facilities (70
spaces and 250 auditorium capacity, the ration of parking spaces one to five), in addition to
space for the building of a beautiful, brick church, that will add beauty, as well as help improve
this section of the town! We do not want to hinder or run in opposition to any but would like to
be a blessing to all.
We who live in this section are the first signers, with the signatures of three other
pastors of the College Heights Addition.
Mrs. R. C. Matheny spoke representing the opponents and presented a petition containing approxi-
mately 60 names in opposition to this zone change request.
This petition written April 25, 1966, to be presented at the Planning and Zoning Commission
hearing May 5,-1966.
We, the people of the College Heights Addition, are opposed to a zone change, to allow the
erection of a church, from an "R-1" to an "R-2 " zoning District on Lots 1, 2, 12, and the East
35' of 11, Block 20 and Lot 12, Block 17, College Heights addition for the following reasons:
1. The lack of proper parking facilities for a church, which would result in inconvenience,
nuisance, and invasion of privacy to all residents in the neighborhood.
2. We chose this section of town to live in with the understanding it was a one -family
residential section, and we do not wish it changed.
3. The probable depreciation of property value due to congested traffic, parking, appear-
ance-, and zone change.
4. The increased hazard of church traffic to our children and ourselves.
5. The -resale difficulty due to change in zoning.'
6. Salem Avenue has a bad record for traffic accidents, and the increased traffic and park-
ing on the street plus the possible blocking of view (by building, cars, or -peop-le)-
would increase the danger. - -
7. The increased possibility of future petitions for zoning changes that would permit
building of public institutions that we feel definitely do not have a place in this
area.
After consideration of all facts presented, Mayor Rogers announced that the hearing was closed.
Motion was made by Councilman Granberry, seconded by Councilman Medlock, motion carried, Mayor
Rogers and Councilmen Granberry, Kastman, Diekemper, and Medlock voting Yea, none voting Nay, to
uphold the recommendation of the Planning and Zoning Commission and pass Ordinance No. 5023,on first
subject to the following seven conditions: reading,
1. That development be limited to church only.
2. That building be constructed and parking lots designated as shown on the plan presented
at the hearing. Said plan is on file in the office of the Secretary, Planning and
Zoning Commission.
3. No parking shall be allowed in the front 35 feet of the parking lots.
4. The front 35 feet of the parking lots and the parkway areas along Salem Avenue shall
be landscaped and permanently maintained.
5. A solid 6' permanent type screening fence shall be constructed along the west property
lines of all properties involved and along the north (alley) line of Lot 12, Block 17.
Said fence shall comply with Section 15.1-2-2 of the Zoning Ordinance.
6. Four of the parking spaces, in the center double row of parking, nearest the alley on
lot 12, Block 17, shall be eliminated in order to provide circulation on the lot.
7. The alley to the rear of East 35 feet of Lot 11 and all of Lot 12, Block 20, shall be
paved.
