SPECIAL CALLED MEETING:
The City Council of the City of Lubbock, Texas, met at 11:30 o'clock a.m. in the regular meeting
place in the City Hall, the following members thereof being present to -wit:
Mayor Max Tidmore and Councilmen W.
City Attorney Fred 0.. Senter, Jr.,
er Lavenia Lowe.
Absent: None
E. Alderson, Jack Kastman, Rolan Simpson, and W. E. Medlock,
City Manager William J. Pitstick, Jr., City Secretary-Treasur...
There were also, approximately twenty-five citizens present for this meeting as well as repre-
sentatives of all news media.
66-25-20-45 Session was called to order by the Mayor announcing that this Special Called Session was for the
(1) purpose of hearing a recommendation and report of the City Attorney in relation to Zone Case No.
1369-A and action taken thereon at a Special Called Meeting on January 10, 1966. He announced
that the hearing on Zone Case No. 1369-A, having been held on January 6, 1966, was tabled after
all having been heard who desired to be heard on Zone Case No. 1369-A, and that no one protested
formally to this zone change request at the hearing.
On January 10, 1966, at a Special Called Meeting this Ordinance was called from tabled and passed;
on first reading.
The City Attorney, at the request of the Mayor, reviewed the action of the City Council in
connection with Zone Case No. 1369 and public hearing, thereon together with Ordinance No. 4870,
enacted November 23, 1965, by unanimous vote, and called attention of the Council to a petition
by citizens protesting Zone Case No. 1369 which was filed for consideration of the City Council.
It was reported by City Attorney, subsequent to theSpecial Called Meeting of January 10, 1966,
that it had come to his attention that the land within Zone Case No. 1369-A was identical with
that encompassed in Zone Case No. 1369. In reviewing the names and addresses of protesting
petitioners to Zone Case No. 1369 it was found that the owner's of twenty per cent of the area on
20th Street in front of the lots involved in Zone Case No. 1369-A appeared to have signed the
petition. Thus, it was his opinion, and he had so advised the Mayor, that for the reason that
the area in each zone case was identical with the exception that four and one-half lots were
added to the area in the last zone case, therefore, the petition filed in protest of Zone Case
No. 1369 should have also been considered in declaring the final action on January 10, 1966, on
Zone Case No. 1369-A which would have failed in its enactment for lack of a four -fifths vote as
required by State Statute 1011e.
Upon the receipt of this report from the City Attorney, it was moved by Councilman Alderson and
seconded by Councilman Simpson that the vote by which action was taken on Zone Case No. 1369-A
cm January 10, 1966, be reconsidered. This motion carried by the following vote. Mayor Tidmore
and Councilmen Alderson, Kastman, Simpson, and Medlock voting Yea, none voting Nay.
Mr. Hugh Anderson, Attorney in the meeting representing the home owners protesting this zone
change, stated that no protest in the hearing on January 6, 1966, was made and no new petition
was filed because they thought their protest was covered by the earlier petition and that the
City Council would consider the petition as an objection or protest in connection with Zone Case
No. 1369-A.
Mr. E. G. Pharr, Attorney for proponents of Zone Case No. 1369-A, stated that they desired to
protest any further consideration of this zone change request by the City Council because the
action taken on January 10, 1966, had become final.
The Mayor then called for the vote to be taken on passage of Ordinance No. 4893 on first reading.
The vote was as follows: Mayor Tidmore and Councilmen Alderson and Simpson voting Yea, Council-
men Kastman and Medlock voting Nay. The Mayor, upon recording of vote, declared that Ordinance
No. 4893 had failed to pass by the required four -fifths vote.
Motion was made by Councilman Kastman, seconded by Councilman Alderson, motion carried, Mayor
Tidmore and Councilmen Alderson, Kastman, Simpson, and Medlock voting Yea, none voting Nay, that
the Special Called Meeting be adjourned.
NO FURTHER BUSINESS COMING UP FOR CONSIDERATION, THE CITY COUNCIL ADJOURNED FROM SPECIAL
CALLED MEETING, JANUARY 17, 1966..
