We will handle the City's suit for a contingent fee of 33 1/3% of the net recovery without pay-
ment of any initial retainer fee. By "net recovery" we mean the total amount recovered in suit
or by way of settlement less litigation expense reimbursed to us or incurred with our approval.
This is the same basis on which we are handling these aluminum conductor cable cases for other
cities and electrical cooperatives. Out-of-pocket expenses will be reimbursed as done in the
electrical equipment cases, but we believe that in this case expenses will be almost negligible.
On November 8, 1965 we filed a petition in intervention on behalf of the City in the class actio
pending in the United States District Court in Philadelphia, Pennsylvania, in order to forestall
any adverse effects under the statute of limitations. We understand that this tentative decisio
to bring -suit must-be'approved by the City Council.
If you have any further questions concerning the foregoing, please let me know.
Sincerely,
/s/ James W. Wilson
