The Planning and Zoning Commission recommended that this request be granted subject to the following conditions: 1. Tract E be zoned "C-2A" limited to a Savings and Loan Association. 2. Over-all development be tied to the site plan as presented. Jim Bertram, Director of Planning, presented the recommendations of the Planning and Zoning Commis- sion. Mayor Turner called for proponents and opponents to appear before the City Council. Roy Middleton, representing State Savings and Loan, appeared before the City Council in support of this zone change request. John F. Walkup appeared before the City Council and read a letter from David C. Cummins opposing this zone change. August 23, 1973 To: The Mayor and Council of the City of Lubbock RE: Change of Zone Application Case No. 1910 by State Savings and Loan Association My name is David C. Cummins. I reside at 6511 Peoria Avenue, Lubbock, Texas. I object to the change of zone application by State Savings and Loan Association. THE TOTAL PARK The area bounded by 64th Street, Peoria Avenue, Loop 289 frontage road, and Quaker Avenue is a contiguous tract of land with a playa lake in its geographical center. The tract was for a substantial period of time signed and known as the undeveloped Leroy Elmore Park. Most, if not substantially all, owners and purchasers of property in the surrounding area thought the entire contiguous tract was city -owned park property and would ultimately be developed as such. Publicly distributed maps of the city reinforced this assumption which was proved erroneous when the recent initial park development in the form of tree and grass planting did not cover the southwesterly part of the "park" and, contemporaneously, a sign appeared on that part of the "park" advertising it for sale: It is indeed unfortunate that any part of this contiguous tract is privately owned and subject to private development. The preferred solution would be for the city to acquire this privately owned tract and devote it to park use. I am advised, however, that the city is not financially able to do this. COMPATIBILITY If private development of the southwesterly portion of the contiguous tract is inevitable, it is obvious that such development must be highly compatible with the development and use of f-),n _ , rL ,,,-,,.,,,,. f., 3.30 Alta 2 2 1973 The degree of required compatibility is greater than in the typical situation of adjacent pro- perty because: (1) there is no physical boundary on the ground between the private property and the park property; (2) the playa lake's location in the center of the contiguous tract relates to the private property in the southwest just as it relates to the park property in the southeast, northeast, and northwest portions of the contiguous tract; and, (3) the nature of the park property is such that no structures are planned to be constructed. The result is that, regardless of legal ownership, the privately developed structures will in- trude into and upon what appears to be park property and will dominate over the entire contiguous tract as the sole structures thereon. PRIVATE DEVELOPMENT The proposed development of a savings and loan association building, several medical profes- sional office buildings, and twelve townhouses with the latter perched on the park boundary would destroy the esthetics of the park and preempt use of the southerly portion of the park by all the citizens of Lubbock. The apparent compromise solution is to prevent development of townhouses or any other habitational dwellings, to limit the height of all structures to one story, and to hor- ticulturally screen the private property from the park property so as to make the former as un- obtrusive to users of the park as possible. If that were done the private property would be used nearly exclusively during weekday business hours and the evening and weekend hours would be the most intensive usage hours of the park property. Traffic and consequent safety problems would also be alleviated for the same reason. The introduction of the townhouses or other habitational dwellings fouls this solution and adds the further problem of providing some pedestrian outlet for the families living on this tract which is segregated from other habitational dwellings in the nearby area. If the townhouses or other habitational dwellings were deleted, the savings and loan and medical buildings limited in height, and horticultural screening developed at the boundary, the users of the park might find the private development only slightly more obtrusive and inter- fering than park buildings constructed on other park properties. While this is not the most pre- ferred solution, this appears to be the best solution consistent with development of the private property. CONCLUSION Specifically, I propose that: (1) Tract E be zoned C-2A (commercial, second class, signing restricted) limited to a savings and loan association no higher than one story: and, (2) Tract F be zoned AM (apartment medical) limited to medical professional buildings no higher than one story with horticultural screening slong the entire boundary of the park property. Respectfully submitted, David C. Cummins DCC/gh Mr. Walkup also presented a petition, containing 128 signatures, in opposition to this zone change. J. E. Greuel and Joe Carter also appeared in opposition to this zone change. No one else came forward; whereupon, Mayor Turner announced that the hearing was closed.
