Box 2000 Lubbock, Texas 79457 Dear Mr. McCullough: In reference to our conversation with Mr. Pat Goodman, Assistant to tire Mayor of Lubbock, and Mr. Larry Cunningham, Assistant to the City Manager, we are requesting an agenda item for the Lubbock Council Meeting of July 26, 1973. Mr. Cunningham asked that the written request be re- ceived by Thursday, July 19, 1973, so that it can be put on the agenda for the council meeting of July.2'6, 1973. The following is submitted: In view of the re-evaluation of property in the City. of Lubbock and Lubbock Independent Schoo District.4hich has resulted in an increase of approximately 25% to 50% in some cases, and this will affect virtually every citizen of Lubbock, this matter should be brought before the council to clear the air of numerous misconceptions. .We are prepared to appear before the council to discuss the conditions from our vantage point and Mr. J. R. Brooks feels the same (as per his conversation of July 10, 1973). Since numerous affected citizens have met with the Tax Equalization Board on July 17, they, along with Mr. Brook have advised us to meet with the city council and discuss the.situation because the tax assessor only carries out the wishes of the city government. CC: Mayor Morris Turner Mr. N. B. McCullough, City Manager P. 0. Box 2000 Lubbock, Texas 79457 Dear Mr. McCullough: Respectfully, Billy W. Forbess 6907 Geneva Monte Sirmon 6906 Geneva George L. Thompson III 6908 Geneva Mike Worley Ronald E. Sosebee July 25, 1973 I have received your letter dated July 23, 1973, which appears to be contrary to my conversa- tion with Mr. Fred Senter, City Attorney. My whole intent of the letter dated July 17, 1973 and conversation with Mr. Senter was to re- quest to be put on the agenda for July 26, 1973. Mr. Pat Goodman, Assistant of the Mayor, and Mr 104 . 2 6 1973 Larry Cunningham, Assistant to the City Manager, told me that I should submit a letter to the -City Manager by July 19, 1973 in order to get on the 'agenda for the City Council meeting of July 26, 19 73. This was done. You, along with Mayor Turner, received a letter in accordance with your de- sires and policies. I conversed with Mr. Senter on July 20, 19-73 and discussed the letter of re- quest for the city council agenda. He agreed that we could go on the agenda before the city council. He requested that he present this to the council prior to the .7uly 26, 1973 meeting along with the letter. I agreed (for myself) with two stipulations as follows: (1) that I be allowed to present this to the council in sufficient time that their decision could be made prior to the decision of the Tax Equalization Board, and (2) .that we could present this petition to the council on July 26, 1973 since the letter had been sent to the council in sufficient time to be put on the agenda for that date. I stressed the expedience of the discussion with the council because the Tax Equaliza- tion Board could not hold their decision very long, according to the Board. I would like to make it clear that I did not "consent to postpone this hearing for a time" as your letter states. I did consent (for myself only) for Mr. Senter to discuss this in private with the council prior to the council meeting. I did not consent for this request to be postponed in- definitely as your letter indicates. The very fact -that the letter was sent immediately after the Tax Equalization Board met with me (who told me that I would have to take this up with the city council) and also immediately after the conversation with Mr. Goodman and Mr. Cunningham indicates that time was of essence in order that the city council would have time to act on the petition prior to the Tax Equalization Board's decision. In all my conversations I called attention to the expediency of the presentation. Furthermore, the entire conversation with Mr. Senter was centered around fulfilling the policies and procedures that the city .government has set up to get a petition on the agenda, which I fulfilled completely according to Mr. Senter, both with the request and time limit. It should be brought out that several people who. signed the original petition letter have been led to believe that we have performed the proper procedure required by the city government and re- cognized by Mr. Senter, and have set aside July 26, 1973, the date to set forth our grievance to the council, which has -cost a considerable amount of coordination, time, and monies in that we have taken off from work and re -arranged schedules, etc. in order to present the case to the council. It appears to me that a deliberate attempt is being made to stifle a legitimate and proper issue under the guise of -letter writting and coordination and inefficiency. I must add that I have tried to present the petition under the system of government in an or- derly fashion and a proper manner, coordinating with city officials from the bottom to the top echelon, assuring that all were aware of the next step up; but I sense a definite reluctance in all parties concerned to allow this petition to be brought and inserted on the agenda of the city coun- cil meeting. Since the non -elected officials -are taking this position, -you are leaving me very little alternatives other than taking to my constitutional rights, which will be to go to the elected officials and present my case hoping that they will not have preconceived or stifling attitudes. Yours truly., Billy W. Forbess jf cc: Mayor Morris Turner After consideration of all information presented in the above letters, this item was taken under consideration. 73-32-304-790 Dr. John Key, a member of the City -County Health Board, appeared before the City Council and pre- (5) seated a report on an air pollution control program and the necessity of such a program. Dr. Key stated that this proposed air pollution control program would require '$25,350 be set up for this purpose in the 1973074 budget. After consideration of all information presented, this item was taken under advisement. The City Council expressed appreciation to Dr. Key and to the Health Board and assured Dr. Key that this would be given consideration in the 1973-74 Budget. 73-32-304-791 The City Council considered Manpower Program Grant No. 3202-48 between the City of Lubbock and the (10a) U. S. Department of Labor which provides assistance to disadvantaged youth. After consideration of all information presented, motion was made by Councilman Baker, seconded by Councilman Hollings- worth, motion carried, Mayor Turner and Councilmen Hollingsworth and Baker voting Yea, Council- woman Jordan voting Nay to authorize the City of Lubbock to act as sponsor for this program. Attention Luther DeBerry Texas Highway Commission Texas Highway Department llth and Brazos Austin, Texas 78701 Dear Mr. DeBerry: July 26, 1973 The City of Lubbock and the County of Lubbock respectfully request that the proposed exten- sion of Farm Road 2641 (Regis Street).between U. S. 87 and U. S.. Highway.62-82 be designated as a spur highway. This proposed highway will serve the main entrance to the Lubbock Regional Airport. The completion of the new terminal building is scheduled for 1975. We feel that additional traffic volume generated by the airport terminal will require a higher type facility than the normal farm to market road. The main entrance to the airport terminal will be a six lane divided facility from Regis Street north. Construction of this entrance road is approved and programmed by the City.. The City of Lubbock and the County of Lubbock have previously indicated by resolution willing ness to acquire the right-of-way for the extension of F. M. 2641 between U. S. 87 and U. S. 62-82 The City and the County are willing to acquire the necessary right of way for a spur under exist- ing State Highway Department regulations for this type facility.
