Zr Z FROM: TO: William J. Pitstick, City Manager November 23, 1964 Honorable Mayor and City Council SUBJECT: Medical and Hospital Bills for Prisoners of the City of Lubbock It is the purpose of this report to: 1. Inform the City Council of certain problems which have arisen recently in regard to medical bills for prisoners. 2. Inform the City Council'of present policies regarding these situations and review this policy. 3. List all pending medical bills in regard to prisoners. 4: Recommend payments on pending medical bills. 5. Recommend modifications in the present policies. During the past few months, the City of Lubbock has been the recipient of several bills from the local hospitals and several local doctors regarding medical bills, hospital bills, and emergency treatment for prisoners in the custody of the Lubbock Police Department. The hospitals have apparently sent all bills related . to prisoners to the City of Lubbock for payment without regard for existing policies and without proper notification to — and authorization by — the City of Lubbock that these bills would be paid and that the City of•Lubbock is responsi- ble for the payment of said bills. The basic problem is to define the City of Lubbock's legal_re_sponsibiiity in providing medical assistance for prisoners in the custody of the Lubbock Police Department. The question arises as to what type of medical assistance, whether_ emergency or permanent, is'ustified under -the laws of the State of Texas. According to the City Attorney's Office, the operation of a police department is a governmental function and acts or omissions in connection therewith ordinarily do not give rise to liability on the part of the City. No law has been found which requires the City to provide a daily medical. check on the health of prison- ers in Texas. Some cities pay only for treatment for injuries inflicted on a per- son by a police officer in the course of making an arrest. Some attorneys feel that payment of medical bills of prisoners would be an unconstitutional donation of a municipal fund to a non-public purpose. It appears that reasonable rules consistent with good human conduct and natural ethics under the circumstances dictate that prisoners should receive such immed- iate medical attention as good conscience would dictate under given circumstances. Present policy on medical and hospital bills for prisoners is shown in Exhibit The attached Exhibit II shows a tabulation of pending prisoners' bills. Only in one or two cases did the officers take the prisoner to the hospital before confin- ing him to jail. Most of the cases in Exhibit 11 became ill or injured while in the City jail. According to the policy as outlined in Exhibit 1, persons who be- come ill or injured while in the custody of the Police Department will be given emergency medical treatment but that no hospitalization or medical care will be furnished by the City of Lubbock for any person within the third category, which 497 DEC 31964 (or "unbalanced") unit prices will authorize the Owner to reject the bid. The Owner reserves the right to accept the bid considered most advantageous to the City of Lubbock. Bidders are expected to inspect the site of the work and to inform themselves regarding all local conditions under which the work is to be done. Copies of the plans and specifications are on file in the office of John T. Hickerson, Director of Public Works, City Hall, 916 Texas Avenue, Lubbock, Texas. Copies of these plans and specifications may be secured from the above office upon request. Payment for successful completion of this contract will be made from bond funds of the City of Lubbock. CITY OF LUBBOCK, TEXAS ER By: r/MK / . The following letter was presented in connection with this zone change request: FIRST METHODIST CHURCH December 2} 1964 The City Council 916 Texas Avenue Lubbock, Texas Dear Sirs, Some weeks ago, Mrs. Jack Keels came to my office to discuss plans for opening a teenage night club at the intersection of 19th and the Brownfield Highway. We talked at some length about specific plans of operation and supervision. I recognize, as do most leaders of the Community, as well as parents of teenage children, the need for a closely supervised place for the youth of our schools to dance. It is clearly established that this is a favorite form of youth recreation. I also recognize a definite shortage of places for couples to go for entertainment. In light of these factors, I am of the opinion that a properly supervised teenage night club would be a definite asset to our community. I am also satisfied, from my discussion with Mrs. Keels, that this is the type of thing they hope to open. I have withheld my full endorsement until I have seen the club in operation. My position is that it is imperative that alcoholic beverages be neither sold nor allowed on the premises, and that those persons giving evidence of intoxication be denied admission. I am convinced this is what the proprietors have in mind, and will endeavor to enforce.' I have also taken the position that if the night club is run properly and in good order, I will not only endorse it, but recommend it to the parents of youth with whom I work as an acceptable place for high school and college youth to go and take dates. Sincerely, Carl M. Anderson Minister to Youth First Methodist Church Lubbock, Texas No person appeared in support of this zone change request and no person appeared in protest, whereupon, the Mayor stated the hearing was closed. After consideration of all facts presented motion was made by Councilman Simpson, seconded by Councilman Kastman, motion carried, Mayor Tidmor and Councilmen Kastman, Simpson, and Medlock voting Yea, none voting Nay, to uphold the recommenda- tion of the Planning and Zoning Commission and pass Ordinance No. 4588 as an emergency measure authorizing the issuance of a Specific Use Permit in Zone Case No. 1280. ORDINANCE ORDINANCE NO. 4588 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE PERMIT IN ZONE CASE NO. 1280; DECLARING AN EMERGENCY; AND PROVIDING FOR PUBLICATION. 64-23-501-1355 A report of the'Sanitary Sewer system serving the area South of 4th Street, North of 19th Street (23) and East of College Avenue to Avenue Q in the Overton Addition was given to the City Council, said report 'stating that the sanitary sewer lines in this area are over -loaded and the flow from this area has been increased by the development of multi -family apartments replacing single-family residential units in this area. After consideration of all factors involved motion was made by Councilman Simpson, seconded by Councilman Kastman, motion carried, Mayor Tidmore and Councilmen Kastman, Simpson, and Medlock voting Yea, none voting Nay, to authorize request for bids to be received by the City Council for installation of a 24" sanitary sewer line to serve this area. 64-23-501-1356 2117 31st St. (30) Lubbock, Texas November 24, 1964 Mr. William J. Pitstick, City Mgr. Lubbock, Texas Dear Mr. Pitstick, The Lubbock Public Library Board requests favorable action by the City Council for a survey of Lubbock's library services and course for future developments. The Board has contacted Mrs. Gretchen Schenk, a nationally known library consultant who has indicated by the enclosed letter that she is available for this service after Feb. 5, 1965. The cost to the city will be $600.00, including expenses. The Lubbock County Commissioners, at their meeting on Mon., November 23, agreed to pay her an additional $300.00 for a survey of county needs. This action is contingent on the City Council's approval of -a city survey. We feet this undertaking will give the Board and the City guideposts for library development for many future years; and will assure Lubbock citizens, both city and county, of a well spent tax dollar. Very truly yours, Mrs. William B. Arper, Chr. Lubbock Library Board M, T. 77i7m R Arnar- rhairman MRS. FRANZ SCHENK ROSE HEDGE FARM SUMMERDALE, ALABAMA 21 November 1964 102 31964 ' Dear Mrs. Arper: This is to confirm the telegram I sent you this afternoon in response to your inquiry regarding the possibility of my conducting a survey of Lubbock Library services and future developments. As to available dates, I shall be free to come to Lubbock any time after February 5th. Since Lubbock is one of the focal points in the planning of library services for the entire Texas Panhandle, a study of probable and possible future developments should be beneficial at this time. I quoted you a cost of $600 including expenses as well as the writing of the report, Your Board might wish to consider an alternative charge of $75 per day plus expenses, covering approximately seven working days. The additional cost of studying a merger with Lubbock County will amount to $300 since the major cost of my travel expenses would not be involved. Should you wish to have me undertake the study, I should incidentally also like to consider the role of Lubbock as the center of extended library services in the future. I did this for Abilene a number of years ago. Today even more than then "no library is an island" and with the Texas State Plan for libraries emerging more clearly Lubbock may develop into an,important library center in the future. Sincerely, Gretchen Knief Schenk Library Consultant The City Council considered the information as set out in the above letters from Mrs. William B. Arper, Chairman of the Lubbock Library Board and Gretchen Knief Schenk, Library Consultant, as to survey to be made in connection with the Lubbock Public Library. Motion was made by Councilman Kastman, seconded by Councilman Simpson, motion carried, Mayor Tidmore and Councilmen Kastman, Simpson, and Medlock voting Yea, none voting Nay, to authorize payment of the City's portion of this cost for said Library Survey as set out in the two above letters and to authorize Mayor Tidmore to enter into contract for said Library Survey. 64-23-502-1357 Motion by Councilman Medlock, seconded by Councilman Simpson, motion carried, Mayor Tidmore and (31) Councilmen Kastman, Simpson, and Medlock voting Yea, none voting Nay, to authorize approval of the 1965 Capital Improvement Program in the following amounts: $3,000,000 Electric Light and Power System Revenue Bonds, and $1,700,000 General Obligation Bonds for the following purposes: Water Improvements $ 775,000 Sewer Improvements $ 265,000 Street Improvements $ 385,000 Park Improvements $ 275,000 A bond sale is to be held by the City of Lubbock on February 25, 1965 to finance said Capital Improvement Program. of record on page 497 Minute Book 23 64-23-502-1358 In accordance with the Notice of Zoning Hearing/ hearing was held on Zone Case No. 1277- (11) Request of T.
