L. Roy Office Engineer City of Lubbock 916 Texas Avenue Lubbock, Texas RE: SPLAWN, LOT 33, NORTHRIDGE ADDITION, 3413 CANYON ROAD Dear Mr. Roy: On June 21, 1963, by conversation with Mr. 0. A. Dunn, with your City Department, it was agreed that pro -rasa costs to me for tying onto the City sewer and City water would be as follows: Sewer------------------------------------------- $193.75 Water------------------------------------------- $297.23 These amounts I agreed to pay, together with $41.40 for a building permit to include sidewalk. On July 23, 1963, without any authorization from me, your City of Lubbock Water Department by pro-rata water receipt No. 5294-W, charged and received a check (not from me) but from Joe Rushing, Plumbing Contractor, in the total amount of $1,324.67, which set out pro-rata charges on lots 32, 352 34, 36, 37-area Manoca Road, Northridge Addition. The receipt further stated that of this amount $1,027.44 is reimbursable in accordance with one of your many City ordinances. On August 6, you sent with a cover letter, what appeared to be an original and two copies of a purported application for water extension. I refused to sign this so-called application, and still do. Neither do I intend to wait for from one to fifteen years to have this $1,027.44 refunded to me, when and if future property owners should ever elect to pay their individual pro- rata charges on the above numbered lots, on the alleged basis of $256.86 per lot -when and if. This is to advise the City that you are to refund my personal money, which you have been using, interest free, since July 23, 1963, within a period of 10 days from the date of this letter, -or - I will be forced to institute legal action against you. This is also to advise you, that in connection with future bills sent for alleged water used, that none of said bills will be paid until and unless the 2 feet of subsoil which has completely covered your water meter, since the date of completion of construction of the house on November 20, 1963. In other words, it would appear that it would be extremely difficult for your meter reader to correctly read a water meter with this much soil completely covering same. In this connection I want a complete explanation of all water charges made since November 20, 1963. Also, this is to advise you that if I should decide to completely discontinue use of your City water facilities, I shall expect to be reimbursed for the complete cost of the burried water meter, in whatever amount I payed for same. Also, please talk with someone in the Light Department and ask them to please remove all temporary light poles which are still placed in and on the interior of my lot approximately 90 days after completion of construction. March 26, 1964 Colonel Richard A. Steele Base Commander Reese Air Force Base Lubbock, Texas Subject: Water Supply Dear Colonel Steel: The citizens of Lubbock have not been able to secure an unlimited permanent supply of water to satisfy the future needs of the city even though they have invested over $6,000,000 in the Sandhills Well Field and obligated themselves to repay $37,000,000 on the Canadian River Project. Thus it has been the policy of the City Council not to provide water service outside the city limits of Lubbock. The City Council made an exception to this policy in authorizing the city to supply Reese with water. They feel that the Base facilities are of primary interest to the citizens of Lubbock and that the city has an obligation to supply water when it is not practical for the Base to provide its own service. The City Council therefore authorized me to offer water supply service to Reese Air Force Base and Reese Village beginning in 1967 with the following general terms and conditions: 1. The extension of water supply facilities to serve Reese will cost approximately $340,000 to provide 1800 gallons per minute delivery rate. This money is not available in City Funds and the expenditure can only be made if the Government loans the city this amount with it to be repaid in 10 to 20 years depending on how much surcharge the Base wants to pay. 2. The basic water rate to Reese will be the same as it is to any customer inside the city limits of Lubbock (such as the Lubbock Independent School District) and that the water will be metered at the point of entrance into Government property. (See attached rate schedule.) 3. That a surcharge in addition to the basic rate be made until such time as the loan from the Federal Government can be repaid. 4. That a minimum annual surcharge be paid by the Base (to be repayed the initial investment) equal to 1/10 or 1/20 of the initial investment depending on the term of the loan from the Government. We hope that these general conditions are satisfactory with you so that you can process this in your budget request. Mr. Fred Senter, Attorney, City of Lubbock, Lubbock, Texas. Dear Mr. Senter: During the past year and one-half I have made investigations and contacts concerning the opening of a road which would be used as a rural mail route for an area in and near the southeast city limits of the City of Lubbock. Some sixty families are living in the Yellow House Canyon Addition, and approximately one hundred additional residential lots are sold in that addition. This addition, and the areas immediately surrounding it, have no mail service. The Planning and Zoning Commission of the City of Lubbock approved routes for the needed road (subject to acquisition of right-of-way), which would extend from the east city limits west to either Loop 289 or the Old Slaton Highway. Owners of land along the roads approved are Mrs. Clyde Clark, Dr. Sam Arnett, Jr., George Benson, Glenn Wages, and myself. Each of these owners has been contacted by me, and none is agreeable to li dedicating a right-of-way. I will dedicate any part which would need to be on my property (my property involved has been platted, though part is only temporarily platted, hence not dedicated). I have a petition signed by owners of lots and residents of Yellow House Canyon Addition, and a copy of a letter from Mr. Amos Howard, Postmaster, indicating need for such a road. Would you ask the City Council to consider necessary steps for obtaining right-of-way for this mail route? Truly yours, Is/ Dr. V. V. Clark See Plat and Petition _ Dr. & Mrs. V. V. Clark appeared before the City Council requesting that the City open a street as requested in the above letter in order that residents living in the Yellowhouse Canyon Addition may be served with mail service. Motion was made by Councilman McLarty, seconded by Councilman Simpson, motion carried, Mayor Strong and Councilmen Alderson, O'Mara, Simpson, and McLarty voting Yea, none voting Nay, that the following Resolution be passed. Also that a request be made to the Post Office Department that mail service be extended to this area as there are approximately 60 families to be served. DVQnT TTTTnNT WHEREAS, it appears that the Yellowhouse Canyon Addition located adjacent to the boundary line of the City of Lubbock in the Southeast portion of the said City of Lubbock is now inhabited by approximately 65 families; and, WHEREAS, it appears that there now exists a single means of ingress and egress to such Addition over an all weather road; and, WHEREAS, it appears that the inhabitants of the said Yellowhouse Canyon Addition are being deprived of a regular mail delivery service because of a regulation of the Post Office Department of the United States which requires that means of ingress and egress shall not require travel over the same road or street; and, WHEREAS, the inhabitants of said Yellowhouse Canyon Addition have petitioned the City of Lubbock to provide additional right of way for street purposes; and, WHEREAS, it appears that such additional right of way will cost a considerable amount of money but will not enhance any public facilities and is not at this time needed for any public purpose other than travel over and across such right of way; and, WHEREAS, it appears further to the City Council that the cost and expense of providing the right of way for an additional means of ingress and egress to said Addition is too costly and is an additions burden on the tax payers of the City of Lubbock which should not be incurred at this time and that if the rule of the Post Office Department which now prohibits the servicing of this area may be waived until such time a public necessity requires additional means of ingress and egress to such community it would thereby relieve the City of Lubbock of the burden of providing this additional means of ingress and egress at this time, NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City of Lubbock acting herein by and through its City Council hereby requests and urges the Post Office Department of the United States of America to waive its present rule and regulation requiring two methods of ingress and egress from a certain area before providing its postal services to an area at this time in order to provide postal services to the approximately 65 families living in the Yellowhouse Canyon Addition which is adjacent to the Southeast portion of the City of Lubbock, and thereby relieve the City of Lubbock of this additional expense. THAT the City Secretary be and is hereby instructed to mail a copy of this Resolution to the Postmaster General of the United States, Postmaster of the Post Office of the City of Lubbock, Texas, Honorable George Mahon, Member of the House of Representatives, Honorable Ralph Yarborough and Honorable John G.
