In accordance with the Resolution on page 449, Minute Book 22, hearing was authorized on paving
(curb and gutter) for Avenue Q from 50th Street to near the Traffic Circle. On this date said
nearing was held. The following letter of protest from Evans, Pharr, Trout & Jones for D. G. Kirkland,
W. B. Rushing, and Jimmy Walker was presented at the hearing. Mr. Tom Clinton also appeared before
the City Commission representing C. N. Hodges, Estate, and protested this improvement.
EVANS, PHARR, TROUT & JONES
October 24, 1963
The Honorable City Commission
City of Lubbock
Lubbock, Texas
Gentlemen:
I represent the Lubbock Cotton Exchange, D. G. Kirkland (who has the Cotton Exchange land under
contract of purchase), W. B. Rushing, and Jimmy Walker. They, or corporations which they control,
own property on Avenue Q between 50th Street and 58th Street. Recently curb and gutter was
installed by the City abutting their respective properties, and the City plans to assess them for
the full cost thereof.
The above owners wish to formally protest the proposed assessments against their respective
properties for the following reasons:
(1) Notice was not published in the newspaper of the proposed assessment in accordance with II
Article 1105(b) of the Texas Civil Statutes, prior to the beginning of construction of f
the improvements. Kerr Construction Company began work on the construction on October 2, 1963,
and started pouring concrete on October 7, 1963. Notices were not published until October 13th,
17th, and 20th, according to the City Engineering Department. The construction work was
completed over a week ago. The portion of Article 1105(b), Section 9, concerned, reads
as follows: "If all such notices shall describe in general terms the nature of the
improvements for which assessments are proposed to be levied and to which such notices relate,
shall state the highway, highways, portion or portions thereof tobe improved," etc.
(emphasis added),
This statute contemplates formal notice prior to the commencement of improvements. It is
true that the ordinance making the assessment may be passed after the construction. However,
formal notice prior to the commencement of the making of the improvements is a condition II
precedent, or prerequisite, to a valid ordinance and assessment.
(2) Also, because the cart was put before the horse, so to speak, in having the notice
and public hearing after the improvements have already been made, the property owners have
not had an opportunity to check plans and specifications for drainage, cost, and so forth.
These matters are of vital importance to them, as they are the ones developing the property,
not the City, and should have had an opportunity to be heard prior to construction.
(3) It is my understanding that the City's rationale for assessing the full cost of these
improvements to the abutting property owners is that the State Highway Department is
constructing the paving at no cost to the abutting property owners. Mr. W. B. Rushing
gave, rather than sold, right of way land to the Highway Department for that very reason,
with the understanding that there would be no assessments of any kind.
(4) The curb and gutter will not enhance the value of respective properties in an amount
equal to the respective assessments.
It disturbed me that some of the owners are somewhat reluctant about raising any protest or
objections to this assessment, as they actually fear reprisals by various departments of the City
in the future in getting Building Permits, Zoning, etc. I have assured them that there is no
one connected with the City in any way who would ever be vindictive over their assertion of their
legal rights.

be to support public confidence in proper charity drives, -to insure that proper organizations that
are supported by charity drives will not suffer from loss in public confidence in charity drives

the people, and to ferret out and expose those persons who personally gain from the generosity
of the citizens of Lubbock.
