FILE October 3, 1963 To: The Mayor and The City Commission of The City of Lubbock, Texas Page No. Gentlemen: Reference: Drainage, 2000 Block of 50th Street and Vicinity, Previously Discussed with The Commission and City Officials. The following engineering facts have been obtained from the City Engineering Department. The NW corner of the intersection of 50th Street and Avenue T is the lowest of this intersection. The SW corner is nine and a half (9") inches higher than the NW corner. The SE corner is five (5") inches lower than the SW corner. The SW corner is only two (2") inches higher than the NE corner. The NE corner is two (2") inches higher than the NW corner. The crest of the street will rise at a point three -fourths of the width of the street away from the North side of the street. Thi: crest at the West end of the intersection will rise to a height of fourteen (14") inches higher than the gutter on the North side of 50th Street, and five (5") inches higher than the gutter at the South side of 50th Street. This crest, extending West, will rise to a point eighteen (18") inches higher than the gutter at the Northwest corner of the intersection. This crest reaches this height - _ - -=j. of eighteen (18") inches at a point one hundred and seventy-five f179'1 fPPh WPSt of rho intaraArf-inn 170 GOT 101963 and at this point it is five (5") inches higher than the gutter on the South side and ten and one-half (10k ") inches higher than the gutter on the North side. At this point the gutter on the South side of 50th Street.is six and one-half (6k") inches higher than the gutter at the Southeast corner of the intersection of 50th Street and Avenue T, and is one and one-half (1'") inches higher than the crest at the East of the intersection. From the Southeast gutter of the intersection to - a point along the gutter one hundred and seventy-five (1751) feet West of the Southwest corner of the intersection the gutter reaches a height six and one-half (61") inches higher than the intersections Southeast corner gutter. The East gutter of Avenue T on the South side of 50th Street is five (5") inches lower than the West gutter. The lowest part of the intersection of 50th Street and Avenue Q is on the South side. The gutter on the South side of 50th Street going West from Avenue Q starts out three (3 ") inches lower than the gutter on the North side of 50th Street. At some places between Avenue Q and the East side of the 50th Street and Avenue T intersection the gutters are the same height. The gutter on the South side of 50th Street does not begin to substantially rise until it reaches the SE corner of the intersection of 50th Street and Avenue T. The water in the gutter on the North side of 50th Street overflows onto the property on the North side of 50th Street and runs across the property Northward. 50th Street water rises to a point as high as the sidewalk of the property abutting 50th Street on the North side when water extends approximately twelve (12') feet South of the gutter. In other words, 50th Street rises so sharply South from the North gutter in the 2000 Block that the street will carry very little water. Avenue T is substantially uphill from 50th Street to 45 Street and 44 Street, rising a height of five (5') feet. I request that these engineering facts, including previous discussions with the Commission and City Officials, be entered into the minute book and be made a permanent record. Respectfully, James G. Marshall To the City Manager of the City of Lubbock, Texas Page No. 2 Mx. Bill Pitstick Bill.: In regards to the construction of 50th Street in the 2000 block and particularly the intersection of 50th and Avenue T. You are an engineer as well as our City Manager. The engineering facts bare out the truth that the design of the street is such that water will be directed from the South Side of the street to the north side at this intersection, and at this portion of the street just the west. Engineering is an exact science. The flow of water can be assertained. The water flowing on the south side of 50th Street will have to run up hill more than 61/2 inches to go from the SE corner of the intersection (six and one-half inches) to get to a point in the gutter 205 feet, in the gutter on the south side of 50th, to the west. There is a crest in the street three -fourths of the way from the north side of the street. This south k (one-fourth)is, I have been told by city employees and construction contracting employees is intended to carry the water down west on the south side. Water coming from the south on Avenue T going north will assist in preventing water from going west on the south 50th side from the SE corner of the intersection of 50th and Avenue T west to Avenue U. Water will have to up hill 6 kZ inches as well as overcome the force on the current from. Avenue T. The gutter at the West side of Avenue T is 5 inches higher than the gutter on the west side. It is to be expected that it often rains more than the capicity of the Storm sewer will handle. It is your duty as the City Manager to prevent this engineering Boobo that will cause great water damage to homes in the area as the water will go north onto the property and houses and cause damage and this letter should be sufficient notice. I want this letter to be placed upon the minutes in the City Minute Book and be of permenant record. Also the fact that I have protested to the City Commission at earlier times that flood conditions exist. Prudence in proper drainage is not being followed, and has?been followed in the past by the engineers of the city in this matter. The City Commission should be explained the exact results of the flow of water as it moves west on 50th Street and across 50th on the way (its way) to Clapp lake to the North west. Proper drainage must be provided for the home owners in this area, All necessary actions are to be taken to correct this situation of flooding. Also the damaging flooding affects of the present construction of 50th Street, and the inevitable resulting damage to private property, and homes. I want an answer to all of my previous request for relief from the City Commission. I demand that I have answer and that it be in the minute book of the City and that it be of public record. Also that exact engineering facts as to the flow of water be determined by the city and be of public record. The estimate should be based on a general heavy rain six (6) inches and more of rain. It is not at all unlikely that we have a 6.7, S, or 9-inch rain and such evenualities must be considered as a certainty is planning and providing drainage for the future for home owners in this City -as well as in this area. MARSHALL REALTY COMPANY To the Lubbock City Commission. To the City Manager Gentlemen: /s/ James G. Marshall Page No. 3 I, James G. Marshall have been favored by my next door neighbor by his turning over to me the right to sell his home. His name is Jack Friedman. His wifes name is Irene. The house is located at 2219 24th Street. I have sold this house. We both feel that the purchaser should know what the city intends to do about the water problem at his home. I have been before the commission and tried to explain it to them as best I could. I did this on Thursday the 26 of September on behalf of both the buyer and the seller. The house was in contract at the time I appeared before the commission. I had this in mind when I appeared before the commission. I am requesting that the City Commission give me an answer so I can give the seller and the buyer an answer and gentlemen I do sincerely think that we are honestly entitled to know. James G. Marshall Page No. 4 A Petition to the City of Lubbock, Lubbock County, Texas, a Home -Ruled City, a Body Politic, a Cooperate, .that may sue and be sued, acting as a Subdivision of the State of Texas, with delegated powers from the Texas Legislature, which has a4so authorized an election of four City Commissioners and a Mayor to act with sole authority as the governing body of the said City of Lubbock. We, the undersigned, do petition the City Commission for the following request, urging that E the said Commission either grant said request where it is within their power, or order an election calling for a vote of the qualified voters to vote on said matters, as is provided by State Statutes of the State Legislature of the State of Texas and/or by Charter Amendments and Provisions of the Charter of the City of Lubbock. The following petitions of request to be considered and granted are as follows: 1. That the construction of 50th Street and the storm sewer inlets, between Avenue "Q" and Avenue "W", be halted immediately. 2. That the curb on the South side of 50th Street be lowered to the same level as the curb on the North side of 50th Street, presently existing. 3. That 50th Street, from Avenue "Q" West to Avenue "W", be reconstructed, which would include lowering so as to enable it to carry more water than it is presently designed to carry. 4. That the City Commission also engage an outside, reputable Consulting Engineering Firm to study the drainage problem of the water shed of this area, and make recommendations of how the streets could be redesigned to carry more water and thus eliminate the flow of water into the homes and across the yards in this area. (It is the opinion of the undersigned that the Engineers responsible for the grading and paving of streets in this area have been derelict of their duties, in that many of the streets should have had a consistantly gradual grade, and that streets should have been lowered to these proper grades and slopes, and should have been designed and graded so as to adequately carry the flow of water, evenly distributed to as many of the streets as was practical to the lake area.) Page No. 5 5. That the City Commission pass an ordinance so that in the future no abutting property owner could be assessed and charged more money for improvements on streets and alleys, or in streets and alleys, than the actual cost of the work done. It is and has been a policy of the City of Lubbock, with the consent of the City Commission, for the Engineering Staff to estimate cost of improvement in and on streets and alleys, and to impose a lien on these abutting properties for the estimate of the improvements. The City Commission has then allowed the City Staff to take bids on these improvements, and should the bids be less in cost than the estimate, then the City has kept this surplus of money, which is unspent, and does rightfully belong to the abutting property owner. This practice should be stopped in its entirety for all time to come. 6. All surplus money derived from policies set out in Paragraph 5 above are now in the asset of the City, and that these monies be spent in correcting the grading and repaving of streets where proper engineering and planning were absent is hereby further requested. These monies now held in escrow were placed in escrow for expenditure on street and alley improvements, and the City Commission holds these monies in trust, and has no authority to use the same for any other purpose. 7. Should the Engineering firm make recommendations that would show that proper prudence of the City's Engineering Staff was not exercised, said undersigned citizens request that the City make good the mistakes made by the City employees. It is further stressed that responsibility be placed. It is further stressed that Lubbock property owners who have paid for street improvements are entitled to quality work which would include proper drainage. 8. The City of Lubbock voters have recently approved a million and a half dollars for Storm Sewer Bonds. The undersigned request that the Honorable City Commission appropriate an adequate portion of these available funds for the purpose of correcting the mistakes in the grades of the streets above mentioned. It is -to be emphasized here that 49th Street and 50th Street and 48th Street and 47th Street and 46th Street are not necessaril in a low water line area of a lake, and that had the grades of all of the streets in this area been properly engineered no flooding problem would exist. Therefore, Bond Issue Funds should first be spent in correcting the mistakes in this otherwise high and dry vicinity. People who have built homes in these areas should be protected first. The following petition signatures urgently request careful consideration and just action by the City Commission. Page No. 6 /s/ Mr. & Mrs. W. F. Gill- 2013 49th /s/ Mr. & Mrs. H. T.
