Dear Sir:
I rgret not being able Co attand the City Coraission raeeting of September 28 as Z raust be in south
Texas. It is my desire, however, to register my opinion on mattera pe rtaining to the report af the
Charter Study Couxnittee cha.red by wex W. 1IcWliaxter.
In y ogi.nion, the ameudments submitted by the chairman and agreed to by the entire cotittee should all
be considered for submissian to the el.ectorate in a chazter amendmext election.
T fee2 Chat the two minority views subtnittad should receive a cansidered repiy tram the Cammission.
Wit respect to a separate request from the Museum Board, it would be my view that this reqaest for in-
clusioa on the ba11o of an amendmenti concering a one-half mil.l tiax for the institution of a City
Museum might be granted.
My feeling is tha Che most convenient and appropriate time fox aa electinn to conaider these ameadments
to the Cir Charter would be the first half of 13ovember, perhaps prefeabZy the 7th or 14th, both being
Tuesdays.

I woud request that tiis letter m,ght be snade available to my £ellow Comnaissioners for their inxormatioi
only and that it be entered in tihe Miautes, if this is perntissibe. If I am not mzstaken, I am not
permitted to cast any vote as tha meeting of September 2$ ia absentia, however, this letter will serve ts

Gentlemen:
We wish Co submit a minor3.Cy report fram Che citizens caz.nittee appointed to study the city charter,
pertaining to a proposed chage regardzng Chapter ITI, Section I, which reads as tollows:
"Tle Board o Ci,ty Devel.apment sha11 be se p as every other board in the city goverrsenr andaney Eor
sch board sha11 be apprapri.ated rom the genera funds each pear for the suport and maintenanca of
the activities of such board."
We question he method of fi nancing the Board o City Deve.opment. 1'he preseaC charter pravisions makes
it mand8tory for one-ha1.f mill on every $1..00 valuation of taxable property i.n Lhe city {or 5 out of
very y7.00.00 valuation) be given to this board. 7.`he amount of taxes co3.lected for fh e Board of City
DeveAopment has increased from $75,479.69 as of September 30, 1956, to an estimaed $147,699.04 for
this year - a phinomenal increase over a period of ive years.
We be.eve tha this provi.sion zs not in keapi.ng with principles of good goverrmenr because (1) Chere
is no cei.lng or liiniti as to the atnount this board receives from year ta year, (2) it prohibis or
eected city offi.cials from exercising thei.r rightful respousibility o deCermi.ue how all tax maney '
shouZd be a1l.ocated, (3) it earmarks funds without regard to estabiished need and performance, and (4)
it opens the or for siuni.lar requests.
This charter provision was admendad i.n .932, changing the tax from 2 miiZs to mfJ.l. Since 30 years
has elased, we belxeve the proposi.tion above should be submztted to the voters so they may decie fox
themselves whict method of financi.ng the Board of City Development would be best for ther city.
Thank you for your consideratiion.

Itave been unable to find any provision in the Charter or city officials to turn the funds of the Board
; of City Deveopment over ro rhe Lubbock Chamber of Cammerce. The cry of nutual objectives does not const'
tute legality; neiher does tie c,aim thati such an arrangement has worked toeJ.l. £or te "progress" of Lubbo
hree points brought out in these discussions should be c].led to the attentxar of the Caission:
1. The Board of City Development s raquired by State Statuta to submit annual budgets for approval by
the Commission. This is not an arbitrary requesti, but iti is called for by iaw. This has not al.ways been
done in the past.
2. Charter provisions ca11. for semi-annual iinancia. reports. Tha.s has not always been done.
3. The co-mingli.ng of funds and fanctions of the BCD aad tt: Chaatber o Camrnerce ias, in the past,
alowed tLte questionab.e use a £unds to influence polirical issues. The use of funds in such a manner
couZd constitute an embarrassing legai question £or city officia.s.
There seeras to be znany valid arguments for a separation of the iunds and activities. of ehe BCD from those
of tite Chaxnber of Costtcaerce. Much criticism could be eliminated, and it seems reasonable that such a spa
ratioa woul.d serve as a stimul.us to both organizations.
