Lubbock, Texas September 22, 1949 The City Commission of the City of Lubbock, Texas, met at 10 A.M. in regular session, at the regular meeting place in the City Hall, the following members thereof being present, to -wit: Mayor W. H. Rodgers, Commissioners W. B. Price, E. K. Hufstedler, Jr., Clar- ence K. Whiteside, John Spikes, City Attorney Vaughn E. Wilson, City Manager Steve Matthews, City Secretary Lavenia Lowe. Absent: Commissioner John Spikes, for the morning session. The Commission recessing at 12 noon and re -convening at 1:45 P.M. The Minutes of Regular Meeting of September 8, 1949, Recessed Regular Meetings of September 13, September 15 and.September 179 1949, were read, and upon motion by Commissioner Hufstedler, seconded by Commissioner Whiteside, carried unanimously, they were approved. The Minutes of Accounts allowed from Warrant No. 1690-D to Warrant No. 2040-D, both inclusive, were read, and upon motion by Commissioner Whiteside, sec- onded by Commissioner Hufstedler, carried unanimously, they were approved. Ordinance No. 931, an ordinance annexing certain territory into the City Limits, was brought to the attention of the City Commission, this being the ' date set for 2nd reading of said ordinance. Due to there being opposition of the covered in this ordinance being brought to certain portions property into the City Limits, a petition signed by twenty seven (27) citizens havtng been filed with the Commission requesting that Ween Addition be allowed to remain outside the City Limits, it was unanimous y agreed by the City Commission that first reading of this ordinance be revoked and said Ordinance No,w 931 not be passed on 2nd reading. Motion to this effect having been made by Commissioner Hufstedler, seconded by Commissioner Whiteside, and unanimously carried. Motion by Commissioner Hufstedler, seconded by Commissioner Whiteside, that Ordinance No. 937 be published. WHEREAS, a large group of property owners, and voters residing within the here- inafter described area have petitioned the Governing Body of the City of Lubbock to annex and include the above described area within the corporate limits of the City of Lubbock, and, WHEREAS, the Governing Body finds that said area herein described and in which many of said petitioners reside, is in line of development, growth and expansion being experienced by the City of Lubbock, and the Governing Body further finds that the inclusion and annexation of the entire area as herein described by metes and bounds, within the corporate limits of the City of Lubbock to be in the public interest and the Governing Body is empowered by Section 3A, Article I, Chapter I of the Charter of the City of Lubbock to annex by Ordinance, additional terri- tories lying adjacent to the City of Lubbock and said area herein described is adjacent to and abuts the city limits of the City of Lubbock, THEREFORE, BE IT ORDAINZD BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. That the hereinafter described areas, as described by metes and bounds as follows, to -wit: BEGINNING at a point in the present city limits line 1320 feet South of the Northwest corner of Section 20, Block A, said point being the Northwest corner of McMillan Heights; THENCE North 4311.80 feet along the West line of Section 20, Block A to the Northeast right-of-way line of Santa Fe Rail- road; THENCE North 560551 East 10,270.45 feet to a point where the Northeast right-of-way line of Santa Fe Railroad crosses the present city limits line• THENCE West 3364.81 feet along the present city limits line; THENCE North 1320 feet along present city limits line and along the East line of Section 20, Block A; THENCE West 900 feet along present city limits line; THENCE North 1251.4 feet along present city limits line; THENCE North 5700$t West 126.42 feet along present city limits line ; THENCE West 3119 feet along present city limits line; THENCE South 1320 feet along present city limits line; THENCE West 1155 feet along present city limits line to point of beginning. be, and the same is hereby annexed to and included within the corporate limits of the City of Lubbock. SECTION 2. This Ordinance shall be published in a daily newspaper published in the City of Lubbock, Texas one time and shall not thereafter be finally acted upon until at least thirty days have elapsed after such publication and if finally passed in its pr�d&r�t' form the boundary limits of the City of Lubbock, Texas shall bhereby be fixed to include the extension described in Section 1 of this Ordinance. On motion of Commissioner Hufstedler, seconded by Commissioner Whiteside, and unanimously carried by an affirmative vote of the City Commission of the City of Lubbock, Texas, this Ordinance was ordered to be published at a Regular Meeting of the City Commission this the 22 day of September, 1949. ORDINANCE NO. 936 AN ORDINANCE REDUCING THE RATE OF ASSESSMENT IN UNIT NO. 857 UNDER ORDINANCE NO. 917 to $3.959 PER FRONT FOOT AND GIVING ABUTTING PROPERTY OWNERS UNIFORM CREDIT FOR CONTRIBUTIONS TO THE IMPROVEMENT IN SAID UNIT BY LUBBOCK COUNTY AND THE CITY OF LUBBOCK: Motion by Commissioner Hufstedler, seconded by Commissioner Whiteside, carried unanimously, Ordinance No. 938 passed first reading. WHEREAS, the City of Lubbock heretofore passed various street im- provement ordinances and resolutions, and entered into contract with the property owners for the making and construction of street improvements on portions of numerous streets, and/or avenues in said City, including among others the following: 27th Street from its intersection with the West Property Line of Jackson Avenue to its intersection with the East Property Line of Van Buren Avenue, known and designated as Unit Number 708. Avenue K from its intersection with the South Property Line of 2 5th Street to its intersection with the East Property Line of Avenue L, known and designated as Unit Number 733. AND WHEREAS, the improvements upon the said portion of the above men- tioned streets and/or avenues have been completed and have been inspected and found to ha"ve been constructed in accordance with the terms of said contract. THEREFORE, BE IT RESOLVED BY THE CITY OF LUBBOCK, TEXAS: I. That the improvements on said portions of the above mentioned streets and/or avenues be and the same is hereby accepted. That to execute against the II. the Mayor and City Secretary be and they are and deliver certificates in evidence of the parcels of property abutting upon the said hereby instructed assessments levied portions of the streets and/or avenues as listed above, and against the owners of such property in accordance with law and in the manner provided in said con- tract, and the proceedings with reference to said improvements and assessments. Motion by Commissioner Price, seconded by Commissioner Hufstedler, carried unanimously, the following Resolutionaw passed: RESOLUTION RESOLUTION ADOPTING PLANS AND SPECIFICATIONS AND DIRECTING ADVERTISEMENT FOR BIDS. WHEREAS, the City Commission on September 8, 1949, passed a res1ution providing for the improvement of a portion of streets and avenues in the City of Lubbock to be done under General Work Order Number 525 and directing preparation of plans and specifications covering the streets and avenues as named in said resolution; and, WHEREAS, the City Engineer has prepared and filed with the City plans and specifications for such improvements, and same have been examined; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT, the plans and specifications submitted by the City Engineer, covering improvements contemplated by aid resolution, BE, and the same are hereby approved and the Mayor and gity Secretary are hereby autho- rized and directed to advertise for bids in accordance with the "Notice to Bidders't made a part of said specifications covering the quantities of materials needed for said paving program as therein set out. AND IT IS SO ORDERED. H. o gura- Mayor Motion by Commissioner Price, seconded by Commissioner Spikes, carried unanimously, the following Resolution was passed: RESOLUTION BE IT RESOLVED -BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: For the duration of the alley paving contract with the Panhandle MV Construction Company under General Work Order No. 514, when said company has in writing advised the City Engineer that the owner of real property "'"N abutting any alley in the City of Lubbock, (not included within the above contract), and has paid to or secured said company in a manner satisfactory to it, ninety (90) percent of the total cost of paving the alley abutting said owners property, the City Engineer shall have authority to authorize such paving provided the total cost to the property owners does not exceed One Thousand ($1,000.00) Dollars, of which total cost the City will pay ten (10) percent PROVIDED the total cost for such alley paving to the pro- perty owner does nct exceed 'the estimates, and is done in accordance with the plans and specifications in said contract above referred to under General Work Order No. 514. The ten (10) percent of the total cost of such paving herein provided for to be paid is hereby authorized and appropriated out of the Alley Paving Fund, said amount to be paid upon inspection and certification by the City Engineer to the City Auditor that said paving has been done and completed as herein provided for. The total appropriation hereby made shall not exceed ONE THOUSAND EIGHT HUNDRED ($l,$OO.00) DOLLARS. AND IT IS SO ORDERED. Mr. Talkington to be paid in accordance with his bid being of record at Page 400, Minute Book 8. There was discussion of request of J. E. Mann of Mayflower Transit CgTapgLny, for permission to construct docks on street right-of-way, building located at corner of 6th Street and Avenue G. After such discus_aion, motion was made by Commissioner Spikes, seconded by Commissioner Hufstedler, carried unanimously, to instruct the City Attorney to draft License, to authorize such docks to be constructed. License to be written to require Mr. Mann, or Mayflower Transit Company, to remove docks if given written notice by'bhe City to do so, within thirty days from the time notice is given; and the Mayor is hereby authorized to execute such License. There was discussion of whether or not the City of Lubbock bear the expense of clearing alleys of obstructions, when they are dedicated, free of cost, to the City, and motion was made by Commissioner Price, seconded by Commis- sioner Hufstedler, carried unanimously, that such obstructions be removed by City forces, free of cost to the ropert Owners, when removal did not cost more than Two Hundred Dollars (3200.00T. If it is to cost more than $200.00 for removal of such obstructions, the matter be brought to the attention of the City Commission, for authorization. The City of Lubbock having made application to the Federal Government for funds for resurfacing the runways at the Municipal Airport,snah runways having been damaged by use of heavy government planes during World War 2, said Federal funds not being yet available to the City, it was unanimously agreed by the City Commission that repair be made to such runways in an amount not to exceed Ten Thousand ($10,000) Dollars. Mr. Pendley, Plumbing Inspector, appeared before the City Commission and there was discussion regarding use of copper pipe and fibre pipe in installatim of plumbing. After discussion of this matter it was unanimously agreed by the City Commission that use of copper pipe and fibre pipe be permitted. Cast iron pipe to be used under flooring. There was discussion of policies in operation of the Police Department, and motion was made by Commissioner Price, seconded by Commissioner Whiteside, carried unanimously, that the Chief of Police be, and he is hereby instructed,to designate three (3) shifts of Desk Sergeants, so that a Desk Sergeant will ht all times, during the 24 hours of the day, be on duty at the Desk Sergeant post. Petition signed by sixteen (16) property owners, reading: "Lubbock, Texas, September 19, 1949. Honorable Myyr and City Commissioners, Lubbock, Texas.
