Mr. John P. Ru4mann,
City Engineer
City of Lubbock
Lubbock, Texas
Dear Mr. Ruhmann:
Referring to our aDnfa ence and tentative verbal agreement
reached at Abilene on F?,btuary 24th. This letter is to confirm our
understanding:
The F W & D C Company will agree to transfer title bf a strip
of ground -approximately 40 x 400 ft., an area of approximately 16,000
square feet, in the vicinity of 19th and 20th Streets, which is now under
lease to Higginbotham -Bartlett Company, subject to lessee's agreement with
us to accept 304y eanooellation of the lease, which you advised the lessee
was agreeable to doing.
Also, we will transfer title of a strip of ground approximately
120 x 460 ft. with an approximate area of 55,200 square feet, lying between
the south line of 26th Street and to a point approximately 20 feet north
of the main track of the F W & D C Company; also a strip of property appro-
ximately 120 ft. square with an approximate area of 14,500 square feet, from
ou;p6riginal right of way, this being the property adjoining and on the south
side of the F W & D C main line and south of the track that will be relocat+
and which now serves the Plains Cooperative lease.
in addition, the relocation and paving of Avenue A, together
with ditches to provide necessary drainage, will isolate and make useless
an approximate area of 6100 square feet between the east line o-f the high-
way right of way and the west line of Avenue A. We feel the City should
acquire this property.
All of the property above referred to to be purchased by the
City at a price of seven cents per square foot. To get the exact amount of
square footage in each tract and the total square footage will require a
field survey. In addition, it will be necessary for the Railway Company
to remove the switch of the Plains Cooperative lease from the center of
Avenue A and relocate it approximately 130 feet west of its present location.
The approximate 130 foot extension of this track, together with labor
charge, is estimated to cost between $600.00 and $700.00, the expense to
be borne by the City.
Originally we had expected to sell to the City the property
now occupied by our main and industry tracks and ask the City to give us
a permanent easement for the operation of these two tracks. I recall
your expressed thoughts that the property should be given to the City
without charge. The property south of the railroad track is of considerable
value industrially and it would not be consistent for us to grant a perm-
anent easement or to dedicate this property to the City without charge.
We will, however, retain a strip approximately 60 x 150 ft. and we will
grant to the City or to the Highway Department a permanent easement
across this property for highway use on Avenue A, with the understanding
that the Railway Company will not be subject to assessment for the paving
of this area.
if the above is in accordance with your understanding 'of the
verbal agreement reached and you will so advise, we will take prompt action
to have joint survey made, definite areas determined, and takesuch action
as may be necessary to permit us to convey to you a satisfactory title to
the property above described.
Very truly )Four s ,
