Motion by Commiissioner Childress, seconded by Cormnissioner Dickey, carried unanimously, to authorize acceptance of the follotATing Right- of-S7ay /agreement betimeen the City of Lubbock and Geori*e R. Bean, for the vridening of 19th Street, and authorize filing of right-of- way deeds for record at the County Court Mouse, Lubbock, Texas, on said property. STATE OF TEXAS KNOW ALL TrI.EN BY THESE PIIESEISTS' : COUNTY OF LUBBOCK TILL-T, the City of Lubbock here called First Party, and Geo. R. Bean and wife, Nora Bean of Lubbock County, Texas, here called Second Parties, for the consideration hereinafter stated do hereby covenant and agree: Second Parties being the owners of the property hereinafter des- cribed and needed for right of Vay purposes in connection -with the widening of 19th Street do hereby dedicate and agree to convey to the First Party the property hereinafter described and First r'arty agrees to pay to Second Parties the swii-v26,323.48, being agreed damages accruing; to Second Parties and all other persons interested in the land herein described, said ariount to be paid Second x'arties for the b-snefit of all persons interested in said tracts of land and payable ,v18,933.30 by Tirst Party to Second Parties upon Second Parties del- ivering deeds of conveyance viith general warranties to said tracts of land to First Party and upon Second Parties beginninE; removal of the "Home Place" fr.on the right of way conveyed to First Party, and the balance ---7,390.18 to be paid by First Party to Second Parties at any time -ithin 12 months after this date, provided Second Parties have removed from the property conveyed to First Party all fences, buildings, structures and other obstructions found thereon, and have changed the location of residences situated on said trf�ict of land from -which the rir:ht of «lay is bein secured. One-third of the sum last above mentioned (.?7,390.18�1 •Till be paid by first Tarty upon compliance itlith the conditions as to the removal of obstructions and change of the residences, as and when the same are coLipleted, with reference to each of the three residences not situated on the property here called the "dome Place". The right of -rnay to be conveyed to First Party is designated by reference to Exhibits "Z.- "B", "C", and 'rL" hereto attached and further designated respectively as the (a) home glace; (E) Drick Veneer - located 1626 19th Street; (c) Frame residence located 1628 19th Street; and (ll) Brick Veneer - located 16.30 19th Street; each said exhibit carrying the description of the right of vjay to be con- veyed to First Party by Second Parties, it being the intention of Grantees in said conveyances, the Second Parties herein, to convey to First Party for street and highT.,,ay purposes that part of the pro- perty owned by Second i?arties,or in -hick they have an `.nterest, lying South of the North building; line established by Ordinance No. 726, of the City of Lubbock., and being adjacent to or abutting the tracts described in Exhitits "A", "B", " t1 and "I.)".
