Wilson, City Attorney 52-11-152-295 The following report from the City Planning Commission was given the City Commission: "On July.2, 1952, the City Planning Commission considered the request of M. 0. and Lona Owens to change the zoning of Lots 15 thru 23, Block 3, Lots (thru 14, Block 4, Lots 1, 2,"and 3, and Lots 6 thru 14, Block 5 Lots 4, 5, and Lots 15 thru 23, Block 6, Flynn Place Addition. The City Planning Commission does not recommend that the request to change this property from a "B" Residential District to the "H" Business District be granted." In view of the refusal of the City Planning Commission to recommend zone change in the Flynn Pace Addition the following petition was received. TO THE HON. CITY COKviISSION, City of Lubbock, Texas M. 0. Owens and wife, Lona, resident of the City of Lubbock, Texas, respectfully represents: 1. They are the owners, in fee simple, of these lots, in the Flynn Place Addition to the City of Lubbock, Viz - Lots 15 to 22, incl., Block 3; Lots 7, S, and 10, Block 4; Lots 7 to 14, incl., Block 5, and Lot 15, block 6, all lying on 33rd Street, and being a majority of the lots therein between the East line of Avenue L, and the North -South alley separating the Eastern parts of Block 3 and 4, from the Western parts thereof, from the enactment of the first "Zoning " Ordinance until 1952 all lay in an "A" Zone, or District, and since such have been placed into a "B" Zone, or District. 2. Applicants' mentioned property is, and has always been, unimproved, save Lot 10, Block 4, an• has been owned by them for Thirty (30) years; the occupied property lying within the part of 33rd Street mentioned is predominately rental. The railroad now operal.es its tracks on the West edge Avenue L, to 34th Street; the property in Blocks 3 and 4, lying East of the North -South alley lies in a "H" Zone, or District, along Avenue H, and completely used as such; Lot 23, block 3, Flynn Place has long housed a business enterprise. 3. A majority of the zesidences constructed with the past several years are beleived to erected subject to construction liens, and such is the pr:-sent i•rogram, and is likely to continue however, no lending agency will recommend such loans within the mentioned part of 33rd Street, for residential construction, and, being in a purely residential area, none could be made for business construction, or operation; such lack of availability is security has rendered the lots unmarketable, and practically destroyed their present value; but there has been repeated opportunities to dispose of same at a fair price, but, on the prespect learning that same is in a highly restricted district, such were abandoned as being wholly unfit for the use for which wanted, and which would be permitted in "H" Zone. Such situation will continue until change is made in the uses to which the property his been put. 4. A large majority of the owners of property within the designated area are in favor of the change is use as is prayed for here; such majority and these parties presented the matter to the "Zoning; and Planning Commis -pion" of the City of Lub. ock in July, 1952, and such was denied, with as stated to these parties, no filing with your Body as report of action, these parties appealed to the Board -of Adjustment of this City, and said Board, on opposition by the City Attorney, denied action on the plea said Board, "had no jurisdiction", such being done October 3rd 1952, if any report to the Commission (City) has been filed we h ve no notice, or official notice of the action. 5. The property herein is such as will be valuable if the uses permitted in a Zone, or District "H", for community retail, multiple house, manufacturing, and others, and permit the inhabitans west of Avenue H, and north of 34th Street to attend to such without having to cross heavily travelled ways, as Avenue "H" now is, and 34th Street will be when the State Paving Project is completed.. 6. Such uses as now to which the property is confined deprives the owners thereo their rights in prosperty without due process of law, denying them the equal protecti the law, and is of continuing nature; these applicants, themselves, own a majority of property sought to be effect6d into an "H" Zone, or District; since the "Zoning" was d (1941) the population of the City of Lubbock has increased from approximately 32,000 p to at least 85,000 persons, and continues to increase. If the change is granted, it not injure nor be detrimental to the peace, morals, safety or welfare of that community, nor of the City at Large, but, in fact, promote such. These parties pray for a hearing before the City Commission, as a body, of their grieveances, and thereat such be redressed, to the end justice and fair dealing may prevail. They call attention to their offer to ay the usual and customary charges, attached hereto, in the proper events fixing such. Respectfully, /s/ M. 0. and Lona Owens By their Attorney: /s/ Robt.A.
