There was consideration of proposal of J. B. Maxey to convey to the City 2522 square feet
of Lot 1, Block 5, Original Town, and a 14 foot strip of land, claimed to be owned by Mr.
Maxey, said land lying between Lot 1 and the present curb of 4th Street for a consideration
of $6000s, Mr. Maxey proposing to sell the City this land for the above named consideration
providing the City would cancel a paving bill in the amount of $351.58 against the 14 foot
strip of land mentioned above. This land being'needed by the City for 4th Street Right-of-way
After consideration of Mr. Maxey's proposal, motion was made by Commissioner Carpenter,
seconded by Commissioner Davis, motion carried, Mayor pro-tem Morris; and Commissioners
Carpenter, Davis and Thomas voting Yea, none voting Nay, that the proposal of Mr. Maxey
as set out in paragraph 5 of the letter from Klett, Bean and Evans, Attorneys, of date,
August 22, 1952, be accepted. The letter from Klett, Bean and Evans of date August 22, 1952,
reading as follows: Payment for this land to be made from Right -of -Way Bond Funds.
City of Lubbock
Lubbock, Texas
ATTENTION: Mr. Scott
Gentlemen:
Mr. J. B. Maxey owns Lots 1 and 2, Block 5, Original Town of Lubbock, adjoining 4th
Street.
A few years ago the City claimed he owed for some paving along 4th Street. It seems -
that many years ago Sylvan Sanders surveyed the property and that there was a 14-foot ex-
cess of property along the north edge lying adjacent to 4th Street and that Mr. Maxey
fenced in the property and has used it for many years, probably 20 or 25 years, claiming
it as his own. When the paving question came up he requested quitclaim from the City on
the 14 feet. He either owned the 14 feet, or he did not join 4th Street, according to
his contention.
I advised him at the time that I considered his position tenable, and that he should
either refuse to pay the paving or get a quitclaim to the 14 feet from the City. I was
3' then, and am still, aware of the contention of the City relative to the townsite dedication,
and the vacancies surrounding the town section. I am also cognizant of the contentions
made by other parties who have claimed a part of these vacancies, and of the results in a
number of the cases. 4th Street was never occupied or used to the extent of the original
vacancy shown on the plat of this 14 feet.
You now wish to widen 4th Street and take in practically all of Lot 1, including part
4. of his building.
I am authorized to present the following proposition: For Six Thousand Dollars
($6,000.00) net to him, you may have all of that land of'Lot 1, and the 14 feet, that
5. you now have scheduled and platted for your street widening. This will require Mr.
Maxey at his expense to move the building. A part of this proposal is that the City
will cancel and terminate his purported claim for paving costs of 4th Street now on
the City's books, such that this old condition will be cleared up. This paving cancel-
lation shall be in addition to the Six Thousand Dollars ($6,000.00).
You have estimated by 'appraisal Four Thousand Dollars ($4,000.00) for the land alone.
Besides the land, Mr. Maxey suffers substantial damage to his building in his necessity to
6. move or tear down the same, and he also suffers substantial damage to the isolation of the
rest of his property by reason of remaining size and its projected location relative to the
underpass. He considers Two Thousand Dollars ($2,000.00) very modest to cover the damage to
his building and the remaining portion of his land by reason of the condemnation proposed.
This proposition made to you is also with the understadding that you are threatening
condemnation unless an agreement is reached, and that this is an involuntary sale to you
7. under threat of condemnation. Naturally he expects to re -invest these funds in similar
property, and in so doing wi11 avdid an income tax penalty by reason of this involuntary
sale.
Sincerely yours,
KLETT, BEAN & EVANS

authorize acceptance of the new organization plan for the City of Lubbock Police Department
as set out in the following letter from the Lubbock Civil Service Commission.
August 12, 1952
Honorable Mayor, City Commissioners and City Manager
City of Lubbock
Lubbock, Texas Re: Recommended Reorganization
of Lubbock Police Department
Gentlemen:
The attached chart outlines a proposed reorganization plan for the Lubbock Police
Department, originally suggested in substance to this Commission by Chief of Police
Harold Mclnroe, and whom we understand has, in turn, discussed same with the City Manager
on one or two previous occasions.
The proposed reorganization is patterned substantially along the lines of a similar
plan currently being used by the Police Department of the City of Dallas, and contemplates
the creation of four (4) positions in a new Classification of Deputy Chief, to rank
immediately below the grade of Assistant Cheif and with salary commensurate with the duties
and responsibilities involved, and involving a substantial and fixed amount or differential
above that of the next lower pay classification (Captain).
One of the four proposed Deputy Chiefs would be in charge of each of the three present
divisions of the Police Department - Detective, Traffic and Patrol. The fourth Deputy Chief
would have charge of Departmental personnel and training work, and would have superior rank
in regard to such matters and activities. It is also contemplated and proposed that one of
the Deputy Chiefs, discretionary with the department head but probably the one in charge of
personnel and training, would serve as general aide to the Chief and would be designated to
act as department head during the absence or disability of the Chief, and would also serve
in a "utility" capacity to relieve division Deputy Chiefs during their absence or disability.
Eligibility to take the promotional examination for the proposed new grade of Deputy
Chief would include all officers now halding the grade of Captain or Inspector, or whose
names are listed on a current Eligible List for such grades. (Specifically, this would
include: Captains Kittrell, Lamb, Newton, Smith, Alley, Inspector Forreetor and Lieutenant
Blakney, whose name is on the current Eligible list for the grade of Inspector.)
It is the considered opinion of this Commission that the proposed organization plan
offers certain distinct advantages, including the following:
(a) Would provide a more centralized supervision and responsibility of the various
divisions of the Department, and at the same time avoid a preponderance of rank
or authority in any one division.
(b) Would afford a wide range of flexibility with regard to future growth and ex-
pansion of the department, in that additional and presently vacant grades -
shown in red on the attached chart - (Assistant Chief add Captains and/or
Sergeants in the Detective and Traffic Divisions) can be added as the needs
and expansion of the department warrants - and with the understanding that
such vacant grades will not be filled except on the recommendation of the
Civil Service Commission and approval of the City Manager and/or the City
Commission.
(c) Will provide a more effective chain of command and promote better coordination
between the various divisions of the Department.
(4) Will provide a reservoir of trained and experienced supervisory officers from
t which to fill future vacancies in the grades of Assistant Chief or Chief of
the Department,
In view of the foregoing, this Commission recommends that the proposed organization
plan and accompanying representations, together with a suitable classification ordinance
for the grade of Deputy Chief of Police, {suggested form of which is also submitted
herewith) be officially adopted and approved, with a view to putting same into effect and
operation at the earliest practicable date.
Very truly yours,
LUBBOCK CIVIL SERVICE COMMISSION
Marion Sanford
