Motinn by Commissioner Spires, seconded, carried, to approve the following "opinion" of City Attorney Vaughn E. vijson, in regard to interpretation of Zoning Ordinance No. 661, regarding "wash a terias": September 20, 1946. Mr. Homer D . Grant City Planning 'ommission % Panhandle Construction Co., Lubbock, Texas Dear Mr. Grant: In response to the request of your board for an opinion concerning the use of certain mechanized equipment for cleaning clothes in an "F" zone under Ordinance No. 661, the following is submitted for your consideration. The property affected is in an "F" ?one and it is supposed to be used for the purpose of placing In a building some 30 or 40 individual mechanically and electrically operated clothes washing units. These units are about the size of the average home electric stove. They are so constructed that about nine pounds of -soiled clothes are placed in an opening in the front of the washing machine, a door is closed, a coin is inserted in the machine, a switch is turned, and for some thirty minutes this machine carries on a mechanical washing process, then adjusts itself automatically so that some 73% of the water in the clothes is thrown from the clothes in a partial drying process. At the end of the time stated the individual placing the clothes therein removes them in this semi -dry condition and they are taken home or elsewhere for starching and ironing or otherwise to complete the laundering process. My understanding is that none of the laundering process except up to and including the drying of the clothes will be done on the premises involved. "Laundries" in their generally accepted and defined sense, are first mentioned and permitte4 under the terms of Ordinance No. 661, in a "G" district, along with cigar manufacturing and other kinds of manufacturing plants. The ordinance does not define the term "laundries" but it is de- fined by Words and Thrases as being: "Establishment receiving soiled clothes to be washed, cleaned and ironed, sending them to wet wash laundry for washing, and starching, ironing, and preparing them for delivery in pack- ages to customers on their return is "public laundry". It will be noted here that only a small portion of the cleaning process will be done by these machines and that this process is not attended by any of the objectionable features attributed to what is ordinarily considered to be a "laundry". Reference is made to Section 1 of the ordinance which sets out the pur- poses of its provisions and it is apparent from seeing this machine in opera• tion that its use, limited as above stated, would not be contrary to the purposes of the ordinance, in that such use could hardly be deemed to intensify fire hazards or prevent a normal use of light and air, or contri- bute to the overcrowding of land, or undue concentration of population. It is further apparent that this cleaning machine could be used in a residence and would not be condemned under the terms of this ordinance as a "laundry" so long as it was not used for commercial purposes in an "A" or a "B" district. "F" Districts provide for "retail cleaning shops", "Retail pressing", and "Dye plants". It is a matter of common knowledge that the operation of a pressing shop is usually attended by the use of steam boilers, heat and other features which are more objectionable than would be the operation of one of these mechanical machines designed only to wash about nine pounds of clothes at a time. A general rule of construction is that the duty of construing an ordin- ance primarily rests upon the Governing Body and in the absence of a showing of abuse of this discretionary right vested in such body, the courts are not authorized to disturb their construction. (1 SW (2nd) 373, King vs Guerra; Young vs City of Abilene, 195 SW, 838.) My understanding is that the premises would be used only to the extent in the cleaning process that was stated above and will not involve anything more than washing clothes to a semi -dry condition for re -delivery to the customer, and no condition will exist which even approaches a nuisance, either to the public or adjoining property owners. I therefore express the opinion that under the facts stated the these autmatic cleaning machines in a properly constructed building be permitted in an "F" Zone as a retail cleaning shop. However, this is subject to approval of the City commission. Yours very truly, Vaughn E. Wilson City Attorney. VEW:ms The foregoing has been considered by the City hearing thereon the Commission adopts and approves with reference to the construction of Ordinance No. This 26 day of September, 1946.
