Bean's proposal. Geo. R. Bean June L 7, 1946 The City Commission City of Lubbock Lubbock, Texas Gentlemen: I have been asked to submit to you a proposition for my conveyance to you of that part of my rroperty in the 1600 block on 19th Street, which the City of Lubbock desires for the purpose of widening 19th Street. As you know, I own 150 feet facing on 19th Street, where my home is now located, and I also own an additional 150 feet facing on 19th Street in the same block upon which are situated two brick veneer houses and one frame house. Inasmuch as it will be necessary for all of the houses to be moved in order for you to obtain that portion of the property which you desire, I feel that the damage which I will sustain will be at least ec),ual to the cost to me of moving all of the houses and such other improvements as the moving: of the houses will make it necessary to move, without reference to the value of the land actually taken, damage to shrubs, and the inconvenience and loss wt ich will be caused me by reason of such houses having to be moved. Nevertheless, I desire to be absolutely fair with the City, and as a proposi- tion of settlement, I am willing to convey to the City that portion of the rroperty desired by the City for the widening of 19th Street, provided the City will nay to me the estimated cost of moving my improvements. With this in mind, I have had prerared by a reliable contractor an estimate of t.hese costs, and h,;nd this estimate to you herewith. In making this offer of settlement, I do not want to waive my rights to ask for the value of the rroperty actually taken, rlus the damage to the remainder of the prol, ert,y in the event the City does not see fit to accept my proposi- tion. in other words, this offer is made as a rrorosi.tion of settlement and is not to be bindin_ uron me in the event the City seeks to c,ndemn such property. I have no desire to retard the rrogress of the City in any way, and wish to cooperate fully with the City in its pro,41ect. Nevertheless, I will be damaged in considerable amount by the taking of the front part of my rroperty by the City for street purroses, making it necessary that all four of the residences be moved, and I, therefore, feel that my submission of an offer of settlement on the basis of the estimated c:)st of moving such buildings is a fair offer of settlement.
