BRIEF IN SUPPORT OF PROTEST TO ZONING APPLICATION CASE NUMBER la.l4 OF ZONING ORDINANCE NUINIBER 661 , CITY OF LUBBOCK, TEXAS In support of and supplementing th g(protest to the City of Lubbock changing the Zoning Ordinance Restrictions to the West One-half of Block 177, Original Town of Lubbock, Lubbock County, Texas, from C Zone to H Zone by property owners in said block or property owners abutting and adjacent property thereto, the following facts are submitted in support of said protest for the City Commission of the City of Lubbock of Lubbock, Texas, action in rejection of any change of present pone Status of said property, to -wit: First. The application does not state the true status of ownership of said Lots 1 to 10, Block 177, 0. T. Lubbock, Texas. The record title shows, instead of owning or having a valid good faith purchase offer acdepted by owners of all said lots in question, one- half of said property is owned by parties either protesting thE6hange in zone status or hav- ing no valid, good faith and binding accepted offer of purchase from sa4petitioners. The Protestants, excepts and prays the application be dismissed. Second. All the block owners or adjacent and abutting property owners have not been properly joined, as the abutting owner of Lots 9, 10 and South One-half of 8, Block lbl, O.T. of Lubbock, Texas, has never received any kind of notice of the intended action of the City to change the zone status of the property under consideration, which would vitally affect the use and economic value of his property. The Protestants, excepts to said application for non -joiner or non -notice of necessary parties in the case periding, and asks the case be continued until proper notice can be had on any and all parties as required by law. Third. That there has never been and there is now no present need for a change in zoning status of the property or the abutting property involved in the application, to the knowledge of the Protestants, there is no demand for any of the uses listed under Zone H of the property involved or abutting properties thereto, that cannot now be accomdated under the present zoning status. The Protestants ask the application be denied for the fact that there is no demand for use of properties involved, which cannot now be served under the present zone restrictions thereon. Fourth. The change of zoning status for Lots 1 to 10, Block 177, O.T. Lubbock, Texas, would create a traffic hazzard on the abutting streets, as -it would result in two blind corners at Avenue N at 15th Street and at lbth Street (two rightaway traffic streets). The lack of use of off street parking by the present owners of said lots, now creates a traffic hazzard, and if the buildings on said lots were allowed to be built to the property lines, as provided under Zone H it would result in two blind corner hazzards, and as well as congested street parking as on 15th Street, and on lbth Street, two through streets, and would increase this hazzard, if no off street parking space could be provided, by the applicants for the persons it serves, as over 99 per cent of the said persons do not live in walking distance thereof and use private automobiles to cone to•and fro therefrom. The protestantb, ask the City to deny said application as it will tend to create addi- tional traffic hazzards on now badly congested streets, if building changes were made as permitted under Zone H. Fifth. The property has been and is now used, and for the foreseeable future will contirs to be used as a residential property, and not business property, as there is not any business buildings within trio hundred feet of the West One-half of Block 177, O.T. Lubbock, Texas, and Protestants know of no such/nV&e intended use. The Protestants, ask the City to deny the application as the present zone status serves the needs of the area involved. Sixth. The change of zone restrictions from Zone C to Zone'H would permit the applicants in this case to cause additional economic loss to owners of property in Block 177, or adjacent property thereto. 1. Abutting church property retards the development of adjacent property for resi- dence use or business purposes. 2. The extension of the present church buildings on Lots 1, 2, North One-half 3 and West One-half Lots b, 71 82 9, and 10, Block 177, O.T. Lubbock, Texas would make the abutting property untendable for use either as reiid ence as now used, or for business purposes in the future. The Protestants, ask the City ta deny the application changing the• zone status from C to H as would cause great economic loss to the protestants and owners in property of Block 1772 O.T. Lubbock and abutting property thereto. There was a lengthy discussion in regard to the change of the zone as set out in Case No. 1{.4 and motion was made by Commissioner Carpenter, seconded by Commissioner Thomas, motion carried, Mayor Tripp and Commissioners Carpenter and Thomas voting Yea, none voting Nay, to authorize this request of zone to be referred back to the Planning and Zoning Commission for further study and recommendation. 53-12-39-85 LEGAL NOTICE OF PROPOSED AMENDMENTS TO ZONING ORDINANCE OF THE CITY OF LUBBOCK, TEXAS TO ALL INTERESTED PERSONS NOTICE is hereby given that the Planning and Zoning Commission has recommended to the City Commission that Zoning Ordinance No. 661 be amended so that: ZONE CASE NO. 445 - Request of J.
