May 7, 1953 Proposed Ordinance Closing Part of Old Avenue A North of F&D Main Track Mr. Steve Matthews City Manager Lubbock, Texas Dear Mr. Matthews: I enclose ordinance for the purpose of closing part of old Avenue A., north of the Denver main track, which we would like for the City Commission to consider and pass. As you doubtlessly know, the Veazey Lumber Co. heretofore acquired a lumber yard site, still operating, adjoining the Denver track on the north, and facing old Avenue A on the west. N But when the City moved Avenue A to the west, and closed some parts of old Avenue A, such change of location of Avenue A to the west left Veazey Lumber Co. somewhat "high and dry", without an outlet on new Avenue A. Dr. Veazey, owner of the lumber yard, is quite anxious to close that part of old Avenue A 4n front of his property, so that he can still have direct access to the Avenue, as originally planned by him. Your consideration and action at your earliest convenience will be appreciated. Yours very truly, ELK -.oh /s/ E. L. Klett Enc. cc. Mr. W. B. Holmes, City Engineer Mr. Vaughn E. Wilson, City Attorney Mr. Murrell R. Tripp, Mayor Mr. Harry Morris, Commissioner Mr. Hurley Carpenter, Commissioner Mr. L. E. Davis, Comnissioner Mr. Lucian Thomas, Commissioner Veazey Lumber Co. Mr. J. C. Whitehurst, Attorney Consideration was given the request as set out in the above letter from Mr. E. L. Klett., wherein it is requested that part of old Avenue A north of the Fort Worth and Denver main track be closed. The area being described as follows: Beginning at the intereection of the east line of old Avenue A and the center line of said track, the said east line of Old Avenue A being the east line of Section 7, Block B, Lubbock County, Texas; THENCE north along the east line of said Section 7, 307 feet to the south boundary line of the rightof-way easement, dated November 5, 1952, granted and con- veyed to the City of Lubbock for public road crossing by FW&D Ry. Co. THENCE I.dest, 60 feet - THENCE south along the West line of said Avenue, 287.1 feet; THENCE southeastward along the said main track center line, 63.2 feet to the point of beginning. J Said Avenue now being designated as Ash Avenue, Since the area requested/codains 2 culverts and a drainage ditch, power line, a telephone line and a laterall gas line, it was found by the City Commission that it would not be to the best interest of the City of Lubbock to close said area, whereupon motion was made by Commissioner Thomas, seconded by Commissioner Carpenter, motion carried, Mayor Tripp and Commissioners Carpenter, Davis and Thomas voting Yea, none voting Nay, to REJECT the request for closing of this portion of Ash Avenue. u"505-9M LEGAL NOTICE OF PROPOSED AMED&NTS TO ZONING ORDINANCE OF THE CITY OF LUBBOCK, TEXAS TO ALL INTERESTED PERSONS r NOTICE is hereby given that the Planning and Zoning Commission has recommended to the City Commission that Zoning Ordinance 661 be amended so that. - ZONE CASE NO. 423 - Request of William Morgan, et al to change all of Sieber Addition 2nd Installment (Blocks 16, 17, and 18) from the "A" to "B" Zoning District Gast of Quirt between 31st and 33rd Streets). On this date May 14, 1953s the City Attorney presented the follow. ing letter to the City Commission, wherein Mr. Rose states the per diem fee for each of his 2 assistants ig $50.00, whereupon it was ungnimously agreed by the City Commission to approve the employment of Mr. Rose and his assistants as set out in the following letter and in letter from Mr. Rose of record at page 495, Minute Book 11. M Mr. Vaughn E. Wilson, City of Lubbock, Lubbock, Texas. Dear Mr. Wilson: This will acknowledge receipt df your letter of April 28 concerning the fee for my professional services. The per diem fee for each of my two assistants is' $50.00. The total fee for the analysis of data and preparation prior to court attendance will depend in large measure upon the legal requirements as set out by you and Mr. Crenshaw. Also there was some question at our conference as to whether some study should be made of ground water conditions at other city well fields to determine their iterrolation and correlation with the well field involved in the litigation. At present I do not kno%ifiow milch work will be expected from us and consequently cannot give you an intelligent estimate of our total fee. According to our accountant the charges for professional services and direct expenses to May 1 are $749.04. When I was originally contacted by Mr. Crenshaw to serve as your consultant I told him tht, a considerable amount of work would be necessary to prepare the technical phases of this that inasmuch as nip schedule of assignments was isry full it was very doubtful whether we could spend the time necessary to adequately fulfill your requirements for services, there- fore, I suggested that he employ another consultant. In a later conversation Mr. Crenshaw suggested that the City would be willing to assign one of its Engineers to the compilation and preliminary analysis of basic data if I would accept the assignment. I agreed to serve as your consultant under this provision which will lessen the cost considerably for consulting services and will permit me to fulfill my previous committments to other clients. I can fully realize the Commission'd desire to obtain an estimate of my charges. On the other hand, I am sure that you realize my reluctance to make an estimate of the fee for services for which I cannot anticipate. If this explanation is not satisfactory with your commission I shall be glad to get with you and Mr. Crenshaw to outline the services to be performed from which an estimate of charges can be made. Very truly yours, /s/ Nicholas A. Rose Nicholas A. Rose cc: Charlie Crenshaw 3-11-510-989 Air. The following repoki was given the City Commission by Lynn Andrews, Secretary to the Zoning and Planning Commission: At the Request of the'City Commission, the City Planning Commission has made a study of all annexation requests received that are still pending, and in general, a study of the entire question of additional annexations to the City of Lubbock# In connection faith this study, the Planning Commission heard the report of the City Engineer relative to .funds available and the cost tothe City of annexing various tracts that have been requested and other tracts of land that would necessarily need to be annexed in the event some of thee requests for annexation were granted. After studying the facts, a motion was made by Mr. C. E. Fulghem, seconded by Mr. J. D. Hassell, Jr., that the Planning Commission unanimously recommend to the City Conmi.ssion that no add- itional property be annexed t olhe City of Lubbock at this tire. The Planning Commission gave as its reasons for this recommendation: 1. Funds are not now available to furnish utilities (the City's part) to all tracts requistdhg annexation. 2. The value to the City of any one to two of the tracts requesting annexation did not appear to the Commission to overshadow other tracts requesting 3 annexation, and therefore, partial annexation would be discrimination* 3. It was beleived that the City, through its administrative officials, ahould make an immediate study as to how future annexations can be made and utilities furnished under a policy that would be economically feasible. This motion was passed by unanimous vote of the Planning Commission Members, 13 11-5U 1001+ The following report was given the City Commission by Lynn Andrews, Secretary to the City Planning and Zoning Commission: The Planning Commission in regular meeting May 7, 1953, unanimously recommended to the City Commission that the following zoning cases not be granted: CASE #431 - Request of C. L. Vaughn to change Lots S. 3, and 4, Block 4, Lot 2, 3, 4, and 5, Block 5, and Lots 1, 2, 3, and 4, Block/C. L. Vaughn Addition from the "B" to "J" Zoning District (35th Street between Avenue A and Avenue D). The Planning Commission feels that granting this request would be injurious to the residentUl property south of the property in question, and that an effective buffer between the industrial property on the north and the residential property on the south is now established. CASE - Request of Church of Nazarene to change Lot 12, Block 3, College Heights Addition from the "A" to "B" Zoning District (Salem Avenue and 35th Street ). The Planning Commission feels that the property in question would not leave sufficient #loom for off-street parking for the needs of the proposed use. CASE #A33 - Request of W. G. McMillan to change Lots 5 through 9, Block 1, Hilton Addition from the. "B" to "H" Zoning District (Avenue Q between 45th Street and 46th Street ). The Planning Commission feels that there is sufficient commercial property set aside in this general area in proposed shopping centers which should be developed prior to any additional commercial zoning in this area. CASE # 34 - Request of Paul Pattillo and C. A. Gibson to change Lots 6 through 10, Block 1, Parkhill Addition from the "C" to "F" Zoning District (34th Street and Flint Avenue). M. Sheats, and Emmagean Douglas -to change Lots 11 through 20, Block 1, Westminister Addition f rom ItC" to "F" Zoning District (34th Street between Flint Avenue and Elgin Avenue). The Planning Commission feels there should be no, changes in zoning on 34th Street before a solution to the traffic and parking problem can be found. CASE #436 - Request of Grady West to change Lot 1, Block 5, Syfrett Addition from "B" to nFu Zoning District (45th Street and Avenue Q). The Planning Commission feels that granting this request would be "spot zoning". CASE #439 - Request of R. B. Kelly, Minister of the First Church of the Nazarene to change Lots 22, 23 and south 70 feet of Lot 21, Block 9, from the "A" to "Bit Zoning District (33rd Street and Avenue Q). The Planning Commission feels that this area would be most desirable for residential development and that the estab- lished.residential quality and character of this area should not be destroked through zoning change. 3-117 514-1005 Request was received from Rufus flush that he be allowed to keel) the recently dedicated Toledo Avenue $om 17th Street to its merger with Utica Avenue at Broadway (Westchester Area) closed to t he public in order that he may cont im'his farming a ctivitie s until the Street is re- quired by the public to be opened.
