Dear Sirs:
Whereas there is already 1/2 Section of land adjacent to the P & S F Ry. and adjacent to the
Country Club Addition now available and not being put tb use for warehouse etc.
Whereas building of warehouses etc. through the middle of the Country Club Addition would
make it an undesirable place to raise a family.
Whereas the building of warehouses in a residential district lowers the value of residential {
property.
We the under signed property owners in the Country Club Addition are against changing any
of the now residential district as defined in the Zoning Ordinance No. 661 into the proposed
"H" Business Zoning District.

Mr. Murrell R. Tripp
Mayor
City of Lubbock
Lubbock, Texas
Dear Mr. Tripp:
February 9, 1953
Last summer the City of Lubbock prepared an ordinance requiring the Santa Fe Railroad
to install flashing light signals on Avenue "U", "Pit and "M".
We were not informed that an ordinance of this kind was comtemplated and when it came
to our attemttion we discussed the matter with City Attorney Wilson and Mr. R. L. Oldham
who was then City Manager, and as a result of these discussions it was agreed that the
Ordinance would not be brought up for final reading and that we would proceed immediately
with the installation of flashing light signals on Avenue "U" and endeavor to secure an ap-
propriation on our 1953 Budget for placing similar signals on Avenue "Pit and limit.
This understanding was not conditioned on any participation by the City of tmbbock in
the cost of installing these signals although I told Mr. Oldham at the time, I thought it
was reasonable and fair that the City should pay a portion of this expense and that I would
discuss the matter further with the City Commission.
Subsequent to these events which took place in July 1952 I appeared before the City
Commi s.s,ion and explained our views regarding the equities in this case.
Their attitude was sympathetic but they did not agree to do anything about this matter.
Actually, the presiding officer who I think was Mr. Davis, simply said they would keep the
matter in mind and do the best they could for us or words to that effect.
We heard nothing farther regarding the matter and I later talked with Mr. Matthews
about it. He said he thought the Commission regarded the matter as a closed incident
although the Commission would be glad to see me any time I wanted to come to Lubbock,, I
believe this brings the situation up to the time of my conversation with you the latter part
of December.
As suggested in our converstwtion, we have been pursuing the matter of obtaining the
money for the flashers on Avenues "Pit and "M" and we would appreciate your consideration
of the possibility of having the City of Lubbock participate in the cost of placing this
crossing pw tection.
The original laws regulating the installation of crossing protection and grade separat-
ions were passed before the onset of the automobile age. At that time traffic was slow and
light both from the standpoint of density and the weight of individual units. As a con-
sequence the railroad was the principal source of danger at a street intersection and at that
time probably it was propenthat a railroad should provide warning signs for the public at
its own expense.
As it is unnecessary to enlarge upon, these conditions have changed and under ordinary
conditions railroad traffic constitutes_ a minute fraction of the traffic over an intersection
with a busy street or highkay.
The highways are no longer used as avenues .kor pleasure and business travel at
leisurely rates of speed but have become arteries of commerce over which hegvy vehicles
moving at high speed carry a very considerablgAmount of freight in direct competition with
the railroads. In an encounter with one of these supervehicles, the train does not always come
off unsccs:thed.
It is our view that if motor vehicles drivers operated their vehicles in a reasonable
manner the warning signs now provided as a standard installation at each grade crossing would
be adequate and consequently/&nything in addition to such standard sign is to permit higher
speeds on the highway or require less attention on the part of the motor vehicle operator and
consequently should be paid for by the highway interest#.
This prinicple has been recognized by the Federal Government and some6tates. Crossing
protection of the type under discussion installed on highways where Federal Funds are in-
volved, if not installed entirely at the expense of the Federal Government is paid for Qn
the basis of 90 per cent by the Government and 10 per cent by the Railroad Company.
The State of Texas in general follows a similar policy and some other States have
legislation restricting the finanieaal participation by the railroads in the installation
of flashing light signals and similar protection to somewhere around 15 per cent.
I mention the facts set out in the foregoing so you may know why we do not believe it
unreasonable to ask the City of Lubbock to participate in the cost of installing the pro-
tection ndw under discussion. F
When we were talking about this matter you said, as I recall it, that if the City
assumes part of the expense for these signals you thought this should not exceed one-half
the average cost of an installation in the open country or away from switching activities.
We estimate a flashing light signal installation of the kind you mentioned would cost
about $7500.00 and while it has been our view that it would be equitable for the City to pair
fifty per cent of the cost of the Avenues "P" and "M" signals we would, of course., appreciate
having you join us on the basis suggested.
The estimated cost of the signals now under consideration is, for Avenue "P" $11,800.00
and for Avenue I'M" $12,900.00.
We share the Ci.ty's anxiety to proceed with this program and hope you will be able to join
us in the expense.
If the Cpnmmission is not favorable toward paying a part of the cost of these signals
we would appreciate having an opportunity to talk with them further before they reach a
final decision in thg6atter.
Sincerely,
Is/ J. A. Noble

Consideration was given the request of Panhandle and Santa Fe Railway Company, as set out
in the above letter, for the City of Lubbock to pay portion of the cost of installing
flashing signal lights at the intersection of the Railroad with Avenue P and Aveuue M .
The Railroad estimates for these intersections being $11,800.00 and $12,900.00 respectively.
After consideration of the request as set out in the letter, motion was made by Commissioner
Thomas, seconded by Commissioner Davis, motion carried, Mayor Pro-tem.Morris, and Com-
missioners Carpenter, Davis and Thomas voting Yea, none voting Nay, to reject the request.
