Ability of Attorneys to sign bonds in certain cases and when not having sufficient collateral was discussed by the abov@ group and policy determined. -13-284-486 The following report was given the City Commission. - The City Planning and Zoning Commission in regular meeting on November 4., 1954 unanimously recommended to the City Commission that the following zone change requests not be granted: ZONE CASE N0. 492 - Request of.Tech Foundation (Dr. D. M. Wiggins) to change Lots 1, 2, 3 and the East half of Lot 4, Block 5,.Ellwood Place Addition, Installment No. 1 to the City of Lubbock, Lubbock County, Texas, from an "A" to an "F-111 Zoning District (19th Street and College Avenue). ZONE CASE N0. 495 - Request of W. Bogart to change the west half of Lot 4, all of Lots 5 and 6, and east half of Lot 7 in Block 5 of the Ellwood Place Addition to the City of Lubbock, Lubbock County, Texas, from an "A" to a "G" Zoning District (19th Street and College Avenue). _ The reason stated by the Planning and Zoning Commission for their action was that to grant such changes would be the beginning of a pattern of growth of a business area throughout this neighborhood and in the area to the west. It was felt that to grant these requests would leave no reason for not granting further requests for business zones in this neighborhood and along 19th Street to the west. It is believed also that persons in this area would suffer a reduction in value of their property for residential purposes if the change is granted. -285.4 87 The following report was given the City Commission. - The status of right-of-way for Ave. "Q" Northeast is as follows: (1) Purchase of W. Wesley Read Box 190 Lubbock, Texas October 28, 1954 Hon. Steve Matthews, City Manager City of Lubbock Lubbock, Texas Proposed Sale Water North 1/2 Sec. 48 Block A Dear Sir: I have advised my client that the city has been able to obtain water along the Northwest pipe line at less cost than his offer of $84,000 on his 320 acres, and now have his authority to offer this water to the City at $63,000.00, subject to reserving the irrigation well on the West line and two domestic (orhousehold and pasture) small wells. Irrigationiell now on South line to be abandoned . Water to be conveyed clear of liens, and with all necessary easements for lines, electric poles, etc. It would appear that this low price, with no greater expenditure than an additional 12 inch line would require, certainly should overcome objections as to spending money to salvage the rapidly declining water field to the Northeast. A new 12 inch line from the 36 inch line up to and into this property, along with the present 12 inch line now extending Northeast which can be extended as need may require, should verywell handle the water from this 320 acres as rapidly as the City would want -to develop the field under this land. Or, letting this property rest from development until the existing 12 inch line becomes useless, then simply extending the existing 12 inch line slightly over 1/2 mile into this property, this water can eventually be made available at very low cost. Under either plan the per thousand gallon cost certainly looks favorably low, especially considering the fact that the gathering system to the Northeast faces rapid diminishing of supply and presages a considerable loss if abandoned. Moreover, there is always the possibility that additional water might be found available to the North of this property. Will you please ask the Commission for further consideration and advise as promptly as possible. Ma Yours truly, /s/ L. Wesley Read L. Wesley Read PS In lieu of all cash, if the City desires, purchase.can be handled with 50% cash, remainder five years at 3% interest, monthly, quarterly, semi-annually or anually. LWR. After consideration of Mr. Read's proposal as outlined above, the Director of Public Works was instructed to make a survey to determine. whether or not it is Feasible for the City to purchase water rights at this location. -1 2 - . . . 54 3- 87 The following report was presented to the City Commission. I Lubbock Sewage Treatment Plant. The amounts listed above for trunk mains will not be adequate to provide fire protection to all of the developed areas. We have several areas in which domestic water service is adequate but fire hydrants are located more than 1000 feet from residences. Likewise we have several areas where pressures will not be adequate when they are fully developed, unless reinforcing mains are laid. It is necessary to keep the above in mind when considering annexations. The 1/4 section located at,50th Street and Avenue A will require a City participation of $66,865 for water when it is 85% developed. The 1/2 section located between 50th and 66th Streets from College to Elgin will require a City Water participation of over $900000 when 85% developed. The City's sanitary sewer costs on the same basis are $9,190.00 and $67,000 respectively. Following are proposed expenditures from Sanitary Sewer Bond Funds for the next 4 years: Balance of Unsold Bonds 275,000 Cash Balance (Time Deposit) 160,000 Total available Proposed Expenditures: $ 435,000 Pro-Rata Supplement $ 1001000 Lift Sta. and Yellowhouse Canyon Outfall 50,000 50th St. A to U - Trunk Main 50,000 50th St. Outfall, Ave. A to Plant 150,000 Outfall line near Compress Ave. 20,000 270,000 Unencumbered and for contingencies $ 65,000 The*tility cost to the City, when the subdivision is 85% developed, for an average 640 acres platted into rectangular blocks is as follows; Water Distribution. - Estimated total cost - 640 acres $ 380,000 Estimated -Pro Rata Charges 2 0 000 Estimated City Cost when developed T150,000 Sewage Collections Estimated total cost - 640 acres $ 210,000 Estimated Pro-Rata Charges 1 000 Estimated City Cost when developed 17 57,000 The above estimates do not include approach mains or trunk mains which lie outside the section. In summary it is evident that annexations, necessary as they are, will result in limiting the bond funds available for fire protection and sanitary sewer trunk mains. It follows, especially in the case of sanitary, sewers, that budgeted funds will have'to be made available for such requirements if addquate service is maintained. W. B. Mr. Henderson also presented the following petition in this regard: STATE OF TEXAS COUNTY OF LUBBOCK TO: The Mayor and the Honorable City Commission of the City of Lubbock, Texas: We, the undersigned resident property owners of the City of Lubbock, Texas, hereby respectfully petition your Honorable Body not to pass the Amendment to Section 16, Paragraph 100 of Zoning Ordinance No. 661 of the City of Lubbock, as said Amendment has been recommended to you by the Planning Commission of the City of Lubbock, on October 11, 1954. Our reasons being that you will destroy more in value to the owners of property facing a street than benefits will accrue to those persons owning reverse front lots. We have faithfully complied with the 35 foot set back rule, and the corner lot owners with reverse frontage have waited until. we have built our property in conformity with the original Ordinance, and now propose to destroy a part of our value to enhance their value. Surely the reverse front lot owners could be helped by a 25 foot set -back rule in lieu of the 15 foot set -back rule, as proposed, and a great deal of the damage that 1 will be done to us by the 15 foot set -back proposal would be eliminated.
