Said request being that they be afforded the opportunity of submitting a proposal to the City of Lubbock for refuse collection and disposal. September 13, 1954 via air mail Mr. Steve Matthews City Manager, City of Lubbock Lubbock, Texas Dear Mr. Matthews: This office is in receipt of clipping from one of your local papers in regard to proposed garbage collection savings, also information that your total cost per year is $338,000 for this service. Presently this company is negotiating with a city of 200,000 population for complete garbage collection and disposal at a stated sum of $22,500 per month, which figure saves that particular city approximately $90,000 per year on their operation. It is felt that our company, which is experienced in refuse collection and disposal,.can offer the City of Lubbock material savings and we ask leave to go into this matter in detail and submit a formal proposal. It is noted that you comtemplate the purchase of Dempster Dumpster units for your downtown area. In this connection we might mention that Moore Service, in co- operation with the Navy at Corpus Christi, has experimented and gone forward in developing a system whereby the cans are not each transported to the sanitary fill from the downtown area but are lifted by means of a fork lift and emptied into a large, packer type trailer and/or truck. This type of operation saves materially on cost of transportation to and from the fill. At Corpus Christi, with packer type truck of 24 yard capacity, seventeen (17) Dempster Dempster boxes were emptied into the vehicle before it was necessary to make trips to the sanitary fill. This information we are passing along to you as sometimes municipalities make certain changes in their collec- tion methods without going into the matter completely. It will be appreciated if Moore Service may be afforded the opportunity of submitting a proposal to the City of Lubbock for your entire operation of refuse collection and disposal, bearing in mind that only local dtizens will be employed, with the exception of possibly one or two supervisory employees that are familiar with Moore Service operation. CBM/db cc Mr. W. B. Director Holmes of Public Works Commissioner Hurley Carpenter Commissioner Lennis Baker Mr. A. B. Davis Secretary, Chamber of Commerce Editor Lubbock Morning Avalanche Cordially yours, MOORE SERVICE /s/ Chas. B. Moore Charles B. Moore . After consideration of the request of the Moore Service that they be allowed to submit a proposal to the City of Lubbock for collection and disposal of refuse, motion was made by Commissioner Carpenter, seconded by Commissioner Baker, motion carried, Mayor Tripp and Commnissionere Baker, Carpenter, Forrest and Thomas voting Yea, none voting Nay, to authorize action in regard to this request to be deferred until completion of the survey now being made by this Company at Corpus Christi. The following letter, addressed to Mr. Vaughn Wilson, City Attorney and signed by the law firm , Crenshaw, Dupree and Milam, in regard tot (1) Merrill and Roberds vs. City of Lubbock (2) Romp- Trevino - Morin vs. City of Lubbock (3) City Water cases was presented to the City Commission for consideration. Mr. Vaughn Wilson City Attorney Lubbock, Texas Law Offices CRENSHAW, DUPREE & MILAN Central American Life -Building Lubbock, Texas September 29, 1954 Ret Merrill and Roberds vs. City of Lubbock Ret Rmmo --Trevino - Morin vs. City of Lubbock Pa. City Water Cases Dear Vaughn; As you know, I have done considerable work in the various cases above mentioned and have so far not called upon the city for payment of any portion of the fees. In the case of Merrill and Roberds vs. City of Lubbock on checking the charge memoranda slips back in 1947, it appears that we agreed on a trial fee of $1,000.00 and $500.00 additional on appeal was taken. The trial has already been had, and it occurred to me that it would be proper to have payment made to us of the trial fee of $1,000.00, and I enclose a bill in that amount. In the Morin, Romo and Trevino cases against the city the fee agreed on was $63.500.00 in the first case tried and $750.00 each for the trial and final disposition of the other cases. In other words there was the possibility that a trial and appeal of the first case tried would result in the other two cases never being tried, in which event the $3000.00 would be all the fee we would receive. There was nothing said about the time or manner of the payment of the fee. We have, as you know, done considerable work in these cases in the taking of depositions and the briefing of the legal questions involved and feel that a payment of $1500.00 at this time on the fee would not be improper. We enclose a bill for that amount. In the City Water cases we agreed upon a fee according to aw letter to you of September 26, 1952, in the six cases as follows: 500.00 for the first case tried and finally disposed of and $1000.00 for each other case tried and finally disposed of; the fee to be payable as and when the case is actually tried and thereafter finally disposed of. Under this agreement we are not legally entitled at this time to any partial payment on the fees in any of the cases. However, the cases have dragged along for a considerable longer time -than any of us anticipated at the time of the fixing of the fee, and as you know, we have done a tremendous amount of work in briefing the law applicable to the cases; preparing pleadings; conferences with engineers and hydrologists; attendance on the stater law and attendance at the trial of the case of City of Plmsanton et al vs. Lower Nueces River Valley Water institute District at Jourdanton, Texas. It was anticipated that some of the questions involved t Austin; in the City cases here would probably be raised in the trial of the City of Pleasanton case and that therefrom it would be beneficial for me to attend the trial and listen in on it. I spent some five daysr time going down there and returning and sitting in on the trial,, but as it turned out none of the questions involved in our City water cases here arose in the City of Pleasanton case. Of course, we could not know that, however, in advance. In view of the long delay in bringing these cases to trial and the large amount of work that has been necessary to do in the cases, it occurred to us that the City Commission might feel that it was not improper at this time to make a partial payment of $1,500.00 on the fee, and we enclose a bill for that amount. Of course, if the City Commission feels that under the agreement as made back in 1952 that no partial payment should be made at this time, we certainly would have no complaint because they took that view and are leaving it entirely up to them as to what they desire to do. We.have also incurred considerable expense in connection with these water cases amount- ing to a total of $261.08 for which I enclose a bill. On the expense to Jourdanton, I only charged for my hotel expense at San Antonio while -attending that trial. We will appreciate it if you will present these bills and our letter to the City Commission; and if they feel that they can properly pay these bills at this time, we would, of course, appreciate their favorable action. With kindest personal regards, we are CCC:grs Encl. Yours very truly, CRENSHAW, DUPREE & MILAM Byr /s/ Chas. C. Crenshaw, Sr. Chas, C. Crenshaw, Sr. After consideration of the request for payment as set out in paragraph 2, 3, 5 and 6 of the above letter, motion was made by Commissioner Baker, seconded by Commissioner Thomas, motion carried, Mayor Tripp and Commissioners Baker, Carpenter, Forrest and Thomas voting Yea, none voting Nay, to authorize payment to the law firm of Crenshaw, Dupree & Milan as follows: _ $10000 as trial fee in the case of Merrill and Roberds vs. City of Lubbock. $1,500 for taking deposition and briefing of the legal questions in the case of Mori4i, Romo and Trevino vs. City of Lubbock. $4500 as partial payment in briefing the law applicable to the cases; preparing pleadings; conferences with engineers and hydrologists; attending the water law institute at Austin, Texas; attendance at the trial of the case of City of Pleasanton et al vs. Lower Nueces River Valley Water District at Jourdanton, Texas and in the following cases: Nancy Brown vs. City of Lubbock Carl Foster vs. City of Lubbock Hugh Newton vs. City of Lubbock C. A letter was written to the Chief Engineer of the Santa Fe requesting that a letter be furnished advising that they would accept such responsibility. A letter in reply was received advising that since the spur track was privately owned_ they were unable to comply with our request, therefore attempts were made to contact the owners of the track. Walker Stanton, one of the olmers, finally agreed to pay one-half of the estimated cost of $1,586.10 of this improvements and has signed a letter to this affect. The other owners have not agreed to pay. The Railroad Company was advised of this and their Chief Engineer verbally advised the Director of Public Works that he thought there would be no difficulty in this matter. Since this was one of the factors holding up the advertisement of this highway project the Director of Public Works advised the Highway Department by letter dated October 1, 1954 that the City of Lubbock would be responsible for the improvements of this crossing. We have no doubt that the Railroad Company will not stand this expense and the crossing work will be accomplished with Railway Company and City Forces. 54-13-229-30 The following letter addressed to Mr. Steve Matthews, City Manager and signed by Charles E. Maedgen, Jr. , president of the Lubbock National Bank, was presented to the City Commission for consideration. THE LUBBOCK NATIONAL BANK Lubbock, Texas October 9, 1954 Mr. Steve Matthews, City Manager City of Lubbock Lubbock, Texas Dear Steve; In line with the conversation which I had with you recently, I am submitting this letter as a formal request to be presented to the City Commission at its next meeting, asking that permission be granted to dig a tunnel across the alley to the east of the Lubbock National Bank Building, We have acquired the rights to the properties adjoining the bank which properties are described as Lots 11, 12 & 13, Block 104, Original Town, on the east side of the alley- way, and we are planning to erect a Motor Bank on them as soon as they are vacated, In order to comply with Texas banking law, these properties must be connected with our main banking room and the construction of a tunnel to the new properties from our present bank quarters will be necessitated to affect compliance with the state regulations. We therefore request permission to build a tunnel five feet wide and eight feet high, of concrete construction, approximately thirty-six feet south of the northeast property line of the Lubbock National Bank Building. The floor of this tunnel will be approxi- mately thirteen feet below ground level, and will cross the alleyway adjoining the bank in an east -west direction to reach Lot li, Block 104, Original Town, which is now occupied by a frame building, and which is soon to be vacated and raxed. A drawing showing the location and construction of this tunnel is attached. It is also requested that permission be granted for the erection of a canopy east -west across the alley, at such minimum height as may be determined by 'city building regulations. This canopy will be approximately ten inches in thickness and approxi- mately eighteen feet in- dth, and will be located about seventeen feet from the northeast property line of the building. A drawing is also submitted showing the diagram of the canopy and the buildings it will join. If there is any further information in connection with this proposed construction, or if you would like to have someone present this to the City Commission in person, we will be glad to furnish further information in any manner desired. I will appreciate a presentation of this request at as early a date as possible, and would also appreciate hearing from you as soon as this matter has been acted upon. Very truly yours, /s/ Chas. E. Maedgen, Jr. Charles E. Maedgen, Jr. President After consideration of the above letter, motion was made by Commissioner Thomas, seconded by Commissioner Baker, motion carried, Mayor Tripp and Commissioners Baker, Carpenter, Forrest and Thomas voting Yea, none voting Nay, to grant this request as set out in the above letter of the Lubbock National Bank and to authorize the tunnel across the alley East of the Lubbock National Bank Building located at 916 Main Street. Said tunnel to connect the Lubbock National Bank Building and a structure to be erected on Lots ll, 12, 13, Block 104, Original Town of Lubbock. Machinery & Supply Company, Inc. of f Fort Worth, Texas, in regard to purchase order No. A-1974 for 300 1" Mueller Curb stops. The Well Machinery and Supply Co, requesting cancellation of said purchase order -as they state their quotation on this material was in error, resulting in a $300.00 loss to the Company. WELL MACHINERY & SUPPLY COMPANY, INC. Fort Worth, Texas October 5, 1954 City of Lubbock Lubbock, Texas Attr Mr. Roy L. Grimes Purchasing Agent Dear Mr. Grimesr From the number of times he is quoted, it is to be assumed that the public at large is of the opinion that the man who said "to err is human" was a pretty smart man. Certainly the folks at Well Machinery & Supply Company are human, and as human beings it seems we occasionally err. In fact, the past few weeks we have erred twice in the same place, which is certainly something we dislike, and especially so since the errors concerned the City of Lubbock. On your Purchase Order A-984 under item #16 there appeared a 11150 Pair of 1" straight meter couplings, Mueller H-10890." In quoting on this item, our quotation clerks quoted 150 pieces., instead of price per pair. The price per piece is $.75 and the price per pair is $1.50, and it would seem we made a $112.50 mistake on this item. Then just to cap the climax, on your Inquiry No. 683 you requested us to quote the following: 11300 - Mueller Curb Stops, l" copper pipe inlet and 1" I.P. Thread outlet.. H-15275 or equal." Our quotation clerks, quoting 98 per cent of the time on 3/4" Mueller Curb Stops, rather than the 1", quoted the 3/4" unit at $2.56; whereas, our actual cost on the 1" unit is $3.55, As a result, if we fill this order there is an actual out-of-pocket loss of $300.00, or within a few cents of this sum, involved in this order. We believe you will agree that both of them are obvious errors. We are sure your competitive quotations make that fact very plain. The meter couplings have already been shipped, and we can readily understand how it might cause you considerable embarrassment to permit any change in this price, and we will "take our licking" on this item and try not to repeat the error. On Purchase Order No,A1974, Mich arrived in our office only a day or two ago and which as stated shows a dead loss of $300.00, we kindly ask your permission to return your purchase order to you so that you may place the order with the next lowest bidder* We made this request against the background ofj#iaving quoted the State Board of Control a few years ago on a number of pumps which run into several thousands of dollars and an error was made, and the State Board of Control very graciously per- mitted us to withdraw our bid without any prejudice whatsoever against our continued privilege of quoting. The order was placed with the next lowest bidder. We do not believe we made any more than an average amount of errors in handling these things, but we are sure you realize that our quotation clerks handle hundreds of them every month, and it is too much to hope than an occasional error will not get through. As stated above, billing on your A-984 will go forward in strict keeping with your purchase order, but we do kindly ask your permission to withdraw on A-1974, which is so obviously an error either in typing or calcuation. Thank you kindly, Mr. Grimes, for your kind consideration of us and the many favors we have received at your hands. With best wishes, we are RIX:mcw Yours truly, WELL.
