f4-1-121-209 The following report was given the City CondA siont
The City Planning and Zoning Commission in regular meeting August 5, 1954
unanimously recommended to the City Commission that the following zone
change request not be grant edt
Zone Case ##481 - Request of E. L. Klett (F. W. & D. Rye Co.) to change that
part of the railroad right-of-way lying west of Texas Avenue crossing Lots 1s
2 and 4. Block 1, Harkey Addition, an addition to the City of Lubbock, Lubbock
County, Texas, from the nHa to the "J" Zoning District.
The reason stated by the Planning & Zoning Commission for their action was that to grant
such a request would be against the policy of the Planning Commission to zone the
property abutting a highway into an industrial district, thereby allowing industry and
industrial uses to approach upon the highway and thus -create an unsightly condition.
This area was rezoned to "H" Zoning District in a zoning pattern sometime back, to
correct this problem.
54,13-122-210 The following letter was received from Walker Stanton, president of the Standard Milling
Company located at 4th Street and Avenue N.
August 10, 1954
The Mayor and City Commission
Lubbock, Texas
Gentlemen;
This letter is written with reference to the necessary right-of-way that is planned
to widen Fourth Street along both sides of our property now located on this street.
According to the information that has been furnished mes it will be necessary to -move.
our truck receiving scales and scale house along with three concrete driveway approaches;
two into our warehouse and one into our grain elevator.
We have secured estimate bids on the cost of moving our scales and scales house at the
request of Mr. Bill Holmes and Mr. John Scott. The two bids are as follows:
H. R. Bundock Construction Co., of Lubbock - $2520.00; The Lyles Scales Co., of
Plainview, Texas - $2183.03.
In as much as we were given permission by the City of Ubbock to locate our scales where
they now are and due to the fact that they have been located intheir present location
since`1941, we feel as though the expense of moving these scales and scale house for the
purpose of widening the Fourth Street right-of-way should be taken care of by the City
of Lubbod$ together with whatever expense would be involved inreplaeing our three drive-
ways into our building on Fourth Street.
Please bear in mind that in case these scales and scale house will have to be moved that -
this work will have to be done at a time when we are not using these scales for the
receiving of grain, which will soon start and run through the months of October, Novembers
and December As we have discussed before, we cannot be without our scales during the
harvest.
Yours very truly,

missioner Carpenter, seconded by Commissioner Forrest, motion carried, Mayor Tripp and
Commissioners Baker, Carpenter, Forrest an)homas voting Yea; none voting Nay, to request
this company to remove the obstruction from the right -of way,at their own expense.

Consideration was given the counter proposal of S. E. McMillan to convey 1.97326
acres or 859955.2 square feet of land out of Blocks 63 and 82, Roberts and McWhorter
Addition. This right-of-way needed by the City for frontage road on Northeast
Avenue Q. 0n March 10, 1954, Mr. McMillan submitted a proposal to the City to convey
842,898.44 square feet at 5W per square foot plus $63.28 for paving cost, which paving
no longer abuts the remaining property, or a total consideration of $42*512.50, the
appraisal value of the property needed by the City for this Right —of -Way (84,898.44
square feet) was 270 per square foot, and the City Commission, on March 11. 1954,
rejected the proposal and authorized that an offer of 270 per square foot, the
appraisal value of the property, be made to Mr. McMillan. Mr. McMillan considered
the offer of 270 per square foot for the needed right-of-way and has reconsidered
and states that he will accept the appraisal price of 27¢ per square foot provided the
City will compensate him for the following items, which he believes are reasonable:
(1) Add the sum of $106.4.2 for paving which no longer will abut his
remaining property.
(2) Purchase a small strip of land between another owner and the highway
right-of-way which is of no use to him as it cuts off the other
owner from the new access road. The City may use this small strip
in dealing with the other owner as it is needed to complete his
frontage. Strip contains 1056.77 sq. ft.
(3) Compensate him in the amount of $5450.00 for because his
property will be reduced in size from a 5 acZWNa 3 acre area,
also his remaining property will have a "V" notch out of it which
will cause several interior angles of less than 90 degrees. Amount
is based on 2J cents per sq. ft.
(4) Remaining property will have a frontage of 670 lin. ft. and will be
assessed approximately $1.50 or $1005.00 for curb and gutter. He has
requested that he be relieved of this cost. Summary of his proposal
is as follows:

The counter proposal as now submitted amounts to $12,743.18 reduction.

ers Baker, Carpenter and Forrest amd Thomas voting Yea, none voting Nay, to authorize

Subject:. Test on Cain Well
A 160 rain. test was run on August 2, 1954. The pump is out of line with the motor causing severe
wear on the drive shaft so a longer run is inadvisable until the pump is reset.
The test shows a probable strong interference from a nearby irrigation well. The irrigation well
was estimated to be pumping approximately 700 gpm. the two wells are approximately 200 yds. apart.
The Cain well has a transmissibility of 21,350 at the end of the test with a drawdown of 12.19
feet. The well was pumped at approximately •510 gpm. It looks life this well could easily
stand a 400 gpm pump and it would last for several years if it isn't overworked.

E-1j-124-213 Mr. Roy Davis of the Plains Co-op Oil Mill appeared before the City Commission requesting
that the City abandon and close Ash Avenue between the Fort Worth and Denver Railway
Company South right-of-way line and the North line of 31st Street, th hosing to be
contingent upon acceptable easements for power, gas and telephone/li . yMr. Davis
stated to the City Commission that this land i4needed by the Oil Company on which to
place a new office building, the company requesting that they be given possession of that
part of Ash Avenue, -from 31st Street, North to the Railroad. Mr. Davis advised the City
Commission that the Plains Co-op Oil Mill has paid the Dillard Estate $5375.00, the
Wheelock Estate $1,500.00, the Brown Estate $4750.00 and attorney fees in the amount of
$375.00 or a total of $9,000.00 in an effort to obtain title to this piece of property.
It being the opinion of the Oil Dili that these payments were necessary as in the event
the street is closed by the City these property owners would have an interest in the
abandoned property. The closing of this street has been discussed with the utility
companies and they are agreeable to working easements, The estimated cost to move
City power lines is as follows:
• Total cost $12,303.28
Credit for Salvage 4,217.14
Credit Improvements to electrical circuit 1,800.00
distribution
Net Cost 62286,14
It was unanimously agreed by the City Commission to secure an appraised value of this
piece of land and defer action on Mr. Davis# request until a later date,

for Right -of -Way f or Avenue Q Northeast. This property being owned by the Roman
Catholic Diocese of Amarillo. Mr. Casey Charness appeared before the City Commission

and McClesky, attorneys for B. E. Needles, said letter indicating the condition under

Lubbock City Commission
City lull '
Lubbock, Texas
Attention; Office of City Engineer
Gentlemen;
July 29, 1954
In compliance with a previous request of recent date frm the City Engineer's office,
we, in the capacity of authorized attorneys f or Mr. B. E. Needles, of Lubbock, Texas,
submit this letter on his behalf, setting forth certain facts and conditions regarding
the dedication of a certain tract of land for a public street within the City of
Lubbock.
Our client holds the legal title to the following described real property and improve-
ments thereon, all situated and lying in Lubbock County, Texas, to -wits
All of Blocks 86, 94, and all of Block No. 68 lying South of the Fort
Worth & Denver Railway right-of-way in Wheelock's Second Addition to
the City of Lubbock,, as previously dedicated and shown on a plat of said
Addition recorded in Volume 26, page 48, Deed Records of Lubbock
County, Texas, this Addit ion being a subdivision out of Survey 5, Block
B. Lubbock County, Texas;
Also, the streets lying adjacent to and abutting the above described real
estate.
Mr. Needles will dedicate, subject to the conditions precedent and subsequent hereinafter
set forth, the following portions of the land lying adjacent to and abutting the above
described real property for public use as a street so long as the same is used by the
public as a public street, to -wits
Being 1385 feet East and 337 feet North of the Southwest corner of Section 5,
Block B, Lubbock Bounty, Texas, a 3/411 iron pipe for the place of beginning
of this tract, which is located at the center of the intersection of 33rd
Street and Dn Avenue;
THENCE North along the center line cfElm Avenue, previously dedicated in Wheelock's
Second Addition to the Town of Lubbock as East Avenue E, to a point in the
South right-of-way line of the Fort Worth & Denver Railway Company right-
of-way;
TIMCE Southeasterly aloe$ the South right-of-way line of the said Fort
Worth & Denver Railway Company right-of-way to the East line of said Elm
Avenue;
THENCE South along the West line of Blocks 68, 87, and 94 of the Wheelock
Second Addition as previously dedicated and shown of record in Volume 26,
page 48, Deed Records of Lubbock County, Texas, which line is 25 feet East
of and parallel to the center line of the said Elm Avenue, to a point which
is the Southwest corner of said Block 94 of said Wheelock Second Addition to
the Town of Lubbock, and which point is 60 feet North and 1410 feet East of
the Southwest corner of Section 5, Block B, Lubbock County, Texas;
THENCE West 25 feet to a point;
THENCE North 277 feet parallel to the West boundary line of said Block 943,
to the said 3/4" iron pipe for the place of beginning.
As a specified condition precedent to any dedication by our client, satisfactory proof
must be made to us showing that all owners of land lying immediately West of the above
described land belonging to Mr. B. E. Needles and the proposed dedicated strip, will
dedicate a like strip a j6inin g, abutting and adjacent to the herein proposed dedicated
strip. In other words, the essence of Mr. Needles willingness to dedicate said strip
is the benefit to be derived from having a full and complete city street 50 feet in width
bounding his property on the West.
__j
At the present time there are certain improvements situated in the Northwest corner
of Block 94, which improvements extend out a distance of approximately 4 feet into
the proposed right-of-way. It is hereby agreed that this improvement, to -wit, a fracas
barn or outbuilding, may be moved as a whole and properly relocated at a position off
of the right-of-way onto said B. E. Needless property, or the port ion of said barn
or outbuilding extending aver the right-of-way may be severed so as to leave the barn
at its present location, but lying completely within the perimeter of Block 94, provid-
ed that after severance of that portion necessary to accomplish this last mentioned
act, the barn walls so removed must be replaced in a good workmanlike manner, leaving
the building in as good or better condition as at the time the alteration was commenced.
It is agreeable that either of the two alternate methods here stated be used, with the
option or choice lying with the City of Lubbock, provided that whichever method is
finally selected, the action taken }!ursuant thereto will be at the sole expense of the
City of Lubbock and at no expense whatsoever to Mr. B. E. Needles, his heirs, legal
representatives or assigns.
It is also agreable that whichever operation is selected shall be accomplished at such
time and in such manner as the City of Lubbock may see fit, subject to the herein -
above conditions, and provided that a written notice, setting forth the time the
project is to be undertaken and the methods to be used, as well as the expected date
of completion, be given to Mr. Needles thirty days prior to the date of the commence-
ment of any operations with regard thereto. This period of notice is essential in
order that our client can make the necessary and proper arrangements with any tenant
now or then in possession. The notice herein contemplated should be dispatched to
our offices for the attention of Mr. B. E. Needles.
If, after a review of the facts and conditions hereinabove set out, it is the opinion
of the City that this letter properly states the agreement between Mr. Needles and the
said City of Lubbock with regard to the matter herein contained, we request that the
enclosed copy be signed by a City official, authorized to bind the said City, and re-
turned to our office.
Yours very truly

APPROVED for the City of Lubbock,
Lubbock County, Texas:
54-13-127-217 Motion by Commissioner Thomas, seconded by Commissioner Carpenter, motion carried,
Mayor Tripp and Commissioners Baker, Carpenter, Forrest and Thomas voting Yea, none
voting Nay, to authorize refund to 0. B. Ratliff, developer of Almeida Subdivision,
in theamount of $823.82 from the City's special fund (Escrow Account), said amount
having been received by the City from 0. B. Ratliff, developer of Almeida Subdivision,
for the paving of an access road abutting Almedia Subdivision on the East side of
i Avenue Q at 49th Street, in accordance with the then existing paving requirements for
the recording of said subdivision. Said refund is hereby authorized to be made upon
recommendation of the City Planning Commission as set out in their minutes of August 5,
1954. Since the iscording of the J,lmeida Subdivision, the City Commission has amended
the Subdivision regulations Ordinance to make it possible to waive the paving require-
ments for Subdivisions where the tract of land being subdivided was under separate
ownership prior to January 22, 1953, and which abuts less than a block of -street and/or
is less than three acres in area. Almeida Subdivision is slightly over one (1) acre
in size and abuts less than one (1) block and was under separate ownership prior to
Januar9 22, 1953, The refund was authorized for the above reasons, also because the
portion of said access road which was dedicated with said plat is less than one (1)
block and does not connect with existing streets, making it awkward to paving at this
time.
