Mr. W. B. Holmes, City cE Lubbock City Hall Lubbock, Texas Dear Mr. Holmes: City Engineer May 10, 1954 In the general plan to handle our electric load in Lubbock, we would like to install a distribution substation at the intersection of 17th Street and Avenue P. You will recall that at this point Avenue P is of alley width. The actual site which we have in mind is in the rear of the residence at 1611 - 17th Street. The type of installation which we plan to mais will be completely enclosed similar to the equipment which we have in service at 22nd Street and Quaker Avenue and near the Anderson Young Electric Company on Auburn Street. It would be appreciated ifyou wpuld discuss the above project with the City Commission. Yours very truly, SOUTHWESTERN PUBLIC SERVICE COMPANY . /s/ George Bunton George Bunton GB/fa 'Division Superintendent After consideration of the above request, motion was made by Commissioner Carpenter, second- ed by Commissioner Thomas, motion carried, Mayor Pro-tem Baker and Commissioners Carpenter, and Thomas voting Yea, none voting Nay, to grant the request of Southwestern Public Service' r Company and authorize distribution substation to be located at 17th Street and Avenue "P". The details of this trans- action are as follows: From S. C. McCarty's letter of 2-5-54., transmitting $2,033.57 back to the City of Lubbock, we have a recap as follows: . Deposit refunded City of Lubbock $19,300,00 17,266.43 $ 2,033.57 From checking the final quantities and plan, we find that 12,085.8 linear feet of concrete curb and gutter were constructed inside the City Limits west of Quaker - from which we obtain the. following: 1) Actual cost of curb and gutter per linear foot : 17 266. = $1.42865 129085.8 This rate was applied against the abutting property footages as shown on the attached roll to obtain the final cost to each property owner and the corresponding amounts to be returned to each from the City. The final cost distribution is as follows: Final total cost of curb and gutter $17,226.43 Less final total P.O, cost 162234.89 Final City of Lubbock cost $ 991.54 The above distribution holds if all property owners pay the amounts due for their respective footages of curb and gutter. L•. Couch, Auditor City of Lubbock Lubbock, -Texas ' Dear Mr. -Couch; As you know, we have been using the labor camp for the past several years and our office has been operating a farm labor office, about seven months out of each year, at the camp. Recently, we suggested and you agreed to allow us to operate an office at the camp on a year-round basis. This -operation -has been successful and Mr. Henry LeBlanc from our State office has recently been in the Lubbock area and approved our operation. He thinks the premises - and quarters are ideal for a farm labor office, this camp being in - the center - of the Latin-American area is definitely a good gathering point for workers and at the same time it is ideal for farmers, dui -to the fact that parking facilities are unlimited. Mr. LeBlanc has suggested tt we -place a sign on top of the building, running down the center ridge, this sign. to, a out two feet high and twenty feet Ibng„ the official name of the labor camp to appear on this sign on both sides. It was further suggested that our agency would be willing -to improve the quarters so that it would be attractive to the farmers who use the labor camp. We have found that during the period from February to June 1, two rooms are needed by our . agency --one for office -operations which we normally occupy - the other as a waiting room for crews who are in the area, seeking referral to other States. (During the period no farm work is available, locally and during this period approximately 800 workers have gone to other -States with the expectation of returning for cotton chopping in this area.) Our - agency wishes to seal off two rooms to be used as outlined above and to do the painting and work.to make the quarters attractive. The sign mentioned above, which may agency has - indicated they are willing to place, wi11 cost approximately $115.00 installed. The labor, material. and paint required for sealing the two rooms will be approximately $350.00. My superiors suggested that if the proposal is accepted by the city for the expected expenditures, we should normally be entitled to an agreement of tenure, this agreement to be renewed at intervals,& Yours very truly, /s/ B. T. O'Connell B. T. O'Connell BTO/jv After consideration of the requests set out in the above letter, motion was made by Commissioner Carpenter, seconded by Commissioner Thomas, motion carried, Mayor Pro-tem Baker and Commissioners -Carpenter -and Thomas voting YeA, none toting Nay, to authorize the Mayor to enter into an agreement between the City of Lubbock and the Texas Employment Commission, said agreement to authorize the placing of a sign at the Labor Camp and the . Sealing off of two rooms to be used by the Texas Employment Commission in connection with Itinerant Labor Labor in this area. The $1150 for installation of this sign, as well as the approximately $350 for cost of this alteration, to be paid by the Texas Employment . Commission. i4-12-582-1015 There was a discussion by the City Commission of allowing penny weighifig machines to be located on the sidewalk -and extending more than 14 inches from the wall of the building, in violation of City Ordinance requiring that no object extend more than 14 inches onto the sidewalk from the wall of a building) and it was unanimously agreed by the City Commission that the Ordinance requiring objects to not extend more than 14 inches onto the sidewalk -from the wall of a building to be enforced. >4-12-582-1016 There was discussion of -the City of ]Lubbock carrying Workmen's Compensation Insuranoe to cover City Employees. Mayor Tripp and Commissioner Baker were present for this discussion. Mr. Marion Sanford appeared before the City Commission representing the Lubbock Insurance Exchange and presented the following proposal: May 18, 1954 City of Lubbock Lubbock, Texas Gentlemen: On May. 33, 1954, at 12:19 P.M., the City Commission authorized that purchase of Workmen's compensation insurance for all city employees except those in the police and fire depart- ments. The coverage was bound in the Traveler's Indemnity Company by the Sanford Agency. The insurance is being handled through the Public Placement Committee of the Lubbock Insurance Exchange and commission will be turned in to the Exchange and distribution on the. usual basis. Workmen's Compensation is for statutory limits and amounts as outlined by the Workmen's Compensation laws of the State of Texas. Since the employees of municipalities are normally exempt from coverage under this Act, we are advising the Industrial Accident Board and the State Board of Insurance Commissions that the City of Lubbock has elected to purchase voluntary compensation for all employees, except those of the fire and police departments. This policy will then pay hospital drug and medical bills of those employees covered by the policy for injuries resulting from their employment. Beginning with the eighth day, it will also indemnify injured employees on a weekly basis for 60% of their regular weekly wages, but not more, than $25.00 per week. The limit of time for which compensation benefits are payable varies, dependent upon the seriousness of the injury. For permanent and total disability, a maximum of 401 weeks may be paid. Of course, this coverage applies only to injuries sustained in the course of employment and not to illnesses of any kind. If any physician should send bills directly to the City, they should be forwarded immediat- ely to Traveler's Claim Department in the Lubbock National Bank Building. When an injured employee desires additional information regarding his case, you may direct him to Traveler's Claim Department. In the event of an accident to an employee insured under the policy, it will be necessary that an accident report be completed promptly. You will be furnished with a supply of foram, the first of which is called "Employer's First Report of Injury." If an employee is off for a period of time, compensable under the policy, supplemental forms are to be completed. Arrangements are being made for sending these accident reports directly to the Traveler's branch office here. Than their office will pay the doctor bills and arrange for the paying of compensation to those employees entitled to it, without further effort on your part. The policy will be written on a quarterly reporting basis and at the end of each quarter, a report is to be made to the Traveler's Indemnity Company for the payroll for employees of all departments covered.. The City will then be billed for premium earned during that quarter, which will be in addition to the deposit premium put up at the beginning of the policy period. At the end of the policy term, an•audit will be made and the premiums paid in quarterly plus the deposit will be adjusted in accordance with the audit. If you have any questions regarding this policy, please call us at any time. /bm. Dear Sirs: The above property has been condemned for building purposes since I came into possession of it, because it is below the high water mark.. Because of this I cannot use this property to any advantage whatsoever. There is $1645.79 due in paving payable in three years, first payment due August, 1953. I do not feel that I can in any way pay for the paving under these circumstances. I would like to sell this property to the city since it is ideally located for inclusion in K. N. Clapp Park. My price is $500 per lot or $3500 less stated paving, 1953 taxes in the amount of $88, and transfer costs. I would reserve the right to remove the three small buildings now standing on the property. Lee Quillen, through his Attorney, Durwood D. Mahon, said proposal dated May b, 1954, and being in the amount of $3500 covering the Right-of-way needed for a 25 foot easement for construction of the West Lubbock County Water Supply Line across Mr. Quillen's property located on the South half of Section 13, Block A, Lubbock County, Texas, May b, 1954 Honorable Murrell Tripp, Mayor Lennis Baker, Commissioner Hurley Carpenter, Commissioner S. S. Forrest, Commissioner Lucian Thomas, Commissioner City of Lubbock Lubbock, Texas Gentlemen: I represent Mr. J. Lee Qalen in connection with your negotiations for a pump or booster station site and easement for water line across his property in the S/2 of Section 13, Block A, Lubbock County, Texas. On investigation, I have learned that the Railroad Company will charge $2184.00 more for trackage by reason of having to cross the water line right-of-way than they would charge if the right-of-way were not taken across this property. It will become apparent to anyone examining the property and the location thereof that this item necessarily must be taken into consideration. As a matter of compromise, Mr. Quillen will be willing to accept $3500.00 in payment for the pump station site and right-of-way across the S/2 of Section 13, as outlined in your previous correspondence and conversation with Mr. Quillen. Mr. Quillen desires to reserve the minerals under the pump station site, of course this will not love him the right to drill for oil on the pump station site. He desires to prohibit the drilling of water well on the pump station site and he also desires to re- serve the right to cross the right-of-way with tracks to provide his land with trackage from the railroad. The farm is rented to Mr. W. E. Medlock and Mr. Quillen desires that the City secure his permission and have an understanding withham direct. I believe that this offer is reasonable and based upon the elements required to be taken into consideration in determining the value of the property taken for public purposes. I would appreciate it if you would advise me of your action on this proposal as soon as convenient. DDM:MR Yours very truly, /s/ D. D. Mahon D. D. mAHON After consideration of Mr. Quillen's proposal, motion was made by Commission Carpenter, seconded by Commissioner Forrest, motion carried, Mayor Tripp and Commissioners Baker, Carpenter, Forrest and Thomas voting Yea, none voting Nay, to authorize an offer to be mado to Mr. Qullen in the amount of $1498,34 for Right -of -Way plus $1092 for trackage rights mak- ing a total consideration of $2500,34 for full and final payment in this regard. >4-12-592-1027 Authority was granted on March 25, 1954, to obtain an appraisal of a triangular parcel of land located at Avenue L and 19th Street containing 2380 square feet needed to reshape the intersection for easy flow of traffic on Avenue L across 19th Street. Appraisal was obtained on April 3rd, however, this appraisal did not take into consideration all factors. With the following appraisal as basis of determing values, further consideration of the item by the Commission is in order. Present day value of the 2380 sq. ft. $15,470.00 Present day value of remaining land (Based on lot with $24030.00 80 ft. frontage on 19th and 181 ft. deep) Value of remaining land after Avenue L widening as proposed $30,000.00 After consideration of the information as set out above in regard to obtaining Right-of-way for reshaping the intersection at the Southwest corner of Avenue L and 19th Street, motion was made by Commissioner Carpenter, seconded by Commissioner Thomas, motion carried; Mayor Tripp and Commissioners Baker, Carpenter, Forrest and Thomas voting Yea, none voting Nay, to authorize an offer to be made to Mrs. W.
