COUNTY OF LUBBOCK CITY OF LUBBOCK Date-, ok:WLS BOARD OF CITY DEVELOPMENT TEXAS A. & M. RESEARCH FOUNDATION ,-12-483-867 Request was received from 0. G. Bates for the City to close the West 7.5 feet of the North .50 feet of the North -South alley located just East of Avenue "Q" and South of 35th Street in exchange for a dedication, 15 feet in width and 50 feet in length along the East side of Avenue "Q" and a 5-foot utility easement through the alley to be closed. After considerar tion of Mr. Bate's request, motion was made by Commissioner Baker, seconded by Commissioner Thomas, motion carried, Mayor Tripp and Commissioners Baker, Carpenter, Forrest and Thomas voting Yea, none voting Nay, to authorize an Ordinance to be prepared for consideration by the City Commission in their next regular meeting, to comply with Mr. Bates request. It was brought to the City Commission's attention, by W. B. Holmes, Director of Public Works, that Mr. Jeff Hooper residing in the Sunny Hill Addition, along with other residences of this area, are requesting the City to extend Sanitary Sewer Main to serve Block 23 and 24 of the Sunny Hill Addition. Mr. Hooper stated that 5 Lot Owners in Block 24, will pay the Pro-rata Charge requested by the City for extension of Sanitary Sewer Main. Twelve of the 16 Lots in Block 23 are involved in an estate, that is in legal action, and the owner of the remaining 4 Lots is financially unable to pay his pro -rats on all 4 Lots, but he has agreed to connect singly after extension of the Sewer Main has been made. This would make a shortage of three residences to meet the City regulations under the Pro-rata Charge Ordi- nance. The estimated cost of the extension to the City is $1,880 and would be required to be paid by the City, from Sanitary Sewer Pro-rata Funds. After discussion by the Commission it was unanimously agreed to adhere to the City's Policy for extension of Sanitary Sewer Main as set out by the City Ordinances. This request for Sewer was made because septic tanks in this area are giving trouble: 54-12-483-865 Mr. W. B. Holmes, Director of Public Works, brought to the attention of the City Commission the request of 0. K. Montgomery, whereupon Mr. Montgomery states that he has contracted the residents of Lot One through Twenty -Eight, Indiana Acres, and has found that there are five residences in this area who will pay the Pro-rata Charge to get Sanitary Sewer Mains extend- ed to Lot One through Twenty -Eight, Indian Acres. It was stated to the Commission that there no residences on the South half of this Block. It is found that to meet the requirements of the City Ordinances regarding Sanitary Sewer Main Extensions eight connections would be required who would pay their Pro-rata Charge for Sanitary Sewer Extensions, and only five of the residences in the area have agreed to pay the Pro-rata Charge. The estimated cost to the City to extend the Sewer Mains to this property at this time is $1,400.00. Therefore the City Commission directed the Director of Public Works to advise the residents in this area that the Sewer.Mains cannot be extended unless the City Ordinances in regard to Sanitary Sewer Extensions are complied with and payment of Pro-fata Charge made. 5L-12-483.-870 Motion by Commissioner Carpenter, seconded by Commissioner Forrest, motion carried, Mayor Tripp and Commissioners Baker, Carpenter, Forrest and Thomas voting Yea, none voting Nay, to authorize extension of a 6-inch water main in Joliet Avenue from 21st Street to 22nd Place in order to relieve low pressure in this area. Highway No. 87 City of Lubbock City Hall Lubbock, Texas Attention: Mr. Wm. B. Holmes City Engineer Gentlemen: Lubbock, Texas March 19, 1954 Enclosed are two prints of a layout of the subject project upon which are shown the proposed roadways and their connections. Generally the design provides for the project to operate as a freeway between the follow- ing limit s : From beginning of project to Erskine Street From Fordham Street to Jarvis Street It is proposed to place curbs or curbs and gutter (whichever is applicable) on both sides of the dividing strips (shown in green) between the various paved roadways (shown in red). One exception is that that t wo North connections to Avenue P will not be provided with curb and gutters. The 32 feet width on the frontage roads is based on a curb and gutter being placed on the outside edge which is considered a responsibility of the property owners. If this curb and gutter is not provided, it is proposed to reduce the width to 24 feet. This plan does not provide for restriction of access of abutting property on the East side of the project between First Street and Baylor Street. In order to maintain true free- way operation, it will be necessary to provide right-of-way for a frontage road on this section or to secure surrender of access rights from the owners. No frontage road is provided on the West side of the project between Erskine Street and the alley North due to right-of-way difficulties; however, for future development, it will be necessary to set up a building line to the near corner of the machine shop now on the pro- perty which is 90 feet from the project center line. It is requested that the City Commission take such formal action as is necessary to restrict the use of the cross streets and the regulatiog6f traffic as outlines on the accompanying layout. Yours very truly, /s/ S. G. McCarty S. G. McCarty FBO/abm District Engineer Encl.- 2 Prints The Highway Department's letter of March 19, 1954, as set out above.. was discussed by the City Commission, and motion was made by Commissioner Carpenter, seconded by Commissioner Forrest, motion carried, Mayor Tripp and Commissioners Baker, Carpenter, Forrest and Thomas voting Yea, none voting Nay, directed the Director of Public Works to proceed with the preparation of the necessary documents to accomplish the assessment of the abutting property for the cost of construction standard concrete curb and gutter along the property side of the frontage road. The City Commission also agreed to take aUch action as is necessary to restrict the use of the cross streets and prevent access to the proposed Freeway at the locations indicated on the sketch accompanying the Highway Departments letter. Said sketch beingof record at Page 492, Minute Book 12. The City Commission, by the above motion, also instructed Director of Public Works to request the State Highway Department t s District Engineer, in writing,, to review the requirements for the City to establish a Building restriction line on the West side of the project between Erskine Street and the alley North of Erskine Street as indicated on sketch accompanying the Department's letter, it being their observation that this street shodd not empty into the intersection of the proposed Freeway and Erskine Street because of the complications involved in handling this traffic, and for the further reason that due to the circumstances involving the acqusition of this property it would be very expensive, and further that the City of Lubbock would not be re- quired, as a result of passage of recent State Laws, to grant this property owner access to the proposed Freeway since this proposed Freeway is not in the location of an existing 54-12-49 -876There was discussion of the proposal of 0.
