;,,L}2-318-624 This being the date set for hearing in regard to paving various and sundry residential city
streets and one alley, the contract for said paving having been let to Kerr and Middleton
under General Work Order Number 835 of the City of Lubbock, Texas, said hearing was held
Approximately fifty (50) persons appeared for the hearing and the following objections were
made to the proposed paving. -
Paving on 37th Street, from Avenue "A" to Avenue "E" was protested by Mr. W. A. Keelin,
Mr. R. J. Maloney and Mr. W. D. Dye, by reason of the fact that their houses front on 38th
Street and the property extends thru to 37th Street and they would prefer- to spend this
money for paving the street in front of their residences instead of the vacant lots to the
North of their property.
Mr. H. F. Sidwell appeared protesting the paving of 37th Street from Louisville Avenue
to Knoxville Avenue. Mr. R. A. Sowder, representing Mr. M. 0. Owens, protested the
paving of Avenue L from 34th Street to 30th Street.
Mrs. Alma Andrews, nee Alma Lewellen, appeared in protest of the paving on 45th Street
from Avenue "L" to Avenue "H". Mrs. J. E. Bain appeared in protest of the paving of
Utica Avenue from 19th Street to 15th Street.
Protest was also received in letter form from 0. B. Ratliff, protesting paving of Utica
Avenue from 15th Street to 19th Street, Mrs. Susie Poarch Ogle protested the paving of
Salem Avenue from 34th Street to 33rd Street.
Letter of protest, dated January 15, 1954, was received from Mrs. Emilie Nolte, protest-
ing the paving of 45th Street from Avenue 11H11 to Avenue "L".
All of the above protests were fully considered.by the City Commission and it was found
that none of the above mentioned property owners protesting the paving of the streets con-
tained in this paving project stated that the assessments were in excess of the benefits
which would be derived from the street paving, therefore,.all of the above protests and
objections were overruled.
Mr. James Robinson appeared before the City Commission and protested the alley paving
abutting the East one-half of Lots 10, 9 and 8. Block 10, Overton Addition to the City of
Lubbock. It was found by the City Commission that the paving of the alley abutting this
property was instituted by commercial property owners on Avenue "Q" to handle heavy com-
mercial traffic in the alley, and Mr. Robinson's property was found to be residential.
Therefore it was ruled by the City Commission that such assessment contemplated by this
ordinance against East one-half of Lots 10, 9 and 8, Block 10, Overton Addition, would not
especially benefit said, Lots as abutting property, therefore, no assessment shall be made
against said East one-half of Lots 10, 9 and 8, Block 10, Overton Addition to the City of
Lubbock, Texas, and the City Engineer is hereby directed to correct his assessment roll
consistent with this finding.

nance No. 1522 was passed on first reading.

54-12-322.63 8 CITY OF LUBBOCK
MEMORANDUM, Inter Office
TO: CITY MANAGER DATE: January 27, 1954
FROM: FINANCE OFFICER
SUBJECT: RECO14IENDATIONS AND COMMENTS ON 1952-53 AUDIT REPORT
The following report is presented to summarize for you the most pertiment comments
made by Mr. W. W. Condray in his audit report on the City's operations and the condition
of the books and records for the fiscal year 1952-53• He gave impetus to four recommenda-
tions which he considered to be the first needs of the City and stressed that they be given
consideration. Listed below are these comments quoted from Mr. Condray's report together
with a brief recommendation by the City Auditor:
1. Comments "There is a considerable question as to whether the City's control over
its fixed assets is sufficient to insure the proper retirement of all assets that are con-
sumed, lost, or otherwise disposed of."
Recommendation: A good system of fixed asset control is needed. Mr. Cassel and Mr.
Condray both have given priority to the consideration of such a system. Both agree it will
take extra help in the accounting department, During a trip to Dallas two years ago, that
City's system was studied with the ideal of installing a system here at that time, however,
it was deceided that the cost of installing and maintaining such a system would not result
in saving the City money by preventing losses of City property. Essentially the same ob-
servation can be made now, Dallas and Austin have the only good fixedfWbis that I know
while Amarillo, Wichita Falls, Abilene, Fort Worth, etc. have about the same inadequate -
control that we have.
2. Comment: "In spite of the fact that additional personnel and funds may be required
it is believed that greater control over the City's stocks of materials and supplies is
badly needed. --It was found that unauthorized personnel do have access to the City's ware-
house and outside storage areas; hence materials may be removed from stores or returned
thereto without knowledge of the personnel who should be held accountable for the stocks and
responsible for the proper original records of stores transactions.
Better housekeeping is in order --Additional fenced in space for outside storage at -the
general warehouse appears to be needed.
Systematic counts of various stores items, for comparision and reconcilat ion with the
balances reflected by the stores records, should be made at regulate periods throughout the
year, by personnel from the office of the City Auditor.
54-12-323-639
Recommendation: Elemination of the above described warehouse in consistencies is
recommended bytrevising warehouse procedures, proper ut-lization of personnel, and by adding
such additional personnel as may be considered necessary. The dolia r•value of stores lost
and stolen is considered insignificant, however, until thIlabove defects are cleared,
opportunity exists for serious shortage which is limited only by the relative inability of
stores on hand to be converted to private use.
3. Comment: "Another prime need of the (accounting) office is in the field of inter-
nal dontro l and auditing. The present personnel seen to be fully occupied with day -today
and month -to -month routine of their duties. --There is a need, in our opinion, for additional,
competent, experienced personnel, without routine duties as to the keeping of records, hand-
ling of money, etc., but with the duty of tebting and reviewing the work of other employees
where financial records are kept and where funds are received."
Recommendation: Such a procedure should be initiated subject to limited financies.
The full time service of one accountant could be utilized on this job alone to conform to
Mr . Condray's recommendations, who considered this one of the first needs of the City.
4. Comment: "The City doegAot account for depreciation of fixed assets, except
through the medium of charging to expense the cost of equipment retired. --It is believed
that this method of reflecting depreciation e.Npense results in an inadequate provision for
depreciation."
Recommendation: Changing to a conventional method of computing depreciation would re-
sult in substantially larger "expense" charges and a resulting decrease in the "net income$'
on the City's Operating Statements. A smaller "net income" figure would tend to have an
adverse effect on the City's financial standing, particularly with regard to the sale of
bonds. Further, larger depreciation reserves would decrease the value of Assets on balance
sheet statements. Current appraisal values of City Assets are sometimes substituted in special
reports as book values over a period of years do not present a true picture of current worth.

right-of-way for a water line easement in the event the property owners did not accept an
offer of $50.00 made to said property owners of a 22 1/2 ft. strip of land located in

Honorable Murrell R. Tripp
Mayor, City of Lubbock
Lubbock, Texas
Re: Southeast Lubbock Development Board
Dear Murrell:
With reference to our recent conversAtion concerning the Southeast Lubbock Development Board
-nd its progress, we seem to be stalled upon a high center.
gout April 16, 1953s we submitted to the City Commission our recommendations with reference
:) how the sale of these lots should be handled and the maximum prices that should be charg-
i therefor. About that time we had arranged to have a corporation chartered to take title
D this property and suggested that the title to the land be conveyed to the corporation by
1e city in order that contracts with prospective buyers and subsequently, conveyance to
zch buyers could be made by the corporation without the necessity of each sale being handled
1 detail by the City Commission.
It is my understanding that, subsequently, the City Attorney ruled that the property could not
be conveyed to the corporation and it is also my understanding that the city commission at
first set higher prices upon the lots than those we recommended, but later lowered the price.
In any event the effect of all of this was to leave the matter in such shape that, for all
practical purpose, any prospective -,buyer would have to negotiate with the city. Whether any
lots have ever been sold, I have never been advised.
It occurs to me that the property can be conveyed to the corporation. My suggestion would
be that the city convey the property to the corporation and that the corporation give its
note to the city and that no lien be retained against the property by the city, but that
since the corporation is, in effect, another arm of the city, the note be an ordinary pro-
missory note of the corporation to the city, payable from the proceeds of the sale of the
property after the deduction of such expenses as abstracts, contracts, revenue stamps, and
any other expenses sustained in connection with the sale of the lots. The corporation is
a non-profit corporation and has no purpose except to assist in the sale of these lots.
While I have not briefed the matter extensively, I know of no provision of the charter of
the City of Lubbock or rule of law, that would prevent the matter from being handled in this
manner.
Among other recommendations included in those made by the board on April lb, 1953, was one to
the effect that the city commission designate one certain employee of the city to handle the
details of contracts, collections, and other matters of that kind. So far as I know this
was never done.
Whether the lots can be sold for the price now placed upon them by the city, I do not know.
It may be that the prices shouh be reduced further if this can be done without the city
sustaining a loss in the sale of the property.
It is my further personal opinion that the Southeast Lubbock Development Board should make
some effort to assist in procuring a source frog which FHA funds can be made available for
loans to purchasers of this property in order for them to construct dwellings thereon. This
presupposes that the property will be approved for FHA loans. As we all know, funds for
FHA loans have not been as readily available during the last year or two as they formerly
were. No doubt, prospective buyers will need some assistance in finding a company which will
make them loans upon this property.
In any event, speaking for myself and I am sure for the balance of the board, we will be happy
to have any further suggestions from the city commission as to how thus matter can be pushed
along and these lots be sold and improved.
Sincerely yours,
KLETT, BEAN & EVANS
