PETITIO" OPPOSI1TG SHOPPING CENTER
REQUESTED IN CASE NO. 541-A
TO THE HONORABLE ZONE%TG CONI:ISSTON
of the City of Lubbock, Texas:
We, the undersigned property owners in the vicinity of the area bounded by 50th Street on the North,
Gary Avenue on the jest, 54th Street on the South and Elgin Avenue on the East, respectfully express
our opposition to a change of the zoning of such area from a residence zone to a business zone.
This opposition is based on the fact that the request seems "excessive" in area, being almost forty
acres, and the Nortion lying South of 52nd Street "cuts deep" into our residential zone, Other points
of significant importance are:
A. Creation of traffic hazards and congestion in the area of 50th Street, a,id interfering with
our children's access to Iionterey High School.
B. Resulting decline in values of our properties in the area since it cuts deep into our
residential section, increasing the exposure of our property to commerce.
Respectfully submitted,

-55-14-381-859The following persons, who live in the J. C. Davis Happy Homes Addition in South Lubbock, appeared I;
before the City Commission in regard to paving and drainage of a part of this area: W. T. Cherry,
1507 40th St; Lee Rice, 1513 40th St; M. A. Fullerton, 1313 39th St; Sanford Lee, 15L1 39th St,;
H. F. Whitson, 1802 41st St; G. C. Wade, 1515 40th St; and others. It was stated to the group that:
n
"Since the State Highway Department lowered the paving and dipped 36t;i Street across Avenue H, it
has.been found possible to provide overland drainage for this area by lowering 40th from Avenue P to
Avenue N, Avenue N from 40th to 39th, and 39th Street from Avenue N to Avenue L. A culvert under the j
Fort Worth and Denver tracks will be necessary and further lowering of streets East of the tracks will
also be required. The grades of all streets in the area between 39th and 41st and between Avenue P and
Avenue L are of minimum slope, and in order for this plan to work all streets and/or avenues will need i
curb and gutter constructed to an accurate flow line.
The City will pay for the necessary lowering of utilities and sidewalks and will try to get the
right-of-way East of your property across which this water drains, including the culvert under the
Fort Worth and Denver Railroad tracks, provided all of the people in your area are willing to
participate the customary amount in the pavin cost adjacent to their property. The exact cost of
paving will be determined after a contract has been awarded but according to current prices, it would
cost each property owner approximately y212.50 for the paving in front of a 60 foot lot, and r420.00
along the side of a corner lot."
It was stated to the City Commission by City Engineer that to proceed with tLis plan as outlined above
it would be necessary to acquire right-of-way across the ;ilamis Orphan's Home land and the Fort Worth
and Denver Railroad Co. at 39th and Avenue L.
After a lengthly discussion the City Commission authorized the City Engineering Department to proceed
with the acquisition of right-of-way in order to carry out the paving and drainage prorrram as outlined
above and to include the paving and drainage of the above mentioned in the first 1956 Street paving
program.

Re: J. E. Birdwell
Water under Section No. 68 and the East 258.31 Acres of Section No. 67, all in 'flock A,
Melvin Blum and Blum Surve;, , Baile, r County, Texas
Gentlemen:
On June 24, 1954, the City of Lubbock, through Letnnis Baker, Mayor Pro—tem, accepted a written
assignment by L. A. Purtell, assigning to J. E. Birdwell the sum of 49,096.10, being the unpaid
total consideration for water rights under the above described lands in Bailey County, Texas,
which said consideration was to be held until a release of an existing deed of trust lien in
favor of Kansas City Life Insurance Company should be fully released, of record. As a paxt of
said agreement made in connection with such assignment and acceptance by the City of Lubbock, said
J. E. Birdwell agreed to obtain a full release and record it in Bailey County, Texas, not later than
January 10, 1956.
J. E. Birdwell requests the City of Lubbock to grant him an extension of one year, or until on or
before January 10, 1957, to obtain the release of said lien, and agrees that the City of Lubbock may
retain said sum of $9,096.10, the full consideration for such water rights, for such period of time,
or until such release i-s obtained and filed of record.
The reason for making this request is that it would work an extreme hardship upon J. E. Birdwell to
be required to obtain a release of the lien at this time, as he would be required to pay the --indebted-
ness not only on this tract of land, but several other tractor. All payments on this deed of trust are
current and will be kept in a current condition.
Respectfully submitted,
