It being hereby unde--stood that in the event the construction of said driveways costs the City more than it would have cost if said driveways had been paved in the year 1955, the BMFP Construction Co. will be required to pay the additional cost due to their materials for construction of the building being located in the driveway areas and making it impossible for this work to be done in the fall of 1955. 55-14-339-708 Motion by Commissioner Carpenter, seconded by Commissioner Thomas, motion carried, Mayor Tripp and Commissioners Baker, Carpenter and Thomas voting Yea, none voting Nay, (Commissioner Forrest -eing absent from the meeting), to approve and authorize change order No. 6 to contract of Kerr and Kiddleton under G.W.O. 835 for construction of 64 blocks of street paving and one block of alley paving. City Commission City of Lubbock Dear Sirs: Lubbock, Texas October 26, 1955 In negotiating with Mr. Scott of the City Engineer's office on the securing of right-of-way on Quaker Avenue diich involves property that I claim as.a homestead, I am listing some facts and figures for your consideration. First, as you know, a proposal has been made by which my garage can be detached and rebuilt at the rear of the house which will give required right-of-way without moving any part of the house but will be an exception by being closer than the required five feet from property line. This will leave my property on a forty-five foot lot which I say and my loan company says will devalue the property much more than your apprais rs have placed on it. In arriving at this_1 have considered the resale value when the garage is rebuilt on purchaser securing loan. In checking with several loan companys in the city, I find that it is almost impossible to secure loan on property that is on a forty-five foot lot. This is a fact that I don't think was considered by your appraisers when they placed the value on the property after the garage is removed and rebuilt. Your appraisers placed a value on my property of $14,200. Approximate cost of another lot would be $2500. The job of moving and refinishing would be approximately $2500 being a total of ,;19,200 plus the fact that you will have a forty-five.foot vacant lot that will be of no use to you. To this total will have to be added an additional.$255, as a penalty by the loan company for prepayment of loan. You then would have the job of disposing of the property of which you expect to bake a substantial loss on. After careful consideration of estimates placed on rebuildin; garage and finishing side of house and considerable damages to property. I find that for a sum of 9,550 I will go ahead and live on the property without the house h-ving to be i.,oved. 1 think I am justified in arriving at this figure and I also think it is very close to the amount that would be spent if the house was moved and resold. I am leaving this matter to your decision. Sincerely, /s/ Judd Estep Isl Wanda Lou Estep After consideration of Kr.
