Irwin 1314 40th St June 14, 1955 Lubbock, Texas TO THE CITY C01,111ISSION OF THE CITY OF LUBBOCK: The undersigned citizens of Lubbock, residing on 40th Street and 41st Street, between Avenue and Avenue P, hereby petition the Honorable City Commissioners not to abandon, close and dis- continue 41st street between avenue P, and Q, and not to authorize the building of a lake for any purpose, as has been requested by Leland Payne, for the following reasons. (1). 41st street is already blocked by a railroad track running parallel to Avenue Ni, to the East. Closing 41st street between Avenue P. and Avenue Q, would leave 41st street in this locality only two blocks long, and without direct access from any main thorou:.;l-fare. (2). 41st street as it now exists w`j.s ?en, in use by the public, and Lne prior ded'cation thereof had been acce_-t ed at the time most of us bought our homes. To close the said street would increase the traffic hazard. There have been many accidents at the intersection of 40th and Avenue P, including one fatality. Avenue P is quite narrow, and adding additional traffic thereto would make it more dangerous. Those who would be compelled to use Avenue P. going North toward 34th, will find it nearly -impossible to enter 34th Street and turn West during rush hours. (3). The proposed lake will not be useful to provide additional drainage if the lake is normally full anyway. If it is not kept full, it would serve only as a misquito and insect breeding ground, and would become a catch-all for assorted trash. Mr. and Mrs. W. L. Roark Mrs, Hettie Whitfield Warren G. At that time a group of interested property owners surrounding this property met with the Comni.i.ss:i_on and protested such action. The Planning Commission ruled in favor of the property owners at that time and to-ned down th^ Tech Found-J.tion's application to re -zone this property for business purposes. A few weeks later a rumor circulated that the City Commission would over -rule the decision made by the City Planning Board, at which time a petition requesting that you not over -rule the decision of the Planning Board was presented to the City Commis:ion bearing the signatures of 34 property owners. This petition was dated November 17th, 1954. We have been told by one member of the Tech Board and one member of the Tech Foundation that some kind of a deal was made between the City Officials and the Tech College -- or Tech Foundation - whereby the City v.ould acquire cert-an right-of-way privileges at the intersection of 19th Street and College Avenue -- and in return, the City Commission would, at a later date, zone the IicClellan property for business purposes for Tech College, or Tech Foundation. If these rumors are true, we the taxpa -ing property ownf-:rs want to know these facts: 11hat kind of a deal was made between the CitNr and the College? (Or Tech Foundation) K y wasn't a deed record filed by the County Clerk? The City paid ti2,500.00 plus curbing, sidewalks and four mimosa trees for the land acquired from the Barrier place. l,iby didn't the City burr the land outright from the Tech Foundation? Tecb Found: tion is called a 'Charitable" organization in the Barrier deed record. ;'dhit kind of "Charity" is it that damages peo-ple Is ho_hes? If the LcClellan place now belongs to the State of Texas, why didn't the legislature have a chance to kfio,., about the deal? Doesn't the Legislature have to ap:, rove the sale of state land? If the City and College (or Tech Foundation ) is sued for damage, isn't the_°e a good possibility th it the college iti.11 be dam_:ged more than the property is worth? Is Tech Foundation really helping or harming the College? If the City Officials are the cause of the problam which has arisen, due to their arrangement with the college, is the City then qualified to decide who is ri -ht and who is wrong? When a man causes trouble and is indicted, does he sit on his own jury? If the City Commission over -rules t'.e planning Board's decision in this matter, and disregards the riijits of the p-r•ol.erl-VT own- rz involved, ;,e, the pro.erty owners, think you are betraying the trust and confidence of those of us wino have supported .you in the past. We further believe, that if you decide against us _n this matter, th-_t no property own r in Lubbock is safe from discrimir_--tioft by our City Government. We thank you for your att(-ntion and will sincerely ap; recidte y our most favorable consideration. Respectfully, submitted Isl Chester Elliott /s/ D. C. The above -referred -to property is located on the corner of 19th and College avenues, Lubbock, Texas. It is the unanimous opinion of .he undersit-ned property owners in the blocks ment-ioned above that any cha.nZe in tl,e zoning regulatio-:s from what they were i-hen the Texas 'Tech Foundation or Texas Technological College acquired this property will be "damaging" to our homes and ,e hereby petition and request the C ty Commission of Lubbock, Texas, _not to cl-lange the zoning of this property from a residential zone, as.it was when Texas Tcch Founds-tion or Texas Technological College acouired said property.
