I 55-14-104-219 The following report was given the City Commission. I The City has followed the practice in recent years of charging the Airport Revenue Fund with all operating expenses of the Airport. In addition the Airport Board has effected the reimbursement to the General Fund for the annual debt service requirements on Airport Bonds. However, Capital Outlay items have continued to be financed from General Funds since January, 1951 and a total of $11,961468 has been spent which has not been reimbursed. The Airport Board is now requesting that Airport Revenue Funds in this amount be expended to reimburse the General Fund for all captal expenditures from January, 1951 to date and that these expenditures be met from Airport funds on a current basis hereafter. Consideration was given the report as shown above from the Airport Board and motion was made by Commissioner Forrest, seconded by Commissioner Thomas, motion carried, Mayor Pro -tern Baker and Commissioners Forrest and Thomas voting Yea, none voting Nay, to authorize transfer from the Airport Revenue Funds, $11,961.68 to the General Fund of the City of Lubbock* The City Commission commended the Airport Board for their efficient operation of the Lubbock Municipal Airport. 55-14-104-220 Letter from Rauscher, Pierce & Co. below: WSCHER, PIERCE & CO . ' . I'n'vestmerit Securities .. ....... Lubbock National Bank Building Lubbock, Texas June 63, 1955 Mr. Alfred Couch, Auditor City of Lubbock Lubbock, Texas Dear Mr. Couch: Concernin- our telephone conversation of this date we are pleased to offer to the City of Lubbock the following taxable bonds, subject to prior sale: $5,000 City of Lubbock Waterworks and Sewer Revenue Bonds, 3J% coupon due June 1, 1956, at a price of $102.25 plus accrued interest to date of delivery. I personally believe that while you can get more return from your savings account investment that this particular purchase is attractive for the City. I will appreciate your advising me what decision is reached by the Council at their meeting on Thursday. I have enclosed with this letter a memorandum concerning the Texas Turnpike Revenue Bonds which will be sold on May 14. These bonds will be a primarily investment for interest and sinking funds of the City or for any other surplus funds the City may have on hand which can be put to work. Under the legislative article the bonds are legal investments for Cities and I feel certain that the yield on the bonds will be in the neighborhood of 3% or better. The bonds are readily marketable and will be traded on a day to day basis much as Governments are now and all in all I don't believe there are many better investments for sinking fund purposes. Yours very truly, %s/ Donald V. Otis The City Commission considered the above letter from Raurher, Pierce & Co. and motion was made by Commissioner Thomas, seconded by Commissioner Forrest, motion carried, Mayor Pro-tem Baker and Commissioners Forrest and Thomas voting Yea, none voting Nay, to reject the offer in regard to purchase of the bonds. 55-14-104-221 Bids as follows were received_ for purchase of 12,000 lb - .024" x .35" x 30" Gutter Broom Steel, bid No. 1011. In the regular meeting of June 2, the Planning and -Zoning Commission unanimously recommended to the City Commission that the above zone change request not be granted. The property in question is on the west side of Avenue L, which also contains a railroad track. The persons desiring the zone change asked for the business zoning because they did not feel that property adjacent to a railroad is suitable for residential purposes. However, the Planning Commission has noted the fact that this portion of town is not included in the general indu:trial trend of development and that to grant the requested change would start a trend of possible warehouses and other uses normally associated with railroad right-of-ways in this particular part of town, which abuts on the railraod that i- in Avenue L. 55-14-110-232 Motion by Commissioner Forrest, seconded by Commissioner Thomas, motion carried, Mayor Fro-tem Baker and'Commissioners Forrest and Thomas voting Yea, none voting Nay, to authorize extension of electric distribution lines into the East 15th - 16th Street alley from Magnolia to Teak Avenue. Martin, assured Dear Sir: On March 2, 1955, our assured's 1954 Chevrolet, driven by our assured, was involved in an accident with a 1955 Plymouth, owned by the City of Lubbock and driven by Detec'Live Charles W. Lewis. This accident occurred at the intersection of Avenu-, J and 9th Street in Lubbock, Texas. As a result of this accident our assured's car was damaged to the extent of $223.97 and we have been called on to make payment under our assured's Collision Policy, which provides a $50.00 deductible. Therefore, we have sustained a loss in the amount of $173.97 and our assured has sustained a loss in the amount of R50.00 as a result of this accident. Our investigation of this accident reveals that it was caused by the negligence of the driver of the City owned vehicle and in view of this we h_ve been attempting to obtain reimbursement of our loss from the City of Lubbock. We frist wrote to the Police Department and they replied to our letter advising us to write to the Claims Department, which i,.,e did, We have now received aletter from Mr. W.J. Morgan,, Safety Director, wherein he enclosed a copy of the minutes of the Kzrch 24, 1955 meeting of the City Commission, showing that our assured had placed a clain, against the City for his $50.00 deductible. and further showing that this claim had been rejected. Mr. Morgan advised that in the event we wanted to pursue our claim further that we should write to you about it stating the basis of -.this claim, the address of our assured during the past six months and the amount of the claim in dollars and cents. The basis of the claim and the amount of the claim is stated above and I wish to advise at this time that our assured's address during the past six months has been 1713 21st Street, Lubbock, Texas. Mr. Horgafia.lso asked that we enclose three itemized estimates of the cost to repair our assured's vehicle and in this connection I wish to advise that our Company uses the a,:prai.sal system,.whereby we do not secure competitive estimates from various Garages but instead pay a qualified appraiser for inspecting the vehicles for us and preparing an estimate for the correct repair cost. In this particular case our assured's car was inspected and an estimate was prepared by Mr. J. T. Hail of -the Automobile Damage Appraisal Service of Amarillo, Texas, and this estimate was in the amount of $223.97. The estimate was accepted by Kuykendall Chevrolet Company of this City and repairs to the assured's vehicle have been made by Kuykenall Chevrolet Company on the basis of this estimate.. We represent National Union Fire Insurance Company and New Hampshire Fire Insurance Company in presenting claim against the City of Lubbock for damages sustained to property owned by Phillip Brown, 1505 East 35th Street, Lubbock, Texas, which said property was insured by our clients. As a direct result of that certain accident of December 7, 1954, our clients were called upon to pay under their insurance contract with Phillip Brown a total sum of $594.85. Such damage arose out of the negligent operation of a city road grader being operated by a city employee at the time the said damage occurred. Our investigation reveals that on December 7, 1954, at approximately 3 o'clock your city road grader operated by Austin Garner, being city road grader No. 2597, drove forward across 25th Stre-t and crashed into the corner of the house belonging to Phil -Lip Brown, causing the damage complained of. The house of Phillip Brown was knocked from its foundation, causin- foundation damage and interior damage to the walls, doors and windows. It also caused damage to the household effects. New Hampshire Fire Insurance Company under its policy paid a total sum of 1482.75 as a direct result of said accident, and is subrogated to the rights of Phillip Brown for said sum. National Union Fire Insurance Company paid a total sum of $112.05 for damage to one Zenith T.V. set which was cov4ered under their personal effects policy with Commercial Credit Corporation and Phillip Brown. I' We sincerely feel that the City should respond in payment of said damages for the reason that your employee was obviously negligent in driving a road grader on to private premises and being unable to use the judgment and foreseeability in stopping said road grader before he ran into the private citizen's house. The•efore, we request that this claim be, listed upon your claim journal to be presented to the proper commission that has authority to pay said claim. If you need estimates or proof of loss of such claim in payment, kindly let us know and they will be furnished upon request. Yours very truly, WRIGHT & WATERS By: /s/ Robert C. Wright Robert C.
