THE STATE OF TEXAS
COUNTY OF POTTER
TO: THE CITY OF LUBBOCK,TEXAS
NOTICE OF INJURY AND OF INTENTION OF FILING SUIT AGAINST
THE CITY OF LUBBOCK, TEXAS
WHEREAS, R. C. BRYAN and wife, LOIS BRYAN, were present within the City of
Lubbock, Texas, hereinafter called City, on the 23rd day of January, 1955 and were
dining at -a restaurant known as PHIL'S RENCH HOUSE located at 1621 19th Street in said
City, being owned and operated by Mr. PHIL ESKIN. A short distance to the West of the
main entrance of said restaurant, there is a break and defect in the public sidewalk
which constitutes a dangerous defect to persons attempting to cross said break.
Immediately to the North of said sidewalk and in front of said restaurant generally,
the said Phil Eskin has placed and laid large heavy telephone poles horizontally upon
the ground lying parallel to the sidewalk in frort of his business. Immediately before
said LOIS BRYAN entered the said restaurant, she crossed and stepped over the broken
place in said public sidewalk. After completing her meal at the restaurant and upon
leaving therefrom, she was aware of the existing danger in the broken sidewalk; and in
an attempt to avoid this danger, she stepped and crossed over the horizontal telephone
pole and walked along the outside of this pole on the North side thereof until she had
nearly gone far enough to avoid the broken sidewalk. Then she had to cross back over
the telephone pole on the south side thereof in order to get back on the public sidewalk.
In so crossing over the pole, it was necessary for her to step on top of the pole, she
at that time was wearing high -heeled shoes and a tight fitting skirt. This pole was not
fastening in place, and when she stepped on the pole, the pole rolled beneath her footing
and threw her headlong into and against the broken sidewalk, W#ich resulted in severe
physical and mental pain and suffering and injuries in an amount of at least $20,000.00.
Therefore you, the City of Lubbock, Texas, are hereby notified that we, the said
R.C. BRYAN and wife LOIS BRYAN, intend to file suit against the said PHIL ESKIN in the
above amount; and at that time, we diall also file suit against the City of Lubbock for
its negligence in allowing and permitting said sidewalk to remain in its broken, defective
and dangerous condition as it existed on that occasion, the 23rd day of January, 1955,
which proximately caused the injuries and damages to the said Lois Bryan; in the amount
of $20,000.00.
This notice is filed with you within 30 days after the injuries were sustained on
the 23rd day of January, 1955.
