The estimated cost of the City's portion for construction of the median divider is $17,000. The City's plan for street lighting being to budget in the 1955 - 1956 Budget at an estimated cost of $12,333.00. Estimated cost to the Highway Department is $45,000,00. The plan being to assess the property owners for the cost of the outermost curb and gutter. The Citizens present for the hearing stated to the City Commission that they would be favorable to the project if the median divider island from Date Avenue to Zenith Avenue could be eliminated from the project. However, Mr. A.H. Gearhart and W.H. Massey who own property in the area emphatically stated to the City Commission that they were not agreeable to paying the assessed cost of the outermost curb and gutter. Since these two pieces of property are homesteads and abut on East Broadway between Date Avenue and Zenith Avenue and these property owners refuse to pay their portion of the cost of this reconstruction of the outermost curb and gutter, it was unanimously agreed by the City Commission that it would not be feasible to assess the above property for curb and gutter, therefore, any action as to the reconstruction of paving at this location was deferred. ►5-13-562-964 Motion by Commissioner Thomas, seconded by Commissioner Carpenter, motion carried, Mayor Tripp and Commissioners Baker, Carpenter and Thomas voting Yea, none voting Nay, Ordinance No. 1696 was passed on first reading. On this date, March 24, 1955, the following letter was presented the City Commission from Kaiser Aluminum and Chemical Sales Inc. Kaiser Aluminum & Chemical Sales, Inc. 225 Mercantile Commerce Building Dallas, Texas March 20, 1955 Mr. Roy Grimes City of Lubbock City Hall Lubbock, Texas Dear Mr. Grimes: Recently we quoted you per our quotation #DL-173 dated 1-10-55 on five items of Kaiser Conductor with the note that we would accept the return of approximately 801000 pounds of Kaiser Conductor previously purchased if we were awarded an order based on said quote. Your purchase order #A-4179 was issued to us. We find that there is no market for the material which you desire to return, and it has been decided by our Product Office that this material can be sold only as scrap. Therefore, we have arranged to have this material sold to Texas Aluminum Company, Rockwall, Texas at a price of twenty-one cents ($.21) per pound. This letter is your authority to release this material to Texas Aluminum Company and Original letter, to invoice them directly at the price stated above. Texas Aluminum Company will as copied herein, pick up the material at your plant in their trucks. returned to Roy GrimesJurchasing This method of handling the items that you desired to return will result in at Agent with 6ity, least two advantages to your city. One, rather than having the credit on this March 31, 1955. return spread over the period of your purchases against your order #A-4179 you will get cash very quickly on your billing to Texas Aluminum Company. Two, with this company picking up the material in their trucks, you will save over two cents per pound which you would paid as freight if you had returned it to our plant per Note #4 of our quotation. In billing Texas Aluminum Company as stated above, you will not receive the in- voice value of the material as invoiced to you at the time that your original purchase was made. In order to allow you the full credit applicable, we propose to reduce the prices on our quotation DL-173 dated 1-10-55 by an amount which will have allowed you the balance involved when the total amount of conductor covered by your purchase order #A-4179 has been shipped. This, of course, cannot be accomplished until you have completed shipments to Texa:-; Aluminum and the total amount of the returned material determined. It should be noted that since this material is having to be scrapped 25% of the total weight returned will be allowed only at scrap value with 75% to be allowed at the original invoice price. Each item will be credited on this basis - in other words each item would be credited on the basis of 25% scrap and 75% invoice price. In order that there be no misunderstanding the word "material" as used in con- nection with the desired return refers to Items 6 and 7 on our quote #DL-173 and Items 6 and 7 on your purchase order #A-4179. These items are specified as #2 all aluminum conductor 7 strand and #4 all aluminum conductor 7 strand. Accurate record must be kept of the weight of the conductor as shipped to Texas Aluminum Company and forwarded to us so that these figures may be used in determining the balance of credit due. I believe the above covers all phases of this transaction, but would be very happy to clarify any question that may arise. Yours very truly, KAISER ALUMINUM AND CHEMICAL SALES, INC. /s/ M. W.
