55-13-535-905 This being the date set for hearing on paving - G.W.O. No. 1010, notice of said
hearing being of record at page 505 and 506, Minute Book 13, said hearing was
held.
Mr. C. N. Land appeared for the hearing in regard to paving of part of lots
21, 22 and 23 and 1 and 2. Block 13, of the Country Club Addition.
There was discussion in.regard to paving (of this property, however, Mr. Land did
not request that the paving not be constructed.
Mr. C.A. Stine, attorney for the Shamrock Oil and Gas Company and Mr. Redge
Greenhaw, representative for the Shamrock Oil and Gas Company appeared be-
fore the City Commission in regard to paving of part of Lot 19 and 20, Block
21 of the Country Club Addition, but did not request that the paving not be
constructed.
Letter from the Shamrock Oil and Gas Company, as follows, was presented to the
City Commission.
March 10, 1955
City of Lubbock
Lubbock, Texas
The Shamrock Oil and Gas Corporation owns a part of Lots 19 and 20 in Block 21,
Country Club Addition .to the City of Lubbock, Lubbock County, Texas, which land
is more fully described in Warranty Deed dated February 9, 1953 from C. L.
Gilbreath and wife, Joyce Gilbreath, and Johnnie D. Joiner and wife, Lorene
Signed copvAf Joiner, grantors, in favor of The Shamrock Oil and Gas Corporation, grantee, of
letter returned to record in Volume 460, page 259 of the Deed Records of Lubbock County, Texas, to
Mr.Holmes, of which reference is made for a full description of such property.
Engin eertng,
March 15,1955. The Shamrock Oil and Gas Corporation paid $12,800 for such property and purchased
property for the sole purpose of constructing and operating thereon a gasoline
filling station.
The Shamrock Oil and Gas Corporation is now informed and believes that the City
of Lubbock alone or in conjuction with the Texas: Highway Department intends to
construct a public road -or highway extending in a northeastwardly and southwest-
wardly direction adjacent to the above mentioned property; the same to consist of
a main thoroughfare and a service road separating our property from the main
thoroughfare with curbs so located along and adjacent thereto or projected there-
to with Erskin Avenue adjacent to the south portion of the above mentioned pro-
perty in such manner and fashion as to materially and adversely interfere with and
prevent ingress to and egress from said property to such roads and highway for
purposes of a gasoline filling station, and therefore, such property will be
irreparably damaged for such purposes and for any business purposes so that such
property will become practically valueless.
Therefore, The Shamrock Oil and Gas Corporation asks that said plans and specifi-
cations be revised so as to permit adequate ingress to and egress from such pro-
perty for such purposes, or that in the alternative, no assessment be made against
the property for curbs or gutters or any other improvements and that the City of
Lubbock pay to The Shamrock Oil and Gas Corporation the consideration which they
paid for such property, that is, $12,800.
Furthermore, in no event will any curb or gutter improvements proposed benefit
this property and no assessment should be made against this property because
thereof, and any such proposed assessment is protested by The Shamrock Oil and
Gas Corporation.
Yours very truly,
Is/ Ed H. Selecman
