Index of Exhibits INTRODUCTION Lubbock, Texas, is one of the fastest growin- cities in the nation. From a popult ion of 31, 853 in 1940, the city grew to a S e of 71,747 by 1950. Recently the population figures for July 1956 were calculated according t est methods available and the official estimated popu- lation of the City now stands at 132,634. Through the wholehearted co-operation of our citizens and builders only a small amount of they building done within the city knits has been substandard or is likely to be substandard in the foreseeable future. However, the city does not control building outside the city limits and some substandard construction has been erected in this area. As the city has expanded t'.'ese areas have been annexed and the problem of blight was inherited. Recently, the City Commission has annexed searal areas when it became apparent that the building in those areA7Aot meeting adequate stand- ards. This method of preventing future blight is meeting with unqualified success. The citizens and the City Commission realize that the problem of blight is not confined to the relatively small area of the city where blight exists. It is a real threat to the hAth, safety and morals of the community; and, as with all such threats, the problem will be met head-on. Recognizing that our efforts will be further aided by a State Ehabling Act for Urban Renewal Activities our city will encourage the adoption of this legislation. The program presented inthe following pa. -'es., supilemented by our citizens' efforts t *ake Lubbock a better city in whic' to live, will, we believe, be the answer to the problem of blight. 1. Codes and Ordinances In a fast growing city such as Lubbock the major portion of municipal attention has gone into providing for new construction. However, many of the ordinances 'adopted to provide guides for thivnew construction are also major tools in fighting blight. We realize that other ordi- nances need be adopted and enforced to attack unhealthful ancydangerous substandard construction. The following is a resume' of t'.e ordinances now in effect and those we intend to adopt to provide the necessary guideposts for the citizens andthe city administration in working toward a solution to the problem. A. Building Code.. The present bu'lding code of the city was adopted in 1938 and patterned after the Uniform Building Code. It has provided an excellent basis for the abnormal amount of new construction within Lubbock during the past 18 years. This code has Leen amended from time to time to keep it up-to-date with improved and modern construction methods. The municipality recognizes that the requirement of new construction methods and good build- ing practices are such that further amendments to the present code may not be the met practical solution. The City Commission is presently studying various recognize*odel building standards with the intent of adopting a new code or making major revisions to ourlrese code as soon as possible. Tentative n1ans call for the passage of this code ordinance by August 1, 1957. B. Plumbing Code. The City has adopted a complete and comprehensive plumbing ordinance passed the 27th day of April 1950. All amendments to this ordinance are included in the city code. C. Electrical Code. In May 1954 th City af Lubbock enacted its present regdations goverA-- ing electrical wiring. This code adopts the regulations as contained in the latest edition of the National Elec.,ric Code. The city recognizes its responsibility of keeping its enifomement ractices up-to-date and applicable to the latest approved methods. For this reason the electric code is reviewed yearly by the Electrical Board for possible revisions to be recomr.ended to the City Commission. D. Fire Prevention Code. The city has no comprehensive Fire Prevention Code as such. Various ordinances relating to fire protection are used by the office of the Fire Marshall in his work; however, re realize that a comprehensive code would give protection that is not now available. The City ommission has begun preliminary work towards preparing an adequate Fire Prevention code and should have final passage of a code ordinance, patterned along atandards suggested by the National Board of Fire Underwriters, by August 1, 1957. 11 E. Minimum Housing Standards. At the present time the city has no minimum housing standards code,. However, preliminary steps have been undertaken toward studying and investigating existing substandard housing conditions for th9urpose of ascertaining realistic minimum standards that used to be adopted. It is the intent/of the city to adopt those standards it deems advisable as contained in the APHA phamplet " A Proposed Housing Ordinance". It is anticipated that a minimum housing standards ordinance will be adopted by August 1, 1957. F. Zoning Ordinance_. Our Zoning Ordinance, discussed further under "Comprehensive Community Plan", is at the present one of the most modem -and up-to-date of its kind in the area. Prior to the time of the ordinance was adopted in January 1955, a zoning ordinance adopted in 1941 was used. Our City Comn•is Sion, fully cognizant of the fact that a good ordinance must be kept up- to-date, has been and is thoroughly familiar with the most important provisions of this ordinance+ G. Other Ordinances. 1. Pro -Bata Ordinance -Water and sewer main .extensions are accomp- lished throng e proves ons of this ordinance. ". The city has in force miscellaneous health ordinance regarding enviromental sanitation, nuisances, garbage, trash, weeds, brush, and others. 1I. Comprehensive Community Plan A. Land Uses and Zon$. The zoning ordinance referred to above has been adopted on the basis of research by our staff, Planning Commission and City Commission. At present we have no land use plan as such. However, the componen is of this plan are available and in use. A com- prehensive collection of these component parts will be made and sould be available by February 1957. B. Thoroughfare Plan. A complete and comprehensive master thoroughfare plan has been adopted by ordinance and followed in street planning. It was enacted Karcb 24, 1955, and has been subsequently amended. C. Community Fadlities Plan. Component parts of a community facilities plan are available but no plan as such has been Trade- Within twelve months the component parts should be collected and published as a comprehensive plLn. This plan will probably not be ordinanced because of various independent governmental units involved, including the County of Lubbock and the Lubbock Independent School District. D. Public Improvements Program. Lubbock's planning for future public improvements has been based on a tried and successful formula. Over the years, representatives of the city's adminis- trative family have worked with their various advisory boards to construct a realistic program for the improvement of there services. Public improvements suggested by these teams are then reviewed at the appropriate time by our City Commission with a view to revising and renewing our public improvements program. From these Efforts comes a proposal which, as in most cities, mecessitates a bond issue. Be- fore the issue is given to the public, a committee of some 300 representative citizens are called in to examine throposal and make recommendations. At this time the preliminary draft of the public improvements program is published and made available to the committee. Usually in the committee work several changes are suggested and accepted by the City Com- mission. When both the improvement program and the necessary bond issue are acceptable to both the committee and the City Commission, the bond issue is voted upon. The success of this method of adopting an improvements program can be demonstrated by the fact that no bond issue has ever failed in lubbock. Once the bond issue has been approved the final draft of the public improvements program is drawn up, approved by the City Commission and followed closely in our construction schedule. Our latest five year capital improvements program, adopted in November of 1955 is attached to this document, in the form in which it was presented to our citizens for their approval. E. Zoning. The City of Lubbock enacted its first Zoning Ordinance in 1941. Realizing that fl realistic, well finned and comprehensive zoning plays a major part in the orderly developing of any growing city, the Planning Commission and City Commission worked through the years in keeping the ordinance up-to-date. Recently both bodies have seen the need to incorporate in the ordina._ce more modern standards of zoning. For Lhi.s reason a new zoning ordinance was adopted in January 1955. This ordinance has been received and accepted b- our citizens as a n;ajor tool in working toward a well planned city. F. Subdivision Regulations. The City has a modern set of subdivision regulations in force. These regulations have provided a rethod whereby new developments may be well planned and fit into our pattern of growth without crippling costs to our taxpayers. III. Neighborhood Analysis Annexation of substandard dwelling has n the past been the most frequent cause of urban blight. Preliminary survey work has been undertaken for identifying the causes, location and extend of blight. The only readily available neighbor000df-siRformation is 1950 census. 1 Number of dwelling units 21,815 Number of delapidatdd units 2,082 As work progresses toward the elimination of substandard areas from our city, we will com- plete our study of all blighted areas. IV. Administrative Organization A. The Chief Building Inspector through his administrative organization adminsters and enfor- ces, in cooperation with other interested deparments, the following codes and ordinances: ,i L. Building Code 2. Zoning Ordinance 3. Electrical Ordinance 4. Plumbing Ordinance 5. Sewa -e Ordinance The current expenditure for these services is (October 1, 1955-Oct.1, 1956) 55,663. 1. 1950 United States Census of Housing, Bulletin H-A43, Tex.:_s, United States department of Commerce, Bureau of the Census, U. S. Government Printing Office 1952, p. 43-50 Table 18 During the year 1955 the building inspector issued; 3523 Building Permits for a total value of .27,725,144.80 3108 Electrical Permits 2712 Plumbing and Sewage Permits It is the current practice of the Building Office to ;ersmally contact those persons who have viol::ted or who may be violating the ordinances which this office enforces, withour issuing violation notices, and discuss the necess-ry corrections which must be'made. It is signification, to note that in only 27 violations (Jan 1, 1955 to Jan 1, 1956) was it necessary to issue a legal notice to correct the violation. Compliance with these notices where it has been necessary to issue them has been almost unanimous,. In fact it has been necessar,- to bring only 2 court actions against persons cited for violations. One of these persons tas since complied with the Electrical Ordinance and is now operating within the scope of all the above mentioned ordinance$. The other case is now pending in the courts and will be brought to its conclusion as soon as possible. It has long been the policy of the City Commission and the administrative personnel to use the best approved ;Methods of public relations in dealing with the citizens of Lubbock in Bode enforcement. The result has be -n that 'in the majority of cases all ordinances of the City, when' possible, are enforced through persuasion and only in the few otherwise incorrectable situations are legal proceedings necessary. B. The City Fire Marshall's Office, a division of the Fire Department, works with Health and Building Department in enforcing those ordinances of the city which pertain to fire pro- tection. In addition, this office has pioneered administrative work in preparing Qrdinances which are designed to furrieh residential housing with fire protection. It is this office which has collected most of the data now being studied by the City Commission toward adopting a nation-. ally recognized -Fire Prevention Code. 11 This office, in -addition to its regular duties, has been very active in educational programs designed to promote good fire prevention practices among the citizens of Lubbock and also to work with other interested persons throughout the state in keeping abreast of the latest standard rractices. As examples of these duties regular tours are conducted through the Fire Station by the Public Schools who also open their classrooms to lectures by persons assigned by the Fire Marshall's Of "'ice. This office also assigns one of its members to attend most of the more im- portant schools and conferences concerning fire protection held from time to time throughout the state. During the week of July 8 through July 14, 1956, a representative of this.department attended such a school at Texas A & M College and while there taught a five hour course stressing the 3mportante of adequate Building Codes in Fire Protection. , All violations of any of the ordinances pertaining to building or the Fire Marshall's Ordinance are usually checked by a team composed of a representative of the Fire Marshall and the interested representative of the Building Department and corrective measures ordered. The Fire Marshall has not found it necessary to file any cases or send legal notices during the past twelve months under -the Fire Marshall's Ordinance, and all other cases are referred to the Building Inspector for legal action. The annual budget for the Fire Marshall's function is $12,595. C. The Health Department, which is res;:onsible with the Building _Department . THE Sanitation Depatent and others, for the enforcement of all ordinances pertaining to Public, Health, renders a valuable service to the community. Among its -duties are vector control, blimination of pit privies, and elimination of any uhsanitary conditions which create a public nuisance. Within the city, since July 1, 1952, the effots of the Sanitary Engineer have resulted in the elimination of approximately, 1550 of the then existing 2100 pit privies in the city. Of the approximately 550 of these privy remaining, 500 are situated in areas where a sewer is not yet, available and 50 are used by persons whose personal financial conditions are such that they have been classified as hardship cases. From time to time these cases are re -studied and the hard- ship designation will be removed when and if the financial conditions of the persons involved are bettered. At the present time planning is being completed, a site selected, and architectural and en:ineering work being done toward building a modern City -County Health Unit. The estimated cost of this building is „300,000. When all the facilities are installed it is anticipated that our health unit will function_ even more efficiently. The Annual Budget of the health Department inspection service for 1955-56 was •,110,940. Of this the City contributed approximiely 90% and the county contributed the twlrimde. D. Urban Renewal is a new function ofthe City and at the present time trhere is no organi- zation to administer and co-ordinate Urban Renewal activities. However, the city his set up the nucleus of such an organization to handle these activities. E. The administration an d co-ordination of the enforcement of regulations and other urban renewal activities will be reviewed, suplemented and improved when and as needed. V. Financing The city recognizes it will have a financial obligation in the undertaking of any Urban Renewal activities. It is the belief of tte city that the carrying out of such a program is financially feasible. The city proposes to finance its share of any Urban Renewal activities undertaken through it general fund. Taxes from increased property valuations of properties re- newed, increased revenues through permits and inspection fees from any rehabilitation or new con struction work and anticipated reduction in cost of municipal servicee being furnished these substandard areas, will take care of a major portion of the cost of urban renewal activities. VI. Housing of Displayed Persons The city recognizes and accepts the responsibili tt ov de necessary assistance in re- housing families displa ed by governmental activite y. e of the city to make available the services of a staff or providing aid in finding decent, safe and sanitary housing within the economic means of these displaced families. Hub Homes, a local housing authority, s comprised of 130 low cost rental units. Of these, 2 may be assumed to be normally vacant and avallable to families displaced. The need for additio- nal rental units will in.all pobability be necessary. No additional public housing is contem- plated. It is believed that many of those displaced by governmental action and also a large number of other families within any project area will want to purchase their own homes, if housing is available within their economic means. The construction of housing facilities for prospective homg6wners and those persons who wil-Vown and operate rental units will necessitate FHA 220 and 221 Mortgage Insurance if needed and available. At present, the city does not forsee any insurmountable problems in relocating displaced families. It is anticipated that any problems which may arise can be solved locally. VII. Citizen :articipation The city of Lubbock has long realized the necessity and value of citizen participation in municipal government. "t the present time there are some 22 boards and commissions wh-ch aid in carrying out effectively a broad program for the future growth ancyplanning+ of our city. Citizens regularly contribute their time and experience free of charge to the developing of our municipals* In'accition, temporary boards are often constituted to make recormiiendations concerning specific problems. Citizen participation is probably the key to the rapid development any many municipal im- provements within our city during its history. In one area of the city, which is substandard, the persons who live there have voluntarily worked with the Planning Commission, a citizen's advisory board, toward the upgrading of the area. The minority group which makes up the greater part of those persons living in th area n.et several times., discussed the ramifications of a renewal program, and decided to throw their full support behind the renewal program. The proposed program in this instance includes re -zoning to a higher clas..if ication, street paving and other municipal imporvements as well as compliance by the involved people with proposed rigid standards for their homes. The Planning Commission, the local Real Estate Board, the local Home Builders, and the Community Planning Council are agencies, independent and min icipal, whicYkave expressed interest and ap roval of th E/planned efforts of the city to combat the problems of eliminating substandard housing and adopting measures for preventing their recurrance. At this time a ;reli, inary study has :een made toward establishing a Housing Committee to be appointed by t::e City Commission. Plans call for this corm ittee to work closely with the Com- mission and administrative personnel. The city accepts the responsibility of working with intere7,ted citizens groups and furnishirt; aid and information in their efforts, co-ordinated with our own, to rid the city of substandard housing and in developing community wide participation in a better housing program. 56-15-343-93$ Motion by Commissioner Maxey, seconded by Commissioner Byrd, motion carried, Mayor Forrest and Commissioners Byrd and Maxey voting Yea, none voting Nay, to authorize sale to H.
