6-15-194-D-531C Motion by Commissioner Baker, seconded by Commissioner Maxey, motion carried, Mayor Forrest and
Commissioners Baker, Byrd and Maxey voting Yea, none voting Nay, to authorize acceptance of the
proposal of A.M. Lockett and Co. as set out in letter of May 15, 1956, to maintain the option for
purchase of a second Badcock and Wilcox steam generating unit for an additional 6 months to
November 15, 1956.

Re: Steam Generating Units
Power Plant Improvements
Municipal Power Plant
Dear Sir:
We refer to your telegram of May 14, requesting extension of the City of Lubbock's option to
purchase the second Babcock & Wilcox Steam Generating unit covered by our proposal D-736 dated
October 3, 1955, and accepted b_y the City Commission November 15, 1955.
Our principals, the Babcock & Wilcox Company, have agreed to extend the option for a period of
six months to November 15, 1956. The contract price of $293,641.00 will be subject to the
standard "Material and Shop Labor Price Adjustment Clauses" attached hereto. It is agreed that the
total amount of price adjustment so resulting will not exceed ten percent (10%) of the contract
price, provided shipment of this unit can be made not later than November 152 1957.
We, of course, cannot guarantee shipment at this time due to uncertainties of material deliveries
and shop schedules. Therefore, if a decision is made to firm the order for the steam generating
unit on or before November 15, 1956, we will determine from the Production Department of the
Babcock & Wilcox Company the shipping schedule as of that date.
We sincerely hope that if and when the City of Lubbock shall release the order for this unit that
manufacturing conditions will approximate those of the present time. However, since this cannot
be guaranteed, and if the Babcock & Wilcox Company is unable to make shipment by November 15, 1957,
or if shipment should be deferred at the request of the City of Lubbock, the maximum limit of price
adjustment shall be determined by mutual agreement.
We trust that we may have your authority to maintain the option to purchase on the above basis.
The Babcock & Wilcox Company
Respectfully submitted,
A. M. LOCKETT & CO., LTD.

Proposal No. D-736 (Second Unit)
Date: October 3, 1955
MATERIAL & SHOP LABOR PRICE ADJUSTMENT CLAUSES
The Contract Price as stated herein is subject to adjustment in accordance with the following:
1. (a) MATERIAL: For the purpose of this price adjustment provision only, the amount representing
material is fixed at 40 per cent of the Contract Price exclusive of the price of erection labor
quoted separately. This amount will be adjusted for changes in material cost based on the
variation in the "Special Wholesale Price Index" of "Steal Mill Products" as published by the
United States Department of Labor. An arithmetical average -of such monthly indexes will be
computed for the period beginning one (1) month before the month in which shop fabrication of the
equipment covered by this Contract is started, to and including the month in which the equipment
is completed at the factory {the latter month being determined as the month in which the last
carload shipment is made). The percentage by which such avera;e is higher or lower than the index
for October, 1955 will be determined and applied to the amount representing material as determined
above to obtain the increase or decrease in the amount representing material. The Contract Price
shall be increased or decreased by an amount equivalent to the increase or decrease in the amount
representing material so determined.
1. (b) SHOP LABOR: For the purpose of this price adjustment provision only, the amount representing
shop labor is fixed at 45 per cent of the Contract Price exclusive of the price of erection labor
quoted separately. This amount will be adjusted for changes in labor rates based on the variation in
the average hourly earnings of "Primary Metal Industries" under "Earnings and Hours" as published by
the United States Department of -Labor. An arithmetical average of such average hourly earnings
will be computed for the period beginning with the month in which shop fabrication of the equipment
covered by this Contract is started, to and including the month in which the equipment is completed
at the factory (the latter month being determined as the month in which the last carload shipment is
made.) The percentage by which such average is higher or lower than the average hourly earnings of
"Primary Metal Industries" for September, 1955, will be determined and applied to the amount
representing shop labor as determined above to obtain the increase or decrease in the amount
representing shop labor. The Contract Price shall be increased or decreased by an amount equivalent
to the increase or decrease in the amount representing shop labor so determined.
2. In computing the percentage increase or decrease for material and shop labor as provided above,
percentages shall be calculated to the nearest one tenth of one per cent.
3. Payment of all price adjustments shall be due upon receipt of the invoice or credit, as the case
may be.
It is agreed that the total amount of price adjustment resulting from paragraphs 1 (a) and 1 (b)
above will not exceed 10% of the total contract price exclusive of erection labor.
Note: Applicable to second steam generating unit only and based on option to purchase on or
before November 15, 1956, provided shipment can be scheduled prior to November 15, 1957.
*Note:
This amount to be released from City's Special Fund to General Fund.

water main from Lubbock to Bailey County and award of contract having been deferred, the bids were
again considered by the City Commission. The following letter from E. E. Farrow of E. E. Farrow Co
was read.
Honorable Mayor
City Hall
Lubbock, Texas
Gentlemen:
and City Commission
May 25, 1956
RE: Sandhills Water Supply
Line, W.W.O. No. 11001
Confirming our verbal statement of May 24 at 3:00 P.M. to Mr. John Hickerson, we hereby withdraw our
bid on the above mentioned job due to a very grievous error which was made by our estimator in
calculating the discounts from the unit prices on the main pipe items, which were given us by our
pipe supplier and manufacturer, Gifford -Hill Pipe Company, on May 24 at approximately 2:15 P.M.
We were placed in a most unusual situation due to the length of time in which this bid had to be
calculated, and our estimator in operating the calculating machine used the wrong multiplier in
figuring the discounts, and consequently worked directly from the machine to our bid sheet.
Please note that Item No. 1 was bid at $9.64, whereas it should have been $11.89. This is 60 cents
less than the actual pipe cost which was $1024. This does not allow for any labor, or trenching, or
installation. On item No. 3 we bid $9.99, and this bid should have read $11.35. On Item no. 4 we
bid $11.60 and whereas our bid should have read $12.93.
Under the circumstances, we had no alternative but to withdraw our bid on account of the honest
mistake in calculation, as above outlined. We trust that you will return our bid and our bidder's
bond without penalty.
Respectfully,
E. E. FARROW COMPANY

After consideration of Mr. Farrow's letter, as set out above, and the investigation made by the City
Commission and the law as submitted by the City Attorney and Ramsey Clark, Attorney for E. E. Farrow
Co., the City Commission finds that the error made by the E. E. Farrow Co. is an honest and uninten-
tionable mistake and that it would be wholly inequitable to hold t":is Company to their bid which was
based upon their mistake and wholly unbalanced when tested by the second lowest bidder or the average
of all bids. Whereupon, motion was made by Commissioner Baker, seconded by Commissioner Byrd, motion
carried, Mayor Forrest and Commissioners Baker, Byrd and Maxey voting Yea, none voting Nay, to
authorize the E. E. Farrow Co. to withdraw their bid. Consideration was then given to the second lowest
bid on this project, being the A and A Construction Co. of Muskogee Oklahoma, James W. Miller
(individual), owner. It was found by the City Commission that the bid of A and A Construction Co. as
appears in the bid tabulation of record at page 190A-C , Minute Book 15 is in order, whereupon, motion
was made by Commissioner Baker, seconded by Commissioner Byrd, motion carried, Mayor Forrest and
Commissioners Baker, Byrd and Maxey voting Yea, none voting Nay, to authorize acceptance of the bid of
A and A Construction Company for laying the water main to Bailey County, Texas, Mayor S. S. Forrest, Jr.
being hereby authorized to enter into contract between the A and A Construction Co. and the City of
Lubbock for construction of this project.
56-15-209-577Motion by Commissioner Baker, seconded by Commissioner Byrd, motion carried, Mayor Forrest and
Commissioners Baker, Byrd and Maxey voting Yea, none voting Nay, Ordinance No. 1928 was passed as an
