THAT, all paving improvements constructed on any street and/or avenue along or within the City Limits of Lubbock, Texas must be constructed in accordance with the City's standard plans and specifications under the supervision of the City Engineer and the distribution of costs shall be in accordance with the following provisions. 1A. Definition: The words abutting property as used herein shall mean property abutting the improvement including but not limited to property abutting the right of way upon which the improvement is being made. 11. THAT, the entire cost of the concrete curb and gutter parallel to and abutting the property and of the same length as the property it abuts as differentiled from center island or median curbs be assessed against the abutting property and the owners thereof, such concrete curb and gutter to be referred to hereinafter as "property owner curb." THAT, ninety percent (90%) of the entire paving cost, exclusive of the "property owner curb," be assessed against all front abutting property and the owners thereof and against all side abutting property and the owners thereof where the abutting property is zoned for commercial or manufacturing purposes or where said side abutting property is zoned for residential purposes and is occupied by a commercial or manufacturing usage. Front abutting property for assessment purposes is that along the shorter side of a lot, and side abutting property is that along the longer side of a lot. The rate per foot to the abutting- property as determined by the above cost distribution is to be referred to as the "front foot rate." 1V. THAT, sixty percent (60%) of the entire paving cost, exclusive of the "property owner curb," be assessed against all side abutting property and the owners thereof where ,the side abutting property is zoned for residential purposes, and if occupied, is occupied by a residential usage. The rate ,,er foot to the abutting property as determined by the above cost distribution is to be referred to as the "Side foot rate." V THAT, the method to be used on a paving project to determine the "front and side foot rates" and property assessments as set forth above is as follows: 1. All streets of identical width are to be grouped together into a single Unit, and the various individual streets of identical width shall be designated as Sub -units of their particular Unit. 2. The "total project cost" of a Unit includes the total cost of the various items of work contributed from all Sub -units of the Unit as bid plus five percent (5%) of said contract cost for engineering. 3. From the "total project cost" the "property owner curb" will be deducted at the rate establish-* ed by the contractor's bid price per linear foot for concrete curb and gutter and/or concrete gutter plus five percent (5%) engineering. ('Property owner curb" does not include that curb and/or gutter along side and across alley returns nor all of the curb radii). If there is a railway crossing in the Unit, the charges assessable directly to the railway company at bid prices plus five percent (5%) will also be deducted. 4. The amount after making the above deductions will be terned the "cost excluding property owner curb costs and railroad crossing costs" referred to herein as amount "A". 5. The "front foot rate" is amount "A" less 10% of amount "A" divided by the total footage of all property abutting all Sub -units making up the entire Unit. 6. The "side foot rate" is 2/3, of the above rate. 7. Part of the total cost to be assessed against each parcel of property abutting the improvements in each Unit will be determined by multiplying the abutting footage of each parcel of property by either of the above rates or by a combination of the above rates, whichever is applicable. This cost will be referred to herein as the "property owner paving cost." 8. The total cost to be assessed against each parcel of property abutting the improvements in each Unit is the sum of the "property owner paving cost" and the "property owner curb cost", the latter being set forth in sub -paragraph (2) of this ParacTraph V and in Paragraph 11. V1. THAT, the above provisions do not apply to the distribution of the paving costs of streets and/or avenues within new subdivisions or of the abutting half of the streets and/or avenues bordering new subdivisions which are recorded in accordance with the provisions of Ordinance 1331, "New Subdivision Regulations" and amendments thereto. The paving of these streets and/or avenues for which money is deposited in escrow, shall be accomplished as soon as any remaining right-of-way is secured if needed and the remaining half of the streets and/or avenues paving cost is secured either by another escrow deposit or by assessment proceedings. Vlll. THAT, the City Engineer's estimate of the money 'deposited in escrow by the subdivider for his portion of the cost of one-half of the width of future paving improvements, referred to above, shall be based on current bid prices at the time the estimate is made. No adjustment shall be made either to the City or to the subdivider in case of variation between the actual successful bid prices received at the -time of award of contract and the estimated bid prices. Mr. W. E. Medlock appeared as Chairman of the group. Mr. Warlick Carr, Attorney, discussed organization plans, stating to the City Commission that the plan is to form a non-profit organization who may lease the land from the City for a period of approximately 15 years with a ten year option, at $1.00 per year. 14r. Carr also stated that it was the plan of the group that the Park be under the supervision of adult members at all times and that the corporation be operated by a Board of Directors consisting of one member from each of the participating organizations. Mr. C. W. Ratliff appeared with the group as chairman of the committee for plans and sketches. Mr. Ralph Penney discussed the financial structure, stating that there are approximately 3,000 teenage parents who it is felt will participate in the cost of developing this park and furnishing labor, without cost, for some of the improvements. The estimated cost of the project is Q5,000900. There was further discussion by the group as to the Board of Directors, Mayor Pro-tem Baker suggesting; that a list of three names from each of the civic clubs and other organizations who participate in the development of the park, be submitted to the City Commission for consideration. This residence is owned by Glen S. Wigginto n and is under the rental management of Mrs. Sneed. The claim is as follows: Lubbock, Texas January 23rd, 1956 City Secretary Lubbock, Texas I am Daisy Sneed, age 55, and reside at 1709 27th Street, Lubbock, Texas. I resided at 1709 27th Street, Lubbock, Texas, for six (6) months immediately preceding the occurrence of the below stated damages. I am divorced and have one dependent child. I am self-employed and an the owner of Daisy Sneed Real Estate, Rentals and Property kanagement. On January 12th, 1956, I rented a house owned by Glen S. Wigginton, who now resides at 1017 Vine Street, Abilene, Texas, and his actual residence of such claimant for six (6) months immediately preceding the occurence of such damages was at 3103 30th Street, Lubbock, Texas. This house is located at 3103 30th Street, Lubbock, Texas, and was rented to a ivir. Cecil Holmes. 1 rented the hose for $110.00 per month and Mr. Holmes has the first option to buy the home. When the house was rented by Mr. Holmes, I overheard Mr. Holmes ask his cousin, a Nirs. Botts of 3112 22nd Street, Lubbock, Texas, to have the utilitys turned on January 13, 1956. About 10:45 A.M., Mir. Botts called me January 13th, 1956, advising that his wife had called the water department that morning asking -them to .turn the water on at the above address. The water department said that someone had to be present at the house when the water was turned on. Mrs. Botts told them she would be there at 10:30 A.N., for them to come then so the water could be turned on. Pir. Botts said he got there early about 10:05 A.M. and the ho4e was flooded in the kitchen and living room. The water was not running when Mr. Botts arrived but it appeared the water had been running shortly before that same morning. We were in the house the day before and it was all right then. We presumed the water had flooded through an open valve for an automatic washer connection. The valve or hydrant on this washer installation was open and pointed in the dining room where it was flooded. When Mr. Botts arrived the water had been turned off. Just after talking to I"lr. Botts, his wife called and said she reported the accident to a "Irs. Thigpen in the water dep ..rtirent . Nirs. Botts and I felt the City turned on the water and was responsible for the damage. Later that same night I again talked to kirs. Botts and she said she had gone by the house .about 11:45 A.M. and water had been tumed on. Mr. Botts had left the house open and she supposed the city came back and again turned on the water. I was mown in the water department on January 14th, 1956, and taling to one of the women who told me that the water man had called in to her and said he had turned on the water but that the house was locked and he turned the water back off again. I am attaching hereto original statemc nt dated January 16th, 1956, from the Frenchway Rug Cleaners, 505 Avenue 0, Lubbock, Texas, itemizing their work done to repair the damages at the house located 3103 30th Street, Lubbock, Texas, reading as follows: "Jan. 15 take-up & re -lay section of wet carpet $12.50 cleaning 378 ft. carpet - 30.25 TOTAL $42.75" I am also submitting a claim for 415.00 payable to myself, I+'Irs. Daisy Sneed, for the inconvenience and the time I spent in seeing about the damaged house. I feel that this is a reasonable amount due to the time that I spent. I have made six trips to the house located at 3103 30th and have made two trips to the City Hall. There will still be additional trips to be made in the future in order to bring the matter to a conclusion. Respectfully Submitted, /s/ Daisy Sneed After consideration of the above claim, motion was made by Commissioner Carpenter, seconded by Commissioner Thomas, -motion carried, Layor Fro-tem Baker and Comnissioners Carpenter, Forrest and Thomas voting Yea, none voting Nay, to authorize payment to Mrs. Sneed in the total amount of 042.75, in settlement of this claim. Full release to be secured from Mrs. Sneed. 56-15-53-137 Mr. Cecil Jennings and Mr. Peters appeared before the City Commission for discussion of platting and paving requirements in the 2100 block of 48th and the 2200 block of 49th Street in Lubbock. Mr. Jennings requesting that because of prior arrangements for paving this property, the paving be laid only 30' wide on a 501 right-of-way. Motion was made by Commissioner Carpenter, seconded by Commissioner Thomas, motion carried, Mayor Pro-tem Baker and Commissioners Carpenter, Forre,3t and Thomas voting Yea, none voting Nay, to grant the request as set out above. 56-15-53-138 6-15-53-139 Motion by Commissioner Forrest, seconded by Commissioner Carpenter, motion carried, Layor Pro-tem Bak,:r and Commissioners Carpenter, Forrest and Thomas voting lea, none voting Nay, to approve and authorize change order No. 2, to Tarver Electric Co. for electrical work on the Auditorium -Coliseum. This chan ;e order to add ]'209900 to the contract to make the total contract cost $9,987. This change oL-der to authorize furnishing and installing 12 120 volt duplex receptacles in the arena of the Coliseum as directed. There was discussion of the request of the Park and Recreation Corruni.ss=i on th_-t a curfew be placed on the City Parks and the i°,eadowbrook Golf Course after the lights are turned out at night. It was unanimously agreed to refer this matter back to the nark and Recreation Commission for further study and recommendation. 56-15-53-140 The following letter of request was received from J. A. Fortenberry, Jr., president of the Lubbock Bus Co. Inc. February 23, 1956 Mr. H. P. Clifton, City Manager Refer to City of Lub.ock Page 54A for City Hall map re. Lubbock, Texas routes of bus company Dear "jr. Clifton: The Lubbock Bus Company, Inc. wishes to propose the following changes in service. We wish to extend service as shown on the enclosed map. This map is made in three colors, red showing existing service, green showing proposed service, and .yellow showing special school service. The changes are as follows; extension of the Broadway & Boston Line out Canton to 48th St., then west to Flint, then north to 34th St., east to Boston and return on the present route. Extend the 32nd St. line south on Indiana to 42nd St., west to Louisville, north to 36th St., east to Indiana and return by the same route. Extend the 28th,,,jSt. line as follows; the line will not be changed until reaching 28th St. and Joliet, then south on Joliet to 32nd St., west on 32nd St. to Orlando, south to 37t h St., west to Slide Road, north to 34th St., east on 34th St. to Orlando where it will follow the same route to town. Combine the 8th St. & Arnett Benson and the 4th St. & Arnett Benson-irito one line with 20 minute service instead of 30 minutes. This can be accomplished by enlarging the loop on the end of the present 8th St. & Arnett Benson line. Extend the 19th St. & Ellwood line two blocks further south at Indiana is the only change on this line. The Hub Homes & Mexico line presently goes out and retu ms the same route. Change this line to follow the present 4th St. & Arnett Benson line to 4th St. and Avenue U, then north to Baylor, east to Avenue 0, and follow the existing Hub Homes & Mexico route back to town. The other extension of service is on the Carver heights (colored) line. Combine the present Carver Heights line and the Cresthaven (colored) lines. The Carver Heights will be unchanged except to continue out Railroad Avenue to 34th St., then east to Quirt Ave., then north to 34th St. and return. This will result in service to Cresthaven all day instead of the three hour break in service in the middle of the day as now exists. These extensions of service will result in bus service in many areas not receiving bus service at the present =time. Some of the additions that will have bus service within the additi6n or within four blocks are: Hulin Sts., Lubbock View, Myrtle Slaton, Sunny Hill, Sunset Hts., College*Hts., Evans, Murryhill, and Walden on the south and westside of the city, to the north; Hobert Jones, Canyon View, San Jose will receive new service. lou will notice on our monthly reports to the City that we are continuing to experience a Pcline in riders. We feel that this is largely due to a shift in the population of the City to the south and west, and also the increase in private passenger cars within the city. We are hopeful that this change in service will result in an increase in patronage, because bus service will be offered to an estimated 20,000 people that do not now have service. We are also requesting that service be eliminated on 15th St. Wetave recently conducted a Purvey and found that an average of 167 passengers ride this line per day. This yields a gross revenue of 20.6 cents per mile. The expense of operation exllusive of office and administrative expense (which would not be effected by the change) is 27.1 cents per mile. This results in a daily loss of $6.82 per day for 105 miles of operation. We also are requesting discontinue all service at 7:00 P.M. daily and all service on Sunday. The following is what our records show to be the result of the existing nigh service. Rout e rules Income per mile Los s E. Bdwy.-4th Arnett Benson 54 4.50 $12.20 8th Arnett Benson-Bdy-Boston 59.2 5.20 12.96 Carver Heights 38.4 13.60 5.08 This service results in a daily loss of $30.24 except on Sunday, when no night service is operated. The annual night service loss is $9,465.12. There are only five lines operating at night at the present time. All of these except Carver heights is operated on one hour service. The following is what our records show to be the result of the Sunday operations: Route kiles Income t-er mile Loss E. If we add the annual loss of $2,134.66 on the 15th St. line to the night and Sunday loss it totals $20,420.74 per year. This is almost two thirds of the loss sustained by us in 1955. We fell that the above changes are necessary for the continued operation of the Lubbock Bus Company. We propose to stop the night and Sunday service immediately and begin operation of the new routing on March 19, 1956. We are hopeful that the elimination of the service plus the increase in day time service will result in a net profit for the Company this year. Very truly yours, LUBBOCK BUS COMPANY 1NC. J.A.
