Motion by Mr. Leaverton, seconded by Mr. Roach, carried unan- imousaly, Acting City Manager W. H. Rodgers was instructed to enter into the following contract with D. L. McDonald. SUPPLEMENTAL AGREEMENT FOR ADDITIONAL ?VATER WELL STATE OF TEXAS, CITY OF LUBBOCK TO LUBBOCK COUNTY. D. L. McDONALD On November 21, 1931, the City of Lubbock, Texas, herein called the City, and D. L. McDonald, herein called the contractor, entered into a water well drilling contract, whereby the contractor agreed with the City to drill and complete one permanent water well, and furnish all labor and material, in accordance with the attached plans and specifications, for the agreed consideration of Four Thousand Three Hundred Fifty Dollars ($4,350.00). The contractor also furnished construction and maintenance bond each dated December 31, 1931, executed by the U.S.F. & G. Co. as surety. Said well was drilled on the Lubbock County ?ark site. Recently it was discovered that said well had caved in and could not be used. The aforesaid contractor recognizes his liability under the aforesaid contract and bonds to construct, complete and maintain said well in accordance with the provisions of said specifications, and as compromise and settlement it is agreed that the said contractor will clean out the Lubbock County Park well, covered by the aforesaid contract and bonds, and put said well in the same condition it was in at the time it was finished, in keeping with the aforesaid contract and bond, and that in addition thereto the City will select a site in the northeast part of the city, at some point north of the Santa re railroad track, and that contractor will, without cost or liability to the City, drill and complete an ordinary test well to ascertain the source and quantity of water that may be obtained therefrom, for the purpose of supplying the City and inhabitants of Lubbock with water, and that if it be ascertained therefrom after said test, that a well drilled on said site will produce as much as 350 gallons per minute under test set forth in said specifications, the contractor will drill and complete a permanent water well thereon, without further cost or liability to the Gity, for the agreed consideration of Two Thousand One Hundred Seventy-five Dollars ($2,175.00), all in accordance with the foregoing contract and specifications.' It being understood that the foregoing contract and specifications are to be carried out and made applicable hereto as to such additional well; it being the purpose of this supplemental agreement that the con- tractor, realizing it is questionable whether the Lubbock County Park well will stand without caving in, obligates himself to furnish to the city another permanent water well ( in lieu of and additional to said Lubbock Park well) for one-half the cost of said Lubbock r'ark well as called for in the original contract and specifications for the Lubbock Park well. in other words, said contract and specifications are to be carried out on the aforesaid additional well wherever same may be located, the principal changes in said contract and specifications for the additional well being in regard to the cost and quantity of water. It is further agreed that should the contractor be unable to obtain the required quantity of water in the north- east part of town after making the aforesaid test, the City of Lubbock will then select another site, probably the eaver tradt in the southeast part of town. The :leaver tract has already been tested by the contractor who reports that a per- manent well thereon will test not less than 350 gallons per minute, and in the event the City desires and directs that the permanent well be drilled on the Weaver tract, then the con- tractor is to receive as his compensation for drilling said permanent water well the sum of 'i'wo Thousand One Hundred Seventy five j)ollars ($2,175.00) less a credit of One & 50/100 Dollars (1.50) per foot for the test already drilled and paid for. In any event, the permanent water well on the vieaver tract shall be drilled and paid for in accordance with the foregoing con- tract and specifications. The City of Lubbock shall have the right, within a reasonable time, to select any other site on which the contractor shall drill and complete the aforesaid test hole and permanent water well which shall produce not less than 350 gallons per minute for the aforesaid consideration of Two 'i'housand One Hundred Seventy-five Dollars ($2,175.00), in the event neither of the first two sites mentioned is used or can be used. If some site other than the first two sites mentioned is used by the City, then the City shall pay for the test hole at the rate of ti per foot. Wherever said additional well is drilled it is agreed that the aforesaid contract and specifications shall cover the drilling and completion of same and the manner of payment there- for. It is further agreed by the (;ity, contractor and afore- said surety company that the aforesaid original contract, con- struction bond, and maintenance bond shall remain in full force and effect, and shall not be abrogated by this agreement, until the completion and acceptance of the aforesaid additional well. Upon the completion of the new permanent water well, in accordance withe aforesaid contract and specifications, the contractor shall furnish maintenance bond similar to that attached to the original contract, and upon the completion and acceptance of said original water well and maintenance bond and restoring of said Lubbock county Park well in the same condition it was in when accepted, the contractor and surety company shall be released from further liability on said-.ubbock County Park well. The main purpose of this agreement is to allow the con- tractor to substitute a new permanent water well in liew of the Lubbock County Park well for one-half the cost thereof, and to transfer the contract and bonds from the Lubbock County Park well to the new well called for, and make the same applicable to the new well and the maintenance bond running for a period of one year from date of completion and acceptance This the day of June, 1931.
