March 14, 1957
City of Lubbock
Lubbock, Texas
Gentlemen:
17-16-216-572
Since your action authorizing agreement to W. John L. Birdwell's proposals contained in his letter
of January 24, 1957, Mr. Birdwell has been checking carefully to see what, if any, existing improve-
ments in wells are in conflict with that agreement. Because of the fact that in the Sand Hills it is
quite difficult to find section corners, W. Birdwell finds that he was in error as to the location
of some of his wells. The purpose of this letter is to request certain exceptions for the purpose
of making an agreement with the City as to existing wells, and a very few exceptions that are needed
because of unusual circumstances. Mc. Birdwell's perpose is to reach a complete understmding so that
in the future there will not be any misunderstandings with the City of Lubbock innegard to the use
of th a water.
1. he owner of Section 68, Block A, Blum and Blum, is W. Birdwell's son, J. E. Birdwell. Because
of agriculatural use pre-existing the agreement of January 24, 1957, it is extrnmely important
that an exception be allowed as to such Section, as follows:
That one of the wells permitted in Section 68 may be drilled not more than 700 feet south of the
North line of said Section, without restriction as to corner.
2. At the time W. Birdwell purchased the lands in question, there was an 8-inch irrigation well
located near the center of Section 11, Block A. It. Birdwell thought this well was in Section
131 of Block 0, but found that he was confused as to the Section Lines. The location of this
well is contrary to the agreement. W. Birdwell requests that he be permitted to use the well
until such time as the City needs it, or its use conflicts with the City's purposes, at which
time he will then permit the City to take over the well. At that time, Mr. Birdwell would like
to take over the well. At that time, W. Birdwell would like to exchange his right to one of
the wells now permitted in Section 2, Block 0, for one well in this Section 11, Block A.
3. Prior to the agreement with the City, an irrigation well had beendrilled in the center cf Section
52. W. Birdwell would like to use this well until the City needs it, at which time he will
deliver the hole to the City. If, in the meantime, he drills another irrigatfin well in this
Section, he will abandon the existing well. 11
4. Under the existing agreement, W. Birdwell has a right to four 6-inch wells to be drilled in
section 2, Block 0, Rather than concentrate so much drilling in one Section, he feels it would
be better for himself and the City if he could trade two of those wells to be drilled elsewhere.
He proposes that he be permitted to drill one well in Section 22, and the one well in Section
11, both in Block A, to be deducted from the total wells permitted in Section 2, leaving only
two wells in that Section 2, Block O.
5. W. Birdwell requests permission to trade one of the wells that he is permitted in Section 2,
Block 0, for one 6-inch well in Section 4, Block 0.
6. W. Birdwell would like to trade his irrigation rights for Section 27 for rights on Section 17,
in Block A; and he would like to trade his rights for irrigation ofthe south half of Section 65
and the south half of Section 66, in Block A, for similar rights as to Section 16, Block A,.
W. Birdwell will sincerely appreciate consideration of these requests, and beliwes that this will
conclude an agreement under which he can live and work in full cooperation with the City.
Very truly yous,
