Mr. Gibson is owner of the "Now That's Yogurt" at 1210 Avenue K^ and he wishes in install(?) tables and chairs on the sidewalk for his customers throughout the day. He is not wanting to comply with the resolution for a street -use license inasmuch as these are not permanent installations but merely will be set out each morning and put away at the end of the business day. The staff dues not feel the idea is objectionable as long as the use of the sidewalk does not block pedestrian traffic, but to waiver the street -use license would be establishing a precedent for other proponents henceforth. This has never been waived for any other previous requests. Mr. Gibson stated that his business is selling yogurt and dn|\ sandwiches, and the reason that he requested o waiver from the 20-yeor commitment is that he is not sure that the idea will work, and if would be opp|ioob|n only for the summer months --that is to say it is an experimental merchandising effort. The purpose of the street -use license is to servo as o safeguard for public use, and the staff does not recommend waiver of the license. Inasmuch as there is not to be any fixed uopifo\ improvements, Assistant City Manager Bertram suggested that possibly an alternative plan could be worked out with Mr. Gibson whereby o modified license could be approved for o short term with certain conditions to allow for control of use of the right-of-way. Councilman Brown indicated that it seemed that something could he worked out without breaking the policy and waiving the street -use license. rr With this thought in mind, the motion was mad* by Councilman Brown, seconded by --- Mayor Pro Tem Henry not to waive the street -use license but requesting the staff to \ work out some alternative as u compromise for o shorter time period. Consider a resolution authorizing the Mayor to sign a revised agreement with the Texas Department of Highways and Public Transportation for installation and maintenance of pavement markings within the City of Lubbock. (Reso. 1005, 1/14/82) Resolution No. 1322 The revised agreement provides for the installation of retro-reflective, prefabricated pavement markings referred to as reflectorized vinyl tape, and the revised agreement is requested by the State Highway Department. The original agreement was approved January 14, 1982, (see Reso. 1005) and the initial installation was completed December 23, 1982. The revised agreement incorporates the latest state and federal requirements for federally funded projects under which the tape was installed, but the maintenance responsibilities of the City and State Highway Department remained essentially the same: the Highway Department will reimburse the City up to $25,000 for any required replacement for the two-year maintenance period commencing December 23, 1982; the City may purchase material approved by the Federal Highway Administration through stated procedures and a joint evaluation report by the City and the State is also incorporated into the revised agreement. In response to Council query as to the necessity of such wide markings, Mr. Bertram responded that this was the State's design and decision. in response to Council query as to the effectiveness of these markings, Mr. Bertram responded that they had been very effective with the exception that those that had been damaged resulted from chains on tires in the recent snow storms that the City has experienced. There being no further discussion, the motion was by Councilman Aderton, seconded by Councilwoman Baker to pass Resolution No. 1322 approving the revised agreement with the State Highway Department as referenced above. Ordinance No. 8411 In accordance with the notice published on February 0, 1983, in the Lubbock Avalanche -Journal, a public hearing was held on the above matter. Proponent: Roy Middleton This request is for R-2 zoning to accommodate o proposed townhouse project. Adjacent land uses are: developed R-1 on the north and west, vacant R-1 on the south, developed R-2 on the east. The area is surrounded by R-1 development and townhouses are considered acceptable land use in on R-1 zone inasmuch as they are single-family, owner -occupied units. The R-2 request is simply to accommodate o small increase in density. The proponent plans to build 22 townhouse units as depicted on the site plan, and the increase in traffic is insignificant. The Planning d Zoning Commission i |y recommends this sf be approved, subject to the following condition: o. That the Planning d Zoning Commission approve the site plan prior to the building permit being issued. Ordinance No. 8412 in n000rdonoo with the notice published on February 9, 1983, in the Lubbock Avalanche -journal, a public hearing was held on the above matter. Proponent: Weldon Wines The Council was apprised that inasmuch as there was 20 percent written opposition by the surrounding property owners, this will require four -fifth's vote of the Council. & previous zone case requesting 8-2 had been denied by P&Z as they fa|f that it allowed too much of an increase in density for apartment units. The adjacent land uses are: commercial on the north and wesf, duplexes and apartments on the south, apartments on the east. For this particular request, P&Z decided that there was a large A-1 tract immediately east of the site in question across 40fh Street and this request was not inappropriate. There has been 20 percent oppuslflcm from the adjacent property owners primarily because Mr. Wines had previously built the "Moon F|ower» apartments on Brownfield Highway which has caused some concern for the residential area. As o result of the hearing of P&Z, the stated condition regarding the site plan being filed prior to the issuance of a building permit resulted. The discussion from the Council expressed concern over the type of fnoi|!fy he planned to build, and in response to Council query, Mr. Winos indicated that he did not know just exactly what the plans were. He did indicate that the tract in question would not accommodate the same number of units as constructed on Brownfield Highway referred to as the ,Moon Flower" apartments. It was the feeling of the Council that there needed to be more documentation available for them as to -' what Mr. Winos` plans were although there was no opposition to the requested zone After discussing the matter in depth with the staff and Mr. Wines and there being no opposition in the Council chambers, the hearing was closed. The motion was mode by Councilman Brown to approve the zone change "that really is not the issue --other concerns are, subject to, as indicated at the hearing, the approval of the site plan that would include an elevation/description of the structures to be bul|f before the building permit is issued." Horton, Assistant City Attorney The Council recessed at 11:18 a.m. for the Executive Session and reconvened at 1:50 p.m. for the following public hearing. 83-42-106-198 Hold a public hearing on the proposed annexation of an area of land containing (25) approximately 143.2 acres, more or less, adjacent to the existing corporate city limits, generally described as being south of 98th Street and east of Quaker Avenue. In accordance with the notice published on February 9, 1983, in the Lubbock Avalanche -Journal, a public hearing was held on the above matter. Proponent: David Holt The proponent requested that the approximate 143.2 acres is involved in the proposed annexation and that he and his family are the owners of this tract. A portion of the tract had previously been annexed and they would like the entire land to be unified. Ninety-eighth Street skirts a playa lake on the south, and Lakeridge is adjacent to the proposed annexation. The soft services that would be provided within 60 days under State Law relate to fire, police, inspection and other code enforcement matters. The staff apprised the Council that the first public hearing was held in the living room of a farm home located on the tract in accordance with the State Law require- ments, and the opposition that did speak at the P&Z hearing indicated that they objected on the basis that the request was concentrating more on annexing additional land rather than developing the vacant land within the City limits. The final vote at the P&Z hearing was three to two. The capital projects involved with this annexation can be completed within the 2 1/2 years of the effective date of the annexation pursuant to the State Law requirement and as specified on the Service Plan on file with the ordinance.
