At the 8:30 a.m. Work Session, limited comments were mode by members of the Council, to wit: Councilwoman Baker indicated that she was not advocating the sale of LP&L as indicated by the news media, but she did think that the citizens needed to make the decision and thus her recommended referendum. Mayor McAlister thought if was premature to have o referendum and that there needed to be greater details to present to the citizens, such as o prospective buyer, o prospective sale price, what to do with the money if sold, and related matters. Councilwoman Baker responded that the proceeds would be directed toward a third major water source in her opinion. Councilman Brown indicated that he had very |iff|e additional comment to make --previously having made his position known in the |*ffer to the Council listing all the options that were available for consideration --but that before any major funds for capital improvements were further expended, at least the parties (Utility Board, Council, and proposed buyer) could sit down and in a business -like manner discuss all the options available to resolve the situation. Subsequent to these discussions, the matter could be submitted to the voters. Coro|| McDonald indicated that, with the exception of purchasing right-of-way, no additional funds or im- provements would be mode until October of 1983; the West Inter -tie would not be completed until fall of 1985. Councilman Brown queried whether or not there were any objections to that method as proposed by him. Councilman Aderfon indicated that they needed to proceed with those projects that were under way and the matter should be put to rest for the time being; if, in the future, someone was interested in leasing, purchasing, or some other proposal and the approach was made to the City, if could be considered at that time. City Attorney Ross, in response to quory, indicated that as long as if was mad* clear to all parties that they were merely discussing and exploring facts in this matter, there would be no problems with such an approach. At the regular session, Lee Stafford, Chairman of the Electric Uf|(ifv Board, appeared before the Council and indicated that the Board had met and were unanimous in their position of retaining LP&L as o viable and operable entity of City government. He gave a brief historical background and cited that the first three months of the new fiscal year of 1982-83 showed o 100 percent increase compared to the some three months of the previous fiscal year; they had good equipment, good personnel, and could handle o day-to-day crisis in o proficient manner" He then read into the record o resolution adopted by the Electric Utility Board which appears undated but which was filed with the City Secretary after reading some into the record. ' Very |iff|e discussion ensued except that Councilman Brown did respond that he appreciated LP&L and the E|oofriu Utility Board and their loyalty and affirmative action; however, the Council has a broader responsibility to the citizens than does the Electric Utility Board and between the two there ought to be o compromise. He appreciated the historical comments that were mode, but the operation could not be continued on the concepts and facts of 1973--fhe elements of operation, of the national economy, and related matters n*oossifnfod facing reality. To explore the method of discussion and evaluation in a business -like manner over a conference fob|o between the Council and members of City Administration and on interested party over the next six months or so has merit and, as stated in Work Session, has the noncensus of the other members of the Council. The remainder of his remarks were those made of the 8:30 a.m. Work Session referenced above. 70 The motion was then made by Councilman Aderton to accept the resolution as presented by the Board and to move on work presently under way; any possible sale of LP&L would depend on any future offers from prospective buyers and the Council would take no further action until such overtures arise. Councilwoman Baker asked for a point of clarification, that being, "Let them make the first move." Councilman Brown asked Councilman Aderton if he would consider an amendment of placing a limitation of four to six months before proceeding with any major capital improvements (related to the West Inter -Tie scheduled for October of 1983) with the exception of the acquisition of right-of-way. Mayor Pro Tem Henry clarified that we are through studying and will proceed unless overtures are made --then we would take a look at it. Councilman Aderton accepted the amendment and all points of clarification being finalized, Councilwoman Baker seconded the motion as amended. The ballot was taken: 5 Yeas, 0 Nays. Mr. Stafford queried from the Floor that if the Council would like to state any guidelines regarding the rate of return on the investment, the Board and the Department would be most receptive. The conclusion was that this being rate - related, the recommendation would initiate with the Board as recommended to the Council. RESOLUTION A RESOLUTION BY THE ELECTRIC UTILITY BOARD AFFIRMING THAT LUBBOCK POWER AND LIGHT BENEFITS ALL OF THE CITIZENS OF LUBBOCK BY ITS EXISTENCE, AND THAT THE CITY COUNCIL AND THE UTILITY BOARD SHOULD PROTECT THIS BENEFIT FOR THE CITIZENS. WHEREAS, Lubbock Power and Light was founded by citizens of Lubbock for citizens of Lubbock to improve electric service to those citizens, and WHEREAS, the competition by two electric companies benefits all of the citizens of Lubbock, and to abolish one would create a monopoly. WHEREAS, the Electric Utility Board is appointed by and responsible to the Lubbock City Council in the areas of research, expansion, operational practices, and to enlarge, extend, preserve and promote an economic and businesslike administration of the Electric Utilities Department of the City of Lubbock, and WHEREAS, the Electric Utility Board is responsible for the promotion of sales of electrical energy by Lubbock Power and Light, and WHEREAS, the actions by this Board and the City Council directly affect the promotion and sales of electrical energy by Lubbock Power and Light, and WHEREAS, the Electric Utility Board has recommended to the City Council that the West Intertie be approved in the interest of savings to consumers using Lubbock Power and Light electric services. WHEREAS, until the future of Lubbock Power and Light is determined to be sound, the future of the resource recovery plant is uncertain. WHEREAS, local control by the City Council serves the best interest of the citizens of Lubbock, and a monopoly by a private electric company would cause relinquishment of this control to the State Public Utility Commission. LET IT THEREFORE BE RESOLVED BY THE ELECTRIC UTILITY BOARD OF THE CITY OF LUBBOCK, TEXAS: 1. That continued negative disucssions concerning the sale or lease of Lubbock Power and Light are detrimental to its market position. 2. That the Electric Utility Board recommends the City Council approve the West Intertie immediately in the interest of savings to the consumers of Lubbock Power and Light. 3. That the Electric Utility Board opposes any effort by the City Council or any of its members to sell or lease Lubbock Power and Light. 4. That the Electric Utility Board recommends the City Council put this issue to rest. /S/ Lee Stafford LEE STAFFORD, CHAIRMAN /S/ Edward Breihan /S/ John Mallo EDWARD BREIHAN JOHN MALLORY ISI Al Caviel AL CAVIEL ISI Jim Gilbreath JIM GILBREATH /S/ John Burdette JOHN BURDETTE /S/ Joe Norris JOE NORRIS 71 83-42-71-113 Ordinance No. 8394 - Zone Case 2385 (10) - An ordinance changing part of Lots 3 and 4, Block 7, Morning View Addition from R-1 to A-2 zoning district, located at East 2nd Street and Niter Avenue. Motion carried: 5 Yeas, 0 Nays. 83-42-73-126 Zone Case No. 2143-A (23) Continue public hearing on the request of Bill Stinson and Wayne Pierce (for South See page 61 of University Development Company) for a Specific Use zone change, from C-2 to C-4 1/27/83 Minutes Specific Use Permit under provisions of Sec. 22.3-23 of the Zoninq Ordinance for a for publisher's bowling center, alcoholic beverage sales and C-2 uses on Tract A, Sandalwood Village affidavit Addition, located at 78th Street and University Avenue. The Planning and Zoning Commission recommends this request be approved, subject to the following condition: a. That a seven -foot screening fence of masonry or cedar construction be placed from the buildinq east to the property line and south to the south property line; that the fence be constructed concurrent with the first building;t Ordinance No. 8407 In accordance with the notice published on January 12, 1983, in the Lubbock Avalanche -journal, a public hearing was continued on the above matter. Mayor McAlister said that because there was 20 percent opposition from adjacent property owners, the Council's action would require a four -fifth's vote. 74 Proponents: Wayne Pierce Ron Sebring, Architect with Hallmark Bill Stinson This request is for a bowling alley with an alcoholic beverage permit as o part of on overall shopping center plan. it is on o froof of land adjacent to the KLBK Television Station which is a legal nonconforming use and is currently zoned R-1. ' Adjacent land uses are: legal nonconforming television station on the north, R-2 and veterinary clinic on the south, single-family development on the east and west. In August of 1977, a zone case was filed in this subdivision at which time was requested C-2 zoning; the staff recommended against C-2 zoning of that time because if was inconsistent with the comprehensive plan nor was it consistent with the commercial development policies. The P&Z found in favor of the proponent and granted C-2 zoning at that time because of its location in proximity to the television station. There were six neighbors who spoke in opposition to the above request, their | opposition being primarily against the alcoholic beverage permit or the consumption of alcohol on the premises as well as the potential traffic problems caused by u | bowling n\|ey~ The proponents came prepared! They had elevations of the architect's concept of the proposed structure with landscaping and internal layout of the various facilities that accompany a large 40-lane bowling alley center; they had visual aids regarding the traffic flow and the number of vehicles that a league season will precipitate; they had traffic statistics regarding vehicles required in attendance of tournaments; they had o survey of the other existing bowling alleys of comparable size; they had projected revenues that m 40-|ene bowling center would generate as if affected hotel/motel, restaurants, retail soles (shopping) --you name if, they had if! The structure would consist of 40,000-42,000 sq ff; the industry indicates that one lane would serve a population of 10,000, and if is anticipated that this center will have 40 lanes. They had the statistics to support the number of existing bowling |,anes in the city (142,000}; and statistics would show that a population fhesaize of Lubbock could accommodate 200 |on*s, so their summation is that there is o market for o bowling center. They provided statistics for tourism, the various tournaments that are available, and the amount of money that was spent at the Wnmen/s Bowling Association Tournament in 1982 (there is n men's tournament scheduled in March) as well as the capability of having bowling tournaments sponsored by various charities. Opponents: Bill Freeman 2013 75fh Street Rickey Woody, 2315 78fh Street Dr. Richard Bartsch, 2604 77th Street All of the opponents spoke in terms of the |nonmpafobi|ify of this facility to residential and neighborhood living --it would precipitate increased traffic flow and congested traffic and be detrimental to property values. They requested that the Council hold to the neighborhood oompafabi\ify concept by denying this request. The sfaff's position to the Council was the same as that before P&Z in that if was not consistent with the comprehensive plan and to grant C-4, which is designed for heavy retail and wholesale commercial, is incompatible with this location; the site plan reflected no specific landscape detail; they were considerably short on the required parking spaces --a bowling alley requires one space for every 100 sq ff of gross floor space plus with an alcoholic beverage permit one parking space for every 50 sq ff for a fofm| of 842 spaces of which they only had 306. The rebuttal ensued both to the opponents' and the sfoff/s positions, and with this confer being a portion of this shopping center represented by Mr~ Stinson as being developed as soon as possible, there would be overflow parking on adjacent tracts that would be developed and surfaced. Mr. Stinson also indicated that they had requested, in the event the facility ceases to be a bowling center, that the property revert to C-2 zoning which would eliminate the continuation of alcoholic beverage ao|e and/or consumption. Following all discussion and testimony, the hearing was closed. In order not to become confused over the 60-40 issue associated with alcoholic beverage permits being granted as o part of another type of C-4 facility, Mayor Pro Tem Henry suggested that the caption of the ordinance be revised removing the comma offer the word ^oonfern which should read, `'...for a bowling center with alcoholic beverage o The motion was then made by Mayor Pro Tem Henry and seconded by Councilwoman Baker to pass Ordinance No. 8407 on first reading granting the requested zone change subject to the condition that u seven -foot screening fence of masonry construction only be placed from the building east to the property line and south to the south property line, that the fence be constructed concurrent with the first building permit; and that the property will revert to C-2 zoning in the event that the bowling center facility ceases to be a bowling center. Motion carried: 5 Yeas, O Nays. Following the action on this matter, Mayor Pro Tem Henry requested City Attorney Ross to complete the '|ong-owaifed study of the 60-40 issue in general, particularly as if would relate to o bowling center, and to submit the recom- mendation of the Legal Department on this matter to the Council in the near future. 75 0IU)Z0A0CE NO. 8407 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK 88 AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2143-A; A SPECIFIC _ USE ZONE CHANGE, FROM C-2 TO C-4 SPECIFIC USE PERMIT D0D0l PROVISIONS OF SECTION 22.3-23 OF THE ZONING ORDINANCE FOR A BOWLING CENTER WZIB ALCOHOLIC BEVERAGE SALES AND C-2 USES ON TRACT /\, SANDALWOOD VILLAGE ADDITION TO THE CITY OF LUBBOCK, LUBBOCK ' COUNTY, TEXAS; SUBJECT TO CONDITIONS; PROVIDING FOR & PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. 83-42-75-127 (24) * See page 61 of 1/27/83 Minutes for publisher's affidavit Zone Case No. 2390 Appeal of Charles E. Hunter f Lot 10, Lowery Subdivision, from R-1 to R-2 and M-1 zoning districts, located at Brownfield Highway and Dover Avenue. The Planning d Zoning Commission Ordinance No. 8408 In accordance with the notice published on January 12, 1985^ in the Lubbock Avalanche -Journal, a public hearing was continued on the above moff------' ` Proponent: C. E. Hunter, for Hunter Millworks Appearances: Jack Woody, an adjacent business neighbor Gene Whitney, representing neighbors in opposition This request is to allow for expansion of the Hunter Millworks which found it necessary to relocate in 1972 as a result of the Canyon Lakes Project. 8d'ouont land uses are; developed industrial on the north, duplex zoning and existing R_l development on the south, developed commercial on the east, existing industrial development on the west. The nature of this business could be found appropriate for M-1 uses with modification. The soufh portion of the tract in question is requested to be R-2, the front portion facing Brownfield Highway is requested to be rezoned M-1. The request met with considerable opposition - from adjacent neighbors primarily due to the fact that the operation produces on outside noise that is objectionable, the noise coming from on outside filtering system that is installed in ha existing building. The desired expansion would need to be restricted from continuation of this nuisance. Mr. Hunter indicated that a compromise had been reached with the neighbors and he therefore requested that that portion of the tract requested for R-2 zone change be dropped from the request and on| `fhof portion requested for N-1 zone change facing Brownfield Highway would remain o part of the zone request; that the alley on the east be closed and o dedicated o||oy between the two tracts be approved; that the operation be limited to architectural millworks; and that a masonry fence on the - south and *osf side of the building be constructed. The staff submitted some additional recommendations to be considered as conditions -- that there be five percent landscaping of the lot, that the requested alley closure and dedication would be handled through the platting process, that there would be no outside display and only architectural millworks be allowed. Mr. Gene Whitqey, representing the homeowners, appeared and indicated that as o result of the compromise and the stated conditions, the neighborhood would withdraw any opposition provided there would be assurances these conditions would be implemented. Following the discussion and all testimony, the hearing was closed and the motion was mode by Councilman Brown and seconded by Mayor Pro Tem Henry to overturn P&Z, approving the request with the following modifications: 1^ That the R_2 zone change froof be deleted from the request and M-1 zone change be granted on the remaining portion, contingent on an alley being dedicated between the two tracts and closing the alley presently existing on the east which would be handled through the platting process; 2° That five percent landscaping of the entire lot be required for the project; 3. That only architectural millworks be allowed in the expansion; 4~ That there would be no outside display. Motion carried: 5 Yeas, 0 Nays. Mrs. Blankenship, Project Chairman of the Jubilee 75 Celebration, apprised the Council of the need for the requested monies to restore Broadway Avenue using the paver bricks that had been previously purchased. She indicated that there are a series of celebrations and this project would be most beneficial in preparation for the following events: in 1983, Texas Tech will celebrate its hD years of receiving the Charter to become on academic institution; in 1974° the City of Lubbock will celebrate its 75th Jubilee; in 1985, Texas Tech will celebrate its 60fh year as on accredited institution; in 1986, Texas will have its Sesquicentennial Celebration (150 years).
