Consider an ordinance adopting the 1982 Uniform Building Code Ordinance No. 8379 Mr. Raymond Powell appeared before the Council to apprise them of the proposed ordinance adopting the 1982 Uniform Building Code. The Uniform Building Code is modified nationally on an annual basis and is amended locally as necessary to fit the needs of the individual municipality. Every third year a new edition of the Uniform Building Code is published with all the preceding 3-year corrections and modifications incorporated therein. The Code Study Committee functions as a Building Board of Appeals and the Chairman of the Code Study Committee is appointed by the Board Chairman. Members of the Code Study Committe are as follows: Leon Davidson Ted Ratcliffe Aubrey Faulkner Jr. *Raymond Powell Pat Hobbs Durwood Finley E. Hoyse McMurtry M. B. Smith Henry Huneke Terry Echols Bill Cox Stan Angelley Raleigh Hudzeitz Michael Landress *Chairman Builder Real Estate Aubrey Supplier Architect Real Estate Westway Supply Company Architect West Texas Homebuilders Association Builder Architect Architect Builder Construction Superintendent/Architect Architect A review of the Code was conducted on a chapter -by -chapter basis and the amendments were voted on by the Committee as reflected in the proposed ordinance. Those items noteworthy are: (1) A sentence was added whereby the Building Code is the controlling document in cases where the Fire Code is in conflict (2) A number of previously amended items have been incorporated into the basic document (3) An increased fee for re -roofing without a permit (4) Failure of contractors/owners to obtain final inspections may lead to termination of building utilities within five days rather than ten days. (5) Smoke detectors in basements of residential units shall be wired in parallel to sound all the alarms in the residence if activated. (6) Laminated glass may be substituted for wired glass, if approved. (7) Inclusion of Appendix 7 (part 1) regarding atriums. (8) Inclusion of Appendix 32 regarding re -roofing. (9) Inclusion of Appendix 55 regarding membrane structures. There are other amendments in reference to the Code contained within the body of the ordinance on file in the Office of the City Secretary. The motion was made by Councilwoman Baker, seconded by Councilman Aderton to pass Ordinance No. 8379 adopting the Uniform Building Code on first reading. Motion carried: 4 Yeas, 0 Nays. Consider an ordinance adopting the 1982 National Fire Code. Ordinance No. 8380 Mr. Powell appeared simultaneously to make the recommendation regarding the new Fire Code because the two services are so closely related and this would enable the public to review and comment on both ordinances if desired. The Code has NOV 1 " : ,' 1467 77 J been reviewed by the Fire Department personnel and there are two amendments contained therein: (1) The authority of the Fire Marshall is limited. (2) A penalty clause is incorporated therein. There being no discussion, the motion was made by Councilwoman Baker, seconded by Councilman Aderton to pass Ordinance No. 8380 on first reading adopting the 1982 National Fire Code. Motion carried: 4 Yeas, 0 Nays (Henry was absent). Ordinance No. 8372 An ordinance regulating and licensing coin -operated machines and gamerooms. This ordinance was read on first reading on September 23, 1982 with revision of Sections 26-55, 26-56, and 26-57 which speaks to the revocation of the operator's permit and the appeal process. The Ordinance also provides a grandfather's clause for those gamerooms in existence by November 3, 1982 with stringent parking requirements. The original purpose of updating this ordinance was to combine scattered gameroom and curfew ordinances previously passed and to serve as a revenue -producing vehicle in compliance with the State regulations on gamerooms---licenses and fees. The delay has resulted from one incident between two property owners that became "sticky" and in order to allow the two property owners to resolve their problems, the Council requested that no action on second reading be taken until this date. Mr. 0. V. Scott, attorney on behalf of Bob Jordan Amusement Company appeared before the Council again and asked that Section 26-56 (b) be deleted and that the rest of the ordinance be passed as that portion of the ordinance (26-56b) was the portion relating to the dispute between the two property owners. Councilman Brown again stated that he did not feel the ordinance solved any of the problems that existed originally; that he didn't particularly like the ordinance as it was presented but would not vote against it if the rest of the Council felt that it basically served the purpose for which it was created. 1468 82-41A-1468-2231 (13) 82-41A-1468-2232 (9) The Mayor responded that he felt the section in question could be used as a harassment from one owner/operator against another. Councilwoman Baker said that she didn't particularly like the ordinance, but that it was designed as a revenue -producing instrument and could concur with the removal of the section in question. In response to Council query, Mr. Scott indicated that the lease for the Space Station parking provisions had been finalized and that he would send a copy of the lease as soon as it had been recorded. In response to Council query regarding public nuisance, City Attorney Ross responded that the Council could pass any ordinance on what they considered to be a public nuisance for greater enforcement on these type situations. Following all the discussion, the motion was made by Councilman Aderton, seconded by Councilwoman Baker to pass Ordinance No. 8372, deleting Section 26-56 (b). Motion carried as amended: 4 Yeas, 0 Nays (Henry was absent). SMH:da ORDINANCE NO. 8372 AN ORDINANCE AMENDING CHAPTER 26 OF THE CODE OF ORDINANCES, CITY OF LUBBOCK, ENTITLED "PUBLIC AMUSEMENTS", BY REPEALING SECTIONS 26-44 THROUGH 26-61 (BEING ARTICLES ENTITLED "COIN -OPERATED MACHINES" AND "BILLIARD AND POOL HALLS") AND IN ITS STEAD ADOPTING A NEW ARTICLE VI ENTITLED "COIN -OPERATED MACHINES"; PROVIDING FOR A PENALTY: PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. Consider an ordinance to abandon and close a portion of a street and alley in Lot 1, Block 2, Suburban Homes Addition. Ordinance No. 8381 This ordinance will abandon and close a portion of 49th Street and alley which is located on Lot 1, Block 2 Suburban Homes Addition (East of Avenue H). These public ways were dedicated July 1, 1977 and the adjacent property owner (HUB City Bodyworks, Inc.) is in the process of expanding their facilities and are platting the property. They are the original dedicator, so no fee will be charged for the closings, with the exception of the $150 application fee. The motion was made by Councilwoman Baker, seconded by Councilman Aderton to pass Ordinance No. 8381 on first reading. Motion carried: 4 Yeas, 0 Nays (Henry was absent). JWF:da ORDINANCE NO. 8381 AN ORDINANCE ABANDONING AND CLOSING THE FOLLOWING PORTIONS OF STREET AND ALLEY: A PORTION OF 49TH STREET AND A PORTION OF ALLEY IN BLOCK 2, SUBURBAN HOMES ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAP OF THE CITY OF LUBBOCK TO INDICATE THE CLOSING AND ABANDONMENT OF THAT CERTAIN STREET AND ALLEY PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. Stan McElroy will appear to request paving of 53rd and Chicago streets. Mr. Stan McElroy appeared before the Council to appeal a long-standing City policy which does not allow half -street widths to be placed on the City paving program. On November 14, 1972, Tract A, Newman Addition, was platted by Roehr Construction Company who paid $10,212.59 in pre -paid fees for future improvements of the two streets in question. At the time of this plat, Bangor Avenue from 53rd to 50th Street was paved as new subdivision paving. Mr. McElroy contends that at the time the City approved his request to pave half of 53rd and half of Chicago, they intended for it to be placed on the City Paving Program. This is contrary to the Engineering Department's contention that to do so would be in violation of the long-standing policy of not placing half -width streets on the Paving Program, but to handle the project by separate contract. If approved, the City would be paying for these improvements with the $10,212.59 in pre -paid payments, plus an additional $16,629.03 for a total of $26,841.62. Mr. McElroy contends that this pre -payment paving fee has not been interest bearing and therefore has been without the benefit of this revenue which would underwrite the total estimate as stated by the Engineering Department. The staff indicated that to approve such would be in violation of the policy and would set a precedence that would be difficult to comply with in the future. The reaction of the Council to Mr. McElroy's situation was mixed ---Councilman Brown felt that the City owed the landowners something, although he could not recommend what would be fair and equitable; Councilwoman Baker stated that any pre -paid payments for paving improvements that was without firm future developmental plans was a chance the property owner took; Councilman Aderton indicated there was no control on the time and place for developmental plans and therefore there was no obligation involved. nov 18 198Z 146-9 Following the discussion, the motion was made by Councilwoman Baker, seconded by Councilman Aderton to deny Mr. McElroy's request for the referenced paving project. 3 Yeas, Brown Nay (Henry was absent). 82-41A-1469-2233 Consider the recommendation of Lubbock Soccer Association regarding the contribution (14) made previously to the City. On June 18, 1982 representatives of the Lubbock Soccer Association appeared before the Council and presented a check for $10,000 to be used for the construction of an observation tower in the Huffman Athletic Complex. The Board of Directors of the Association now believe it is unnecessary and undesirable to build such a structure and have requested that the fields be improved for play and therefore would like $4000 of the $10,000 previously presented to be expended for grass seed on fields 9- 29 exclusively. It is the staff's recommendation that the $10,WO be returned to the Lubbock Soccer Association since they are no longer interested in constructing the tower and that we accept $4000 as outlined in their letter to purchase grass. This would eliminate complicated accounting and would allow for them to contribute whatever they wish for additional improvements to the playing fields. The motion was made by Councilman Aderton, seconded by Councilwoman Baker to return the $10,000 previously submitted and in turn to receive a contribution of $4000 for the purchase of grass seed to be used exclusively on the soccer playing fields at the Berl Huffman Athletic Complex. Motion carried: 4 Yeas, 0 Nays (Henry absent). 82-41A-1469-2234 Consider a resolution authorizing the Mayor to sign a contract with GHS Development, (15) Inc. *Copy of Proposal Package Resolution No. 1265 i ifrom GHS Developers, Inc. Ifiled w/ original GHS Development Corporation has submitted a proposal to construct a theme park in ;resolution. Mackenzie State Park. At the work session, an indepth report and slide presentation was made by Dan Kamp, Director of Parks and Recreation, followed by a discussion of the main points of negotiation with the GHS firm with the contract to be finalized by December 1, 1982. The deadline for the opening would be May, 1983. Some of the items included in the contract relate to weekly maintenance (approximately $100 per week) during the growing season; pruning and shaping of existing trees; removal of a restroom on the lower level; removal of weeds and underbrush along the canyon wall; regular police patrol; grading of the parking lot; regular vector control; and a detailed description of the site. Additional indepth explanation is attached to the resolution and contract on file in the office of the City Secretary. Some of the effects to existing facilities would be that the Terrace Party House would be used as an arcade -refreshment complex and accompanying architecture should be compatible with the existing facilities; the pottery center would be relocated; the relocation of the swimming pool would be delayed until delivery of equipment, but the youth pool would be used as it is; the existing waterway would be used for paddle boat operation. The Council was receptive to the report as presented and one of the principals of the GHS firm (Gary Slaughterhouse from Odessa) was present and the Council thought this was a good example of public and private sector working together. In response to Council query as to how soon construction would begin, City Manager Cunningham responded in about a week. The motion was made by Councilman Brown, seconded by Councilwoman Baker to pass Resolution No. 1265 authorizing the proposed contract with GHS Development, Inc. for the development of a Water Theme Park to be located in the northern portion of Mackenzie State Park. Motion carried: 4 Yeas, 0 Nays (Henry absent).
